97-059 ORD PROVIDING EXTENSION OF CERTAIN BOUNDARY LIMITS OF COP AND ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 5,389.031 ACRES ORDINANCE NO. 97-059 AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF PARIS, PARIS, TEXA5, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 5,389.031 ACRES, MORE OR LESS, WHICH IS LESS THAN THIRTY PERCENT (30%) OF THE TERRITORY INCLUDED WITHIN ITS PRESENT CITY LIMITS, WffiCH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF PARIS, PARIS, TEXAS; APPROVING THE SERVICE PLAN; AND PROVIDING ZONING FOR SAID TERRITORY. WHEREAS, public hearings before the City Council of the City of Paris, Paris, Texas, where all interested persons were provided with an opportunity to be heard on the proposed annexation of the following described property: Tract 1 BEGINNING at the existing Paris city limits line at US Hwy 82 West and Loop 286 N.W., said point being 600 feet west of the centerline of the outside lane of Loop 286 N.W.; THENCE westerly along the centerline of US Hwy 82 West a distance of 4,317.5 feet to a point; THENCE southerly along the existing Paris city limits line a distance of 500 feet to a point; THENCE westerly, parallel to and 500 feet south of the centerline of US Hwy 82 West, a distance of 3,667 feet to the east right-of-way line of County Road 22900; THENCE northerly along the east right-of-way line of County Road 22900 to its intersection with the centerline of US Hwy 82 West a distance of 500 feet, and continuing with the east right-of-way line of County Road 32100 a distance of 500 feet, in all 1,000 feet to a point in the east right-of-way line of County Road 32100, said point being 500 feet north of the centerline of US Hwy 82 West; THENCE easterly, parallel to and 500 feet north of the centerline of US Hwy 82 West, a distance of 7,987 feet to the existing Paris ciry limits line; THENCE southerly along the existing Paris city limits line a distance of 571 feet to the place of beginning, containing 136.981 acres. The above-described territory and area so annexed shall be part of the City of Paris, Paris, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied by the City of Paris, Paris, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions, and regulations of the City of Paris, Paris, Texas. Section 3. The service plan providing for the extension of municipal services into the above-described territory, attached hereto as Exhibit A, is hereby approved. Section 4. The above-described territory is hereby zoned Temporary Agricultural (A) upon annexation as provided for in Zoning Ordinance No. 1710 of the City of Paris, Paris, Texas. Section 5. It is hereby declared to be the intention of the City Council of the City of Paris that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional or invalid by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality or invalidity shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any unconstitutional or invalid phrases, clauses, sentences, paragraphs, or sections. 22 Section 6. IC is further hereby declared to be the intention of the City Council of the City of Paris to exclude any area or areas described in the description of the property to be annexed, which are not within said City's jurisdiction te annex and that such area or areas should be carved out of the description by the valid judgment or decree of any court of competent jurisdiction, in order that such area or areas would not cause this annexation ordinance to be found to be invalid, voidable, or void. Section 7. It is further hereby declared to be the intention of the City Council of the City of Paris to exclude any area or areas described in the description of the property to be annexed, which encroach upon the City of Reno's city limits as existing at the time of the "Agreement Apportioning Extraterritorial Jurisdiction Overlap," dated October 8, 1984, or upon that portion of Reno's extraterritorial jurisdiction apportioned to Reno by said Agreement, and that such area or areas should be carved out of the description by the valid judgment or decree of any court of competent jurisdiction in order that such area or areas would not cause this annexation ordinance to be found to be invalid, voidable, or void. Haynes, ity Attorney 23 SERVICE PLAN FOR AREA PROPOSED TO BE ANNEXED Immediately upon annexation, the City of Paris will provide the following services on the same basis and terms as they are currently offered to the current residents and property owners within the corporate limits of the Ciry of Paris: a, police protection; b. fire protection; c. solid waste collection; d. maintenance of roads and streets, with the exception of US Hwy 82, US Hwy 271, US Hwy 19/24, FM 195, FM 1508, FM 1510, FM 2121, FM 79, FM 2820, and Spur 139 which are maintained by the Texas Department of Transportation; and e, maintenance of road and street lighting in accordance with established criteria. 2. Immediately upon annexation, the City of Paris will begin maintenance of water and wastewater facilities in the annexed area that are not within the service area of another water or wastewater utility. Water service in most areas of proposed annexation is currently available from the Lamar County Water Supply District, which may serve residents upon approval by the City Council of the City of Paris. City water and sewer service lines will be provided to the area upon request and will be subject to the same pro rata program which is available to the current residents of the Ciry of Paris, which program provides for partial reimbursement to the sponsor of the costs associated with any such water and sewer service line extensions. Utiliry extensions will be guided by the Master Plan, an update of which has been funded in the 1997-98 budget of the City of Paris. 3. The City of Paris will begin immediate maintenance of all water and sewer service lines serving the annexed areas once the same have been acquired or installed and accepted. 4. There are no parks, playgrounds, or swimming pools located within the areas proposed to be annexed and none are proposed at this time. 5. There are no other publicly owned facilities, buildings, or services within the areas proposed to be annexed and none are proposed at this time. Exhibit A
