ORDINANCE NO. 96-015
AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING FOR THE
ESTABLI5HMENT OF MAXIMUM, REASONABLE AND PRUDENT RATES OF SPEED
ON CERTAIN PORTIONS OF CERTAIN STREETS AND HIGHWAYS AND PUBLIC
PLACES IN THE CITY OF PARIS; PROVIDING FOR A PENALTY NOT TO EXCEED
$200.00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF APRIL
1, 1996.
WHEREAS, the Transportation Operations Office of the Texas Department of
Transportation prepared an engineering and traffic study and survey to determine the maximum,
reasonable and prudent speeds for vehicles traveling upon certain portion of certain streets and
highways, and parts thereof, the most effective use of said streets and highways, and the safest
and most effective movement of vehicular traffic thereon; and,
WHEREAS, such study and survey recommends certain maximum, reasonable and
prudent rates of speed for vehicular traffic upon said streets and highways, and parts thereof,
located within the City of Paris, and it is deemed appropriate that the City Council of the City
of Paris establish the same based on such recommendation; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS:
Section 1. That the following maximum, reasonable and prudent rates of speed for
vehicular traffic upon certain streets and highways located within the City of Paris, as
determined by an engineering and traffic study and survey prepared by the Transportation
Operations Office of the Texas Department of Transportation, be, and the same are hereby,
established as hereinafter set out for the streets and highways and portions thereof to which they
apply:
(a) No person shall drive a vehicle upon a public road, street or highway
located in the City of Paris at a speed greater than is reasonable and prudent
under the conditions and circumstances then existing. Except when a special
hazard exists that requires lower speeds for compliance with the above
requirement, the limits hereinafter set out shall be lawful, but any speed in excess
of the limits as hereinafter set out for the streets and highways, and portions
thereof, to which they apply shall be prima facie evidence that the speed is not
reasonable or prudent:
(1) On F.M. Highway 905, southeasterly from the
centerline of Loop 286 to the City Limits of Paris, a distance of
approximately 0.780 miles, a speed limit of forty-five (45) miles
per hour at all times, as evidenced by the plan attached hereto as
Exhibit A;
(2) On F.M. Highway 79, southerly from the north City
Limits of Paris, a distance of approximately 1.008 miles, a speed
limit of forty-five (45) miles per hour at all times; thence southerly
a distance of approximately 0.626 miles, a speed limit of forty (40)
miles per hour at all times; thence southerly to the centerline of
BU 82 H(Bonham Street), a distance of approximately 0.613
miles, a speed limit of thirty-five (35) miles per hour at all times,
except that a school speed limit of twenty (20) miles per hour will
be effective on school days, from approximately highway milepoint
22.014 to approximately milepoint 22.304 only during the
following hours: from 45 minutes before school opens until
classes begin; from the beginning to the end of the lunch period,
if needed, and for a 30 minute period beginning at the close of
school, as evidenced by the plan attached hereto as Elchibit B;
(3) On Spur Highway 139, easterly from the centerline US
82/US 271 to the centerline of F.M. Highway 195, a distance of
approximately 0.791 miles, a speed limit of fifty (50) miles per
hour at all times, as evidenced by the plan attached hereto as
Exhibit C;
(4) On F.M. Highway 1508, southwesterly from the City
Limits of Paris to the centerline of US 271, a distance of
approximately 0.900 miles, a speed limit of fifty-five (55) miles
per hour at all times, as evidenced by the plan attached hereto as
Exhibit D;
(5) On F.M. Highway 195, northeasterly from the
centerline of BU 82 H(Lamar Avenue), a distance of
approximately 0.200 miles, a speed limit of thirty (30) miles per
hour at all times; thence northeasterly a distance of approximately
1.100 miles, a speed limit of forty (40) miles per hour at all times;
thence northeasterly to the north City Limits of Paris, a distance
of approximately 0.972 miles, a speed limit of fifty (50) miles per
hour at all times, as evidenced by the plan attached hereto as
Exhibit E.
Section 2. Any person violating any of the provisions of this ordinance shall be guilty
of a Misdemeanor and, upon conviction, shall be fined in any sum not to exceed $200.00, and
each and every day's continuance of any violation of the above enumerated section shall
constitute and be deemed a separate offense.
Section 3. All ordinances or parts of ordinances in conflict herewith are hereby
expressly repealed.
Section 4. This ordinance shall become effective on April 1, 1996.
