AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY
OF PARIS, PARIS, TEXAS, AND CHANGING THE BOUNDARIES ESTABLISHED BY
THE ZONING MAP OF SAID CITY; ESTABLISHING A COMMERCIAL DISTRICT (C)
WITH SPECIFIC USE PERMIT (49) AUTO FUEL SALES ON LOT 11, CITY BLOCK
315, ON PROPERTY BELONGING TO SAMMY BOLTON, SO AS TO INCLUDE
THEREIN TERRITORY FORMERLY DESIGNATED A5 A COMMERCIAL DISTRICT
(C); DESIGNATING THE BOUNDARIE5 OF THE COMMERCIAL DISTRICT (C) WITH
SPECIFIC USE PERMIT (49) AUTO FUEL SALES SO ESTABLI5HED; PROVIDING
FOR A PENALTY NOT TO EXCEED $2,000.00; REPEALING ALL ORDINANCES OR
PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN
EFFECTIVE DATE OF JANUARY 1, 1996.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS:
Section 1. That the boundaries heretofore established by the Zoning Map and Ordinance
No. 1710 of the City of Paris, Paris, Texas, be, and the same are hereby, changed, and that a
COMMERCIAL DISTRICT (C) WITH SPECIFIC USE PERMIT (49) AUTO FUEL SALES
be, and the same is hereby, established on LOT ll, CITY BLOCK 315, on property belonging
to SAMMY BOLTON, so as to include in such COMMERCIAL DISTRICT (C) WITH
SPECIFIC USE PERMIT (49) AUTO FUEL SALES the hereinafter described property, which
was formerly and is presently designated as a COMMERCIAL DISTRICT (C), and that the
boundaries of said COMMERCIAL DISTRICT (C) WITH SPECIFIC USE PERMIT (49) AUTO
FUEL SALES, be, and the same are hereby, established as follows:
SITUATED within the corporate limits of the City of Paris, County of
Lamar, and State of Texas, and being all that certain tract or parcel of land
situated in the Enoch Crow Survey, No. A-208, located 3 miles East from the
Public Square in the City of Paris, Lamar County, Texas, being all that certain
Lot 11 of Block 315 as reflected on the Tax Maps of the City of Paris and being
the same property described in deed to Hoyd Branch et al., dated March 8, 1995,
of record in Book 511, Page 167, Lamar County Real Property Records, also
being part of that certain 9 acre tract described in a Deed from Clyde Louise
Arnold to Gene Arnold, et al, dated August 17, 1989, recorded in Vol. 105, Page
194, Real Property Records of Lamar County, Texas and being more particularly
described as follows;
BEGINNING at a found 1/2" capped iron pin for corner, being on the
southwest corner of said 9 acre tract, being on the North boundary line of Lamar
Ave. which is also U.S. Hwy 82, and being on the Southeast corner of a 0.3182
acre tract described in a Deed to Wal-Mart Stores, dated March 20, 1994,
recorded in Vol. 431, Page 1, Real Property Records of Lamar County, Texas;
THENCE N 0° 01' E along the fenced West boundary line of said 9 acre
tract and the East boundary line of said 0.3182 acre tract a distance of 149.93
feet to a found 1/2" capped iron pin for an angle point, being on the Northeast
corner of said 0.3182 acre tract and being on the Southeast corner of a 3.0335
acre tract described in a deed to Wal-Mart Stores, dated March 21, 1994,
recorded in Vol. 431, Page 11, Real Property Records of Lamar County, Texas;
THENCE N 0° 02' 40" E along the fenced West boundary line of said 9
acre tract and the East boundary line of said 3.0335 acre tract a distance of 59.97
feet to a found 1/2" capped iron pin far a corner, being on the Southwest corner
of a 9.0036 acre tract described in a deed to Wal-Mart Stores, dated March 21,
1994, recorded in Vol. 431, Page 14, Real Property Records of Lamar County,
Texas;
THENCE East along the South boundary line of said 9.0036 acre tract a
distance of 209.86 feet to a found 1/2" capped iron pin for a corner, being on the
Southeast corner of said 9.0036 acre tract and being on the West boundary line
of a 6 acre tract described in a deed to David C. Miesch, et ux, Jo Peevey
Miesch, dated January 23, 1969, recorded in Vol. 486, page 417, Deed Records
of Lamar County Texas;
THENCE S 00 00' 53" E along the East boundary line of said 9 acre tract
and the West boundary line of said 6 acre tract a distance of 210.11 feet to a 1/2"
rebar set for a corner, being on the Southwest corner of said 6 acre tract and the
Southeast corner of said 9 acre tract and being on the North boundary line of said
Lamar Ave. and U.S. Hwy 82;
THENCE N 89° 56' 38" W along the North boundary line of said Lamar
Ave. and U.S. Hwy 82 a distance of 210 feet to the PLACE OF BEGINNING
and containing 1.012 acres of land, located in the 4000 Block of Lamar Avenue.
Section 2. That the Chief Building Official of the City of Paris, be, and he is hereby,
directed to change the Zoning Map of the City of Paris in accordance with the provisions of
Ordinance No. 1710 and the land use map accompanying the same, and in accordance with the
provisions of this ordinance.
Section 3. Any person violating any of the provisions of this ordinance shall be guilty
of a Misdemeanor, and, upon conviction, shall be fined in any sum not to exceed $2,000.00,
and each and every day's continuance of any violation of the above enumerated ordinance shall
constitute and be deemed a separate offense.
Section 4. All ordinances and parts of ordinances in conflict herewith are hereby
expressly repealed.
Section 5. This ordinance shall become effective January 1, 1996.
PASSED AND ADOPTED by the City Council of the City of Paris, in regular session
convened, in the Council Chambers, City Hall, Paris, Texas, on this the l lth day of December,
