97-033 ORD PROVIDING CHAPTER 23 OF CODE OF ORDINANCES BE AMENDED BY ADDING ARTICLE III THERETO ORDINANCE NO. 97'033 AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING THAT THE CHAPTER 23 OF THE CODE OF ORDINANCES, CITY OF PARIS, PARIS, TEXA5, BE AMENDED BY ADDING AN ARTICLE III THERETO; ESTABLISHING THE HOURS OF OPERATION FOR THE CITY OF PARIS AQUATIC FACILITY; PROVIDING RULES FOR USE OF THE FACILITY; PROVIDING FEES; PROVIDING FOR A PENALTY NOT TO EXCEED $2,000.00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF JULY 1, 1997. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section 1. That Chapter 23 of the Code of Ordinances of the City of Paris, Paris, Texas, be, and the same is hereby, amended by adding an Article III thereto to read as follows: "ARTICLE III. CITY OF PARIS AQUATIC FACILITY "Sec. 23-75. Rules for facility use. "The Department of Parks & Recreation shall promulgate any and all necessary rules and regulations for the use by the public of the City of Paris Aquatic Facility. "Sec. 23-76. Hours for facility use. "The City of Paris Aquatic Facility shall be open to the public on the following days and at the following times: Sunday 1:00 p.m. - 4:00 p.m. Public Swim Monday-Thursday 9:00 a.m. - 12:00 p.m. Programs 6:00 p.m. - 8:00 p.m. Programs Tuesday - Thursday 1:00 p.m. - 6:00 p.m. Public Swim Friday 9:00 a.m. - 8:00 p.m. Public Swim Saturday 9:00 a.m.-8:00 p.m. Public Swim "Sec. 23-77. Fees and requirements for rental. "(a) The Department of Parks & Recreation shall charge the following fees to the public under the following requirements for use of the City of Paris Aquatic Facility: "(1) Daily pass - $1.00 per person; "(2) Daily pass group rate (20 or more people) - SOC per person; "(3) Season pass -$25.00 per person, $1.00 per person for the fifth (Sth) or more immediate family member; "(4) Season pass replacement -$5.00 per person; "(5) Pool rental (2 hours) -$200.00 for up to 75 people and $1.00 per person for each person over the 75th. Pool rentals are subject to the following requirements: "(A) All reservations must be made at least one (1) week in advance of the event by contacting the Department of Parks and Recreation. "(B) The pool is available for reservation between the hours of 8:00 p.m. to 10:00 p.m. on Thursdays, Fridays, and Saturdays. "(C) Time needed for setup and cleanup shall be included as part of the reservation time and will be charged accordingly. "(D) Decorating items shall be the responsibility of the renter, and only tape may be used to affix decorations to walls, posts, etc. "(E) The standard reservation includes three (3) staff inembers for the rental. Unless the permit states otherwise, the maximum number of people in the facility is 75. In cases were the permit shows that more than 75 people will be attending, additional staff shall be scheduled. "(F) Rentals shall be responsible for any and all damages to the facility occurring during and as a result of renter's use of the facility. "(6) Day care group rate (20 or more people) - SOC per child. Arrangements must be made for day care by contacting the Department of Parks & Recreation. "(7) Program fee -$25.00 per 8 lessons "(8) The Department of Parks and Recreations shall set all other fees as may be necessary . "(b) The above-stated program fee is created for the purpose of recovering the City's expenses for instructors and pool times for such programs as water aerobics, swimming lessons, water walking, etc. "(c) The Department of Parks & Recreation may establish a scholarship program to assist economically disadvantaged families and individuals in improving their quality of life through recreational opportunities. Such scholarships will be available for all programs and amenities at the City of Paris Aquatic Facility." Section 2. Any person violating any of the provisions of this ordinance shall be guilty of a Misdemeanor, and upon conviction shall be fined in any sum not to exceed and each and every day's continuance of any violation of the above enumerated section shall constitute and be deemed a separate offense. Section 3. All ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. Section 4. This ordinance shall become effective on July 1, 1997.
