ORDINANCE NO. 94-025
AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING THAT
THE CODE OF ORDINANCES, CITY OF PARIS, BE AMENDED BY REVISING
SUBSECTIONS (b) AND (c) OF SECTION 34-22 OF SAID CODE TO ESTABLISH WATER
RATES FOR RESIDENTIAL, COMMERCIAL AND INDUSTRIAL CUSTOMERS WHICH
IS BASED UPON THE COST TO SERVE EACH CLASS; BY REVISING SUBSECTIONS
(a), (b) AND (c) OF SECTION 34-23 ESTABLISHING A SEWER SERVICE RATE FOR
CITY WATER CUSTOMERS AND ESTABLISHING THE COST TO USERS
DISCHARGING OVERSTRENGTH SEWAGE; PROVIDING FOR A PENALTY NOT TO
EXCEED $2,000.00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF JUNE 19
1994.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS:
Section l. That Subsections (b) and (c) of Section 34-22 of the Code of Ordinances of
the City of Paris, Paris, Texas, be amended so that such shall read as follows:
"Section 34-22. Water rates.
(b) Charges for water furnished by the City, measured in cubic feet, are
established as follows based upon customer class and meter size and incorporate a base
monthly cost which includes the cost far the first increment of water, and a cost per one
hundred (100) cubic feet used above the first increment:

and industrial customers shall be based upon customer class and meter size, incorporating
a base monthly cost for the first increment of usage and a cost for each additional one
hundred (100) cubic feet above the first increment, as follows:

(b) Monthly residential customer wastewater volume shall be based upon meter
water consumption by the customer up to the maximum amount represented by the three-
month average of November, January and February of previous fiscal year. If no historical
water consumption data are available, customers will be billed at seventy (70) percent of the
current month water consumption until such time as historical data of water use are
available.
Monthly commercial and industrial customers' wastewater volume shall be based
upon one-hundred (100) percent of the actual metered potable water consumption, except
those customers whose wastewater is metered, and their volume shall be based upon one-
hundred (100) percent of the metered wastewater. The former shall be billed for one-
hundred (100) percent of the metered potable water and the latter sha11 be billed for one-
hundred (100) percent of the metered wastewater.

(c) Users desiring to discharge sewage into the City's sewerage system, the
strength of which sewage exceeds two hundred fifty (250) parts per million Biochemical
Oxygen Demand (BOD), two hundred fifty (250) parts per million of Total Suspended
Solids (TSS), or thirty (30) parts per million of ammonia (NH3), and which is acceptable
under Article III of this chapter, may do so upon written permission of the City and by
paying a monthly treatment charge in the amount of thirty-seven cents ($.37) per pound of
Biochemical Oxygen Demand (BOD) in excess of the allowable Biochemical Oxygen
Demand (BOD); twenty cents ($.20) per pound of Total Suspended Solids (TSS) in excess
of the allowable Total Suspended Solids (TSS); and twenty-four cents ($.24) per pound of
ammonia (NH3) in excess of the allowable ammonia strength. The City shall make the
necessary tests of the user's sewage strength to determine this charge. The charge
prescribed by this subsection shall be in addition to the charges prescribed in subsection (a)
hereof. The above described excessive strength surcharge rates may be recalculated
immediately after the adoption of the annual budget, using the amount budgeted as cost and
actual operational characteristics for the most recently completed twelve (12) month period
for plant loading. Such rates shall become effective when adopted by the City Council or
on September 1, whichever occurs first. "
Section 3. The rates established in Sections 1 and 2 above will be effective with billings
begimvng July l, 1994.

All service in excess of base will be charged at $2.54 for each additional 100 cubic feet.
(b) Monthly residential customer wastewater volume sha11 be based upon eighty
(80) percent of the actual metered potable water consumptiotl.
Monthly commercial and industrial customers' wastewater volume shall be based
upon one-hundred (100) percent of the actual metered potable water consumption, except
those customers whose wastewater is metered, and their volume shall be based upon one-
hundred (100) percent of the metered wastewater. The former shall be billed for one-
hundred (100) percent of the metered potable water and the latter shall be billed for one-
hundred (100) percent of the metered wastewater.
Section 6. The rates established in Sections 4 and 5 above will be effective with billings
beginning December 1, 1994.
Section 7. Any person violating any of the provisions of this ordinance sha11 be guilty
of a Misdemeanor, and upon conviction shall be fined in any sum not to exceed $2,000.00, and
each and every day's continuance of any violation of the above enumerated section shall constitute
and be deemed a separate offense.

Section 8. All ordinances or parts of ordinances in conflict herewith are hereby expressly
repealed.
Section 9. This ordinance sha11 become effective on June 1, 1994.
