AN ORDINANCE CONTAINING A HF,ARING ON PROPERTIES LOCATED IN THE CITY
OF PARIS, TEXAS, BELONGING TO VARIOUS OWNERS, AND AN ORDINANCE OF THE
CITY COUNCIL FINDING THE MATERIALS REMAINING ON THE PREMISES TO
CONSTITUTE A NUISANCE AND TO BE A FIRE HAZARD TO LIFE AND PROPERTY AND
A HAZARD TO THE LIFE AND WELFARE OF THE INHABITANTS OF THE AREA, AND
ORDERING SAID RUBBISH, LUMBER AND REFUSE FROM THE STRUCTURES TO BE TORN
DOWN AND REMOVED FROM THE PREMISES IN ORDER TO ABATE SUCH NUISANCE.
PROVIDING FOR A PENALTY NOT TO EXCEED $2,000.00; AND PROVIDING FOR AN
EFFECTIVE DATE OF FEBRUARY 1, 1995.
WHEREAS, a public hearing was called to order by the Mayor of the City of Paris, Don
Shelton, on the Sth day of January, 1995, at 6:00 o'clock P.M., in the Council Room, City Hall, 135
lst Street S.E., in the City of Paris, Texas; and,
WHEREAS, the City Council finds that the Building Hazard Inspection Committee fixed a date
for hearing on the resolution referred to the Committee by the City Council on the 14th day of
November, 1994, and said Committee fixed said hearing at 10:00 o'clock A.M. on the 16th day of
December, 1994, and the hearing was had thereon. That proper notice was given to the owner or
owners of the structures located at the following addresses:
405 Evergreen, W. 50' Lots 6& 7, Block 8, Neagle Addition
1567 S. Main Street, Lot 7, Block 14, Texas & Pacific Addition
1004 8th Street S.E., Lots 1& 2, Block 6, Gibbons Park Addition
1161 3rd Street N.W., Lot 2-A, City Block 97
1100 Block 9th Street N.W., Lot 11, Block l, Elliott Addition

That at said hearing the Committee listed the structures involved and introduced pictures of the various
portions of the structures and various portions of the premises involved and a list of discrepancies in
the structures located thereon. That the Committee found that each of the above structures was in such
state of deteriorarion and dilapidation as to create a serious fire hazard to life and property and that
each of said structures was dilapidated and was dangerous to life and property. That said buildings
are in such a state of dilapidation and decay that none of said structures are capable of repair. It is
further found that the condition of the premises and structures involved was such that the Committee
recommended to the City Council that they be declared a nuisance and that the owners thereof be
ordered by the City Council to tear down and remove the same from the lots involved. That said
Committee filed a complete report of its hearing and its findings with the City Clerk of the City of
Paris on the 22nd day of December, 1994; and,
WHEREAS, the City Council further finds that proper notice was given to the owner or owners
of the structures hereinafter listed. That at said hearing on the 16th day of December, 1994, the
Committee listed the structures involved and introduced pictures of the various portions the structures
and various portions of the premises involved and a list of discrepancies in the structures located
thereon. That the Committee found that each of the hereinafter listed structures was in such a state
of deterioration and dilapidation as to create a serious fire hazard to life and property, and that each
of said buildings was dilapidated and dangerous to life and property and dangerous structures to life
and property. That the owners of the property appeared before the Committee and requested time to
repair the structures or the Committee found that the structures could be repaired. That it was the
recommendation of the Committee that the structures be condemned or repaired and that the respective
owners thereof be given the time to abate said nuisance by repair or removal as is set out in connection
with each of such addresses, as follows:
960 & 962 S. Main Street, 6 months to repair or
Lots 12 & 12A, City Block 157 demolish and remove
429 E. Sherman, 60 days to repair or
Lot 9-A, City Block 141 demolish and remove
206 24th Street S.E., 30 days to submit plan
Lots 45, 47, 49 & S. 10' Lot 43, and obtain permit
Block 2, Lamar Terrace
1415 W. Plum, 6 months to make repairs or
Lot 2, Block 4, Harrison 9th Addition demolish and remove
1306 Bonham, Lot 5, City Block 189 30 days to make repairs or
demolish and remove

Lot 6, Block 2, Hull Addition demolish and remove
1145 E. Martin Luther King, Jr. Drive, 45 days to make repairs or

and it is so stated in the report of the Building Hazard Inspection Committee filed with the City Clerk
of the City of Paris on the 22nd day of December, 1994; and,
WHEREAS, the City Council has fully heard and considered the testimony presented upon the
hearing and a complete transcript of the testimony reported by the Building Hazard Inspection
Committee; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS:
Section 1. That the structures located at the following addresses:

are a nuisance, and they are hereby declared a nuisance, in that they are dangerous to life and
property, and that the same constitute a fire hazard to life and property, and that the respective owners
are hereby ordered to abate such nuisance within thirty (30) days from the date hereof. That the
structure located at the following address:
437 E. Garrett, Lot 5, Block 4, Washington Heights Addition
is a nuisance, and it is hereby declared a nuisance, in that it is dangerous to life and property, and that
the same constitute a fire hazard to life and property and that the respective owner is hereby ordered
to abate such nuisance within sixty (60) days from the date hereof. The City Clerk is directed to
furnish the owners a copy of this ordinance, in the event the addresses of said owners are known, and
in the event the respective owners refuse to comply with this ordinance, the City Attorney, T. K.
Haynes, is hereby directed to proceed to enforce this ordinance by the procedure provided for in
Article III of Chapter 7 of the Code of Ordinances of the City of Paris.
Section 2. That the structures hereinafter enumerated are a nuisance, and they are hereby
declared a nuisance, in that they are dangerous to life and property, and that the same constitute a fire
hazard to life and property, and that the respective owners are hereby ordered to abate such nuisances
on or before the dates set out in connection with the addresses of each of such structures, as follows:
960 & 962 S. Main Street, August l, 1995, days to repair or
Lots 12 & 12A, City Block 157 demolish and remove
429 E. Sherman, April 1, 1995, to repair or
Lot 9-A, City Block 141 demolish and remove

Section 3. It shall be unlawful for the owner of property to fail to comply with an order of
the City Council given pursuant to Section 7-52, within the time specified in such order. It shall be
a defense to the violation described herein that the time given in the order of the City Council has been
extended by the City Council.
Section 4. Any person violating any of the provisions of this ordinance shall be guilty of
a misdemeanor and upon conviction shall be fined in any sum not to exceed $2,000.00, and each and
every day's continuance of any violation of the above enumerated section shall constitute and be
deemed a separate offense.
Section 5. This ordinance shall become effective on February 1, 1995.
The City Clerk is directed to furnish the owners a copy of this ordinance, in the event the addresses
of said owners are known, and in the event the respective owners refuse to comply with this ordinance,
the City Attorney, T. K. Haynes, is hereby directed to proceed to enforce this ordinance by the
procedure provided for in Article III of Chapter 7 of the Code of Ordinances of the City of Paris.
