ORDINANCE NO. 95-040
AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING THAT
THE CODE OF ORDINANCES, CITY OF PARIS, BE AMENDED BY REVISING
SUBSECTIONS (a) AND (b) OF SECTION 3423, ESTABLISHING A SEWER SERVICE
RATE FOR CUSTOMERS USING CITY WATER; REVISING SUBSECTIONS (a) AND
(b) OF SECTION 3424, ESTABLISHING A SEWER SERVICE RATE FOR
CUSTOMERS NOT USING CITY WATER; PROVIDING FOR A PENALTY NOT TO
EXCEED $2,000.00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES
IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF
NOVEMBER 1, 1995.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARI5:
Section 1. That Subsections (a) and (b) of Section 34-23 of the Code of Ordinances of
the City of Paris, Paris, Texas, be, and the same are hereby, amended so that such shall read
as follows:
"Section 3423. Sewer rates - For customers using City water.
(a) Charges for sewer service furnished by the City to residenrial,
commercial and industrial customers sha11 be based upon customer class and
meter size, incorporating a base monthly cost for the first increment of usage and
a cost for each additional one hundred (100) cubic feet above the first increment,
as follows:

(b) Monthly residential customers' wastewater volume sha11 be based
upon one-hundred (100) percent of the actual metered potable water consumption
up to the maximum amount represented by the average of the preceding
November, January and February consumption, which shall be known as the
"winter average". If no historical water consumption data is available for a
customer, that customer's wastewater volume sha11 be based upon one-hundred
(100) percent of the actual metered potable water consumption up to the
maximum amount represented by the winter average established by the residential
class.
Monthly commercial and industrial customers' wastewater volume shall
be based upon one-hundred (100) percent of the actual metered potable water
consumption, except those customers whose wastewater is metered, and their
volume sha11 be based upon one-hundred (100) percent of the metered wastewater.
The former shall be billed for one-hundred (100) percent of the metered potable
water and the latter shall be billed for one-hundred (100) percent of the metered
wastewater.
Section 2. That Subsections (a) and (b) of Section 34-24 of the Code of Ordinances of
the City of Paris, Paris, Texas, be, and the same are hereby, amended so that such shall read
as follows:
"Section 34-24. Same-For customers not using City water.
(a) Wastewater service to customers who do not receive water service
from the City shall be billed monthly based upon one hundred (100) percent of
consumption based upon information obtained from water supplier, plus a service
charge not to exceed five dollars ($5.00) for collecting the water consumption
information from the water supplier.
(b) Commercial and industrial customers without sewer meters will be
charged on the basis of one hundred (100) percent of the actual metered water
consumption. "
Section 3. The rates established in Sections 1 and 2 above will be effective with billings
beginning November 1, 1995.
Section 4. Any person violating any of the provisions of this ordinance shall be guilty
of a Misdemeanor, and, upon conviction, sha11 be fined in any sum not to exceed $2,000.00,
and each and every day's continuance of any violation of the above enumerated secrion shall
constitute and be deemed a separate offense.
Section 5. All ordinances or parts of ordinances in conflict herewith are hereby
expressly repealed.
Section 6. This ordinance sha11 become effective on November 1, 1995.
