94-019 ORD CONTAINING A HEARING ON PROPERTIES LOCATED IN COP BELONGING TO VARIOUS OWNERS ORDINANCE NO. 94-019 AN ORDINANCE CONTAINING A HEARING ON PROPERTIES LOCATED IN THE CITY OF PARIS, TEXAS, BELONGING TO VARIOUS OWNERS, AND AN ORDINANCE OF THE CITY COUNCIL FINDING THE MATERIALS REMAINING ON THE PREMISES TO CONSTITUTE A NUISANCE AND TO BE A FIRE HAZARD TO LIFE AND PROPERTY AND A HAZARD TO THE LIFE AND WELFARE OF THE INHABITANTS OF THE AREA, AND ORDERING SAID RUBBISH, LUMBER AND REFUSE FROM THE STRUCTURES TO BE TORN DOWN AND REMOVED FROM THE PREMISES IN ORDER TO ABATE SUCH NUISANCE. WHEREAS, a public hearing was called to order by the Mayor of the City of Paris, George Fisher, on the llth day of April, 1994, at 6:00 o'clock P.M., in the Municipal Court Room, Police and Courts Building, in the City of Paris, Texas; and, WHEREAS, the City Council finds that the Building Hazard Inspection Committee fixed a date for hearing on the resolution referred to the Committee by the City Council on the lOth day of February, 1994, and said Committee fixed said hearing at 10:00 o'clock A.M. on the llth day of March, 1994, and the hearing was had thereon. That proper notice was given to the owner or owners of the structures located at the following addresses: 1106 3rd St. S.W., N 75' Lot 4& 14' of N 75' Lot 3, Block 1, Locust Hill Addition 649-655 Sth St. N.E., Lot 37, City Block 60 956 & 964 E. Tudor, Lot 17, City Block 69 1150 6th St. N.E., Lot 7, Block l, Hull Addition 1840 Fitzhugh, Lot 9, Block A, East Park Addition 1451 12th St. N.E., Lot 10, Block O, East Park Addition 1 ll2 14th St. N.E., Lots 9& 11, Block 2, Harlan Heights Addition 2630 W. Houston, Lots 18-19, Block 2, Sperry 3rd Addition 536 W. Houston, Lot 3, City Block 44A 1421 W. Kaufman, Lots 11, 12, & 13, Block 1, Talkington-Hodge Addition That at said hearing the Committee listed the structures involved and introduced pictures of the various portions of the structures and various portions of the premises involved and a list of discrepancies in the structures located thereon. That the Committee found that each of the above structures was in such state of deterioration and dilapidation as to create a serious fire hazard to life and property and that each of said buildings was dilapidated and was dangerous to life and property and dangerous structures to life and property. That said buildings are in such a state of dilapidation and decay that none of said structures are capable of repair. It is further found that the condition of the premises and structures involved was such that the Committee recommended to the City Council that they be declared a nuisance and that the owners thereof be ordered by the City Council to tear down and remove the same from the lots involved. That said Committee filed a complete report of its hearing and its findings with the City Clerk of the City of Paris on the 21 st day of March, 1994; and, WHEREAS, the City Council further finds that proper notice was given to the owner or owners of the structures hereinafter listed. That at said hearing on the llth day of March, 1994, the Committee listed the structures involved and introduced pictures of the various portions the structures and various portions of the premises involved and a list of discrepancies in the structures located thereon. That the Committee found that each of the hereinafter listed structures was in such a state of deterioration and dilapidation as to create a serious fire hazard to life and property, and that each of said buildings was dilapidated and dangerous to life and property and dangerous structures to life and property. That the owners of the property appeared before the Committee and requested time to repair the structures or the Committee found that the structures could be repaired. That it was the recommendation of the Committee that the structures be condemned or repaired and that the respective owners thereof be given the time to abate said nuisance by repair or removal as is set out in connection with each of such addresses, as follows: 121-141 lst St. N.E., 30 days to obtain permits and submit plan for renovation Lot 3, City Block 11 and 90 days to make repairs. 624 Sth St. N.E., Lot 7, 60 days to transfer title to new owners and City Block 61 (funeral home) 6 months to make repairs. 516 E. Tudor, 30 days to repair or demolish and remove. Lot 5-A, City Block 61 510 E. Tudor, 30 days to repair or demolish and remove. Lot 5, City Block 61 1170 Van Zandt, 30 days to get contractor and obtain permits and Lot 18, City Block 175A 90 days to make repairs. 2591 W. Houston, 90 days to make repairs. Lot 5, Block 1, Sperry 3rd Addition and it is so stated in the report of the Building Hazard Inspection Committee filed with the City Clerk of the City of Paris on the 21st day of March, 1994; and, WHEREAS, the City Council has fully heard and considered the testimony presented upon the hearing and a complete transcript of the testimony reported by the Building Hazard Inspection Committee; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section l. That the structures located at the following addresses: 1106 3rd St. S.W., N 75' Lot 4& 14' of N 75' Lot 3, Block l, Locust Hill Addition 649-655 Sth St. N.E., Lot 37, City Block 60 956 & 964 E. Tudor, Lot 17, City Block 69 1150 6th St. N.E., Lot 7, Block 1, Hull Addition 1840 Fitzhugh, Lot 9, Block A, East Park Addition 1451 12th St. N.E., Lot 10, Block O, East Park Addition 1112 14th St. N.E., Lots 9& 11, Block 2, Harlan Heights Addition 2630 W. Houston, Lots 18-19, Block 2, Sperry 3rd Addition 536 W. Houston, Lot 3, City Block 44A are a nuisance, and they are hereby declared a nuisance, in that they are dangerous to life and property, and that the same constitute a fire hazard to life and property, and that the respective owners are hereby ordered to abate such nuisance within thirty (30) days from the date hereof. That the structure located at the following address: 1421 W. Kaufman, Lots 11, 12, & 13, Block 1, Talkington-Hodge Addition is a nuisance, and it is hereby declared a nuisance, in that it is dangerous to life and property, and that the same constitute a fire hazard to life and property, and that the respective owner is hereby ordered to abate such nuisance within forty-five (45) days from the date hereof. The City Clerk is directed to furnish the owners a copy of this ordinance, in the event the addresses of said owners are known, and in the event the respective owners refuse to comply with this ordinance, the City Attorney, T. K. Haynes, is hereby directed to proceed to enforce this ordinance by the procedure provided for in Article III of Chapter 7 of the Code of Ordinances of the City of Paris. Section 2. That the structures hereinafter enumerated are a nuisance, and they are hereby declared a nuisance, in that they are dangerous to life and property, and that the same constitute a fire hazard to life and property, and that the respective owners are hereby ordered to abate such nuisances on or before the dates set out in connection with the addresses of each of such structures, as follows: 121-141 lst St. N.E., May 12, 1994, to obtain permits and submit plan for Lot 3, City Block 11 renovation and July 11, 1994, to make repairs. 624 Sth St. N.E., Lot 7, June 11, 1994, to transfer title to new owners and City Block 61 (funeral home) October 11, 1994, to make repairs. 516 E. Tudor, Juiie 11, 1994, to repair or demolish and remove. Lot 5-A, City Block 61 510 E. Tudor, June 11, 1994, to repair or demolish and remove. Lot 5, City Block 61 1170 Van Zandt, May 12, 1994, to get contractor and obtain permits and Lot 18, City Block 175A July 11, 1994, to make repairs. 2591 W. Houston, July 11, 1994 to make repairs. Lot 5, Block 1, Sperry 3rd Addition The City Clerk is directed to furnish the owners a copy of this ordinance, in the event the addresses of said owners are known, and in the event the respective owners refuse to comply with this ordinance, the City Attorney, T.
