97-006 ORD PROVIDING THE CODE OF ORDINANCES BE AMENDED BY REVISING CHAPTER 26 ARTICLE II OF SAID CODE ORDINANCE NO. 97-006 AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF PARIS, BE AMENDED BY REVISING CHAPTER 26, ARTICLE II, OF SAID CODE; PROVIDING FOR THE APPOINTMENT OF THE COMMANDING OFFICER OF THE POLICE RESERVE UNIT BY THE CHIEF OF POLICE; PROVIDING FOR COMPLIANCE BY POLICE RESERVE OFFICERS WITH THE TEXAS COMMISSION ON LAW ENFORCEMENT OFFICER STANDARDS AND EDUCATION; PROVIDING STANDARDS FOR ACCEPTANCE INTO THE POLICE RESERVE UNIT; PROVIDING ALLOWANCES FOR OFFICERS WHO ARE MEMBERS OF OTHER RESERVE EMERGENCY ORGANIZATIONS PRIOR TO ACCEPTANCE INTO THE POLICE RESERVE UNIT; PROVIDING FOR MONTHLY MEETINGS AT THE POLICE STATION; REQUIRING ATTENDANCE AT MONTHLY MEETINGS AND DEVOTION TO DUTY BY POLICE RESERVE OFFICERS; PROVIDING REQUIREMENTS FOR WEARING THE UNIFORM; PROVIDING THAT POLICE RESERVE OFFICERS FURNISH A.38 CALIBER OR LARGER REVOLVER; PROVIDING STANDARDS FOR CARRYING A WEAPON; PROVIDING METHODS FOR TERMINATION OF MEMBERSHIP; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF FEBRUARY 1, 1997. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section 1. That Chapter 26, Article II, of the Code of Ordinances of the City of Paris, Paris, Texas, be, and the same is hereby, amended so that such shall read as follows: "ARTICLE II. RESERVE UNIT "Sec.26-21. Created. "There is hereby created a police reserve unit under the conditions, rules, and regulations set out in this article. "Sec.26-22. Purpose. "The purpose of the police reserve unit shall be to assist and augment the regular police department of the City. "Sec. 26-23. Composition generally. "The police reserve unit shall be composed of such number of inembers as is determined by the chief of police, subject to the right of the city council to expand or decrease the membership or completely disband the unit. "Sec. 26-24. Chief of police to direct and sponsor. "The chief of police shall be the director and sponsor of the police reserve unit. He shall aid in developing and establishing policies, directives, standard operating procedures, and programs of the unit. "Sec. 26-25. Officers generally. "The police reserve unit shall have a commanding officer appointed by the chief of police and such other officers as the chief of police shall designate. 1 "Sec. 26-26. General duties of commanding officer. "The commanding officer of the police reserve unit shall be directly responsible to the chief of the police department and shall carry out such policies, orders, and directives as are issued by or through the chief of police or his designated assistant. The commanding officer shall develop, with the advice of the chief of police, organizational policies and standard operating procedures. The chief of police shall be responsible for seeing that all police reserve officers maintain compliance with the provisions of the Texas Commission on Law Enforcement Officer Standards and Education, pursuant to Revised Civil Statutes, art. 4413(29aa), as amended. The commanding officer shall be responsible for seeing that the overall program of the unit is properly adhered to and for developing and maintaining continued assignments or instructions as directed or delegated by the chief of police. "Sec. 26-27. Acceptance of inembers. "Any person who is of good character, who is 21 years of age or older, and who is interested in the objectives and purposes of the reserve organization may apply for membership in the police reserve unit. The applicant must be able to be licensed by the Texas Commission on Law Enforcement Officer Standards and Education as a peace officer for the State of Texas. The applicant must be able to successfully complete physical, psychological, and medical evaluations to standards. He is also subject to a background investigation, a polygraph test, a meeting with an oral interview board, and final evaluation by the chief of police. "Sec. 26-28. Procedure following acceptance of new members. "Each new member of the police reserve unit shall take the prescribed oath of office and be issued a badge and commission. He shall then report to the identification office of the police department for fingerprinting and photographing. The commanding officer shall issue his equipment and obtain a receipt. "Sec. 26-29. Member not to belong to other reserve emergency organization. "No member of the police reserve unit shall belong to any other organization that responds to emergencies. Any current reserve officer that belongs to another emergency organization shall be allowed to continue membership until such time the officer separates from the police reserve unit. "Sec. 26-30. Meetings generally. "Regular meetings of the police reserve unit shall be held at the police station on the third Monday of each month at 7:30 p.m. Such meetings shall be presided over by the commanding officer of the reserve unit or his designated assistant, under the supervision of the chief of police. To such an extent as possible, parliamentary rules shall be observed and proper order maintained. During these monthly meetings, instruction will be had on police efficiency. "Sec. 26-31. Duty of inembers to attend meetings and devote time to police activities. "Each member of the police reserve unit shall attend monthly meetings and devote a minimum of eight (8) hours per month to regular police activity. A member may be absent from a monthly meeting with the commanding officer's permission. Members may not miss more than three (3) meetings in a calender year with un- excused absences. Notice of absence should be given as far in advance as possible where a work schedule or assignment is concerned. 2 "Sec. 26-32. Duty of inembers to wear uniform. "Each member of the police reserve unit shall wear the uniform while performing duties pertaining to police department activities. Members shall also wear the uniform to monthly meetings as determined by the commanding officer of the police reserve unit. "Sec. 26-33. Member's holster and weapon. "(a) Each member of the police reserve unit shall furnish his own belts and holster, both of which shall be black in color. He shall also furnish his own pistol or revolver which shall be .38 caliber or larger. All weapons shall be kept in excellent service condition at all times. "(b) Any police reserve officer who has attained full certification as a basic peace officer for the State of Texas and is licensed as such shall be considered as being on- duty at all times. An officer meeting these requirements is authorized to carry, at his discretion, a weapon for which he has been certified. The weapon shall be kept out of view of the general public. If a weapon is carried, the officer must have his badge on his person. The weapon is not to be carried on his person where he works or while he is a representative of any other employment. "(c) Any police reserve officer who has not attained full certification as a basic peace officer for the State of Texas shall be considered as being on-duty only when he is in uniform and assigned to ride patrol or work special events. This officer shall not carry a weapon on his person when he is off duty. "Sec. 26-34. Members subject to supervision by police officers. "At all times when a member of the police reserve unit is accompanied by a member of the regular police department, the member of the regular police department will be the person in charge of the operation being accomplished. "Sec. 26-35. Termination of inembership; suspension or demotion of inember. "(a) Any member of the police reserve unit may, of his own volition, terminate his membership. In addition, any member may be removed, suspended, or demoted for: "(1) A flagrant and serious violation of reserve unit or police department rules and regulations, or "(2) Repeated minor violations of reserve unit or police department rules and regulations. "The supervisory staff of the police reserve unit shall make recommendations to the chief of police on disciplinary actions regarding members of the unit. The chief of police will make the final determination. The members of the police reserve unit serve at the discretion and under the administration and discipline of the chief of police. "(b) When a member of the police reserve unit is terminated for any reason, all uniforms, badges, identification, and other equipment shall be returned to the supply sergeant in reasonable condition. A release will then be signed to clear a terminating member of any obligation in this regard. 3 "Sec. 26-36. Article not to affect police department or operation of civil service. "Nothing within this article shall be construed to, in any way or manner, affect the operation of the police department or the rights and privileges of the members thereof under the municipal civil service as provided in Chapter 143, Local Government Code." Section 2. All ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. Section 3. This ordinance shall become effective on February 1, 1997.
