:MINUTES OF THE SPECIAL MEETING OF THE PLANNING AND
ZONING COMMISSION
SEPTEMBER 12, 2005
The Planning and Zoning Commission met ~onday, September 12,2005,
4:00 P.M., Love Civic Center, 2025 S. Collegiate Street, Paris, Texas with
the following members present:
1. Reeves Hayter

5. Bobby L. Myers
6. Barbara Forrest
7. Brad Archer
Lisa Wright, Director of Community Development, was also present.
1.
Call meeting to order and roll call.
2.
Approval of minutes from previous meetings. (August 1, 2005,
Regular Meeting; August 22, 2005, Special Meeting) Motion was
made to approve the minutes by Bobby Myers, seconded by Benny
Plata. Motion carried by a vote of 6 ayes and 0 nays.
3. Public Hearing to consider the petition of Joe L. Fulton for a change
in zoning from a Light Industrial District (LI) to a Heavy Industrial
District (HI) on Lot 11, City Block 355, being n urn ber 2615 Loop 286
. NW.
The public hearing was declared open.
Joe Fulton, representative of Fulton Recycling and Shredding, Inc.,
spoke in favor of the petition stating that his company would like the
property upgraded to Heavy Industrial zoning to put i:t:l a metal
shredding machine capable of processin g 150 tons of metal per h 0 or.
The operation will bring in customers from other cities. Mr. Fulton
distributed hand-outs showing the layout of where the machine will
be placed. The plan is to put in an embankment around the property

on the west side to act as a shield and also adding rail shipment with
about 30 cars coming in and out in a week.
Gary Vest, Director of Econ 0 mic Dev elopmen t, s po ke in favor of th e
a pp lica tion an d said this business would provide work fo r in divid uals
in terms of giving them a place to haul scrap to. He said there should
. be no junk vehicles left in town.
Barbara Forrest arrived at 4:10 p.m.
There was no oPposition, the public hearing was declared closed.

Public Hearing to consider the site plan approval requested by
Crawford Dental Clinic on Lot 14A-4, City Block 259, being number
2920 Pine Mill Road. .
Motion was made to recuse Reeves Hayter from consideration of the
next item by Carl Lucas, seconded by Benny Plata. Motion carried
6 ayes and 0 nays.
The public hearing was' declared open.
Bill Mercy, 3225 Mahaffey, representing Dr. Crawford, spoke in
favor of the site plan approval.

There was no opposition, the public hearing was declared closed.
6.
Consideration of and action on the site plan approval requested by
Crawfo rd Den tal Clinic on Lot 14A -4, City Block 259, being n urn ber
2920 Pine Mill Road.
Motion was made to approve the site plan subject to the City
Engineer's Memo dated August 30, 2005, by Brad Archer, seconded
by Bobby Myers. Motion carried 6 ayes and 0 nays.
Motion for Reeves Hayter to return to the meeting was made by Carl
Lucas, seconded by Russell McCain. Motion carried 6 ayes and 0
- nays.
7.
Consideration of and action on the Final Plat of Lot 1, Block A, of the
Kennedy Subdivision, being number 305 1st Street NW.
Motion was made to approve the plat by Carl Lucas, seconded by
Russell McCain, snbject to the City Engineer's Memo dated
September 1,2005. Motion carried 7 ayes and 0 náys. .'
8.
Consideration of and action on the Final Plat of Lot 2, City Block
2SS-A, of Tejas Plaza, being number 201 N. Collegiate.
Motion was made to approve the plat by Brad Archer, seconded by
Benny Plata subject to the City Engineer's Memo dated September
. 1 , 2005. Motion carried 7 ayes and 0 nays.
Consideration of and action on the Replat of Lots 1,2, and 3, Block
A ofthe Brandywine Business Park, being located in the 3400 Block
of Pine Mill Road.

Benny Plata, subject to the City Engineer's Memo dated August 29,
2005. Motion carried 7 ayes and 0 nays. .

Consideration of and action on the Final Plat of 79 Business Park
(part of City Block 323), being located at 2510-2596 FM 79.
Motion was made to approve the plat by Carl Lucas, seconded by
Brad Archer subject to the City Engineer's Memo dated September
1, 2005 and with the specification that maintenance will not be the
responsibility ofthe City of Paris. Motion carried 7 ayes and 0 nays.
11.
Consideration of and action on the Master Plat of the Meadow Park
Addition, being located in the 4100-4400 Block of Bonham Street.
Moti~n was made to approve the plat by Brad Archer, seconded by
Bobby Myers, subject to the City Engineer's Memo dated September
2, 2005. Motion carried 7 ayes åIÏd 0 nays.

Consideration of and action on the Preliminary Plat of the Meadow
Park Addition, Phase 4, being located in the 4100-4400 Block of
Bonham Street.
Motion was made to approve the plat by Carl Lucas, seconded by
Benny Plata, subject to the City Engineer's Memo dated September
2, 2005. Motion carried 7 ayes and 0 nays.

Bobby Myers, subject to the City Engineer's Memo dated August 30,
2005. Motion carried 7 ayes and 0 nays.
14. Consideration of and action on the Preliminary Plat of Signature
. Senior Living, Part of Lot 14, City Block 259, being n urn ber 750 N.
Collegiate.
Motion was made to approve the plat by -Russell McCain, seconded
by Benny Plata, subject to the City Engineer's Memo dated August
30, 2005. Motion carried 7 ayes and 0 nays.
Consideration of and action on recommending revisions to the Code
of Ordinances to redefine "Home Occupations" and to provide for a
permit for such activities.
The Director of Community Development handed out a draft
ordinance that redefined home occupations and established several
criteria for Qperating the same. She explained that this would
simplify the procedure for home owners who operate small, non-
obtrusive businesses from their homes and would also eliminate the
concerns over what kind of business could go in under a zoning
change. Motion was made to approve the revisions to the Code of
Ordinance to redeîme "Home Occupations" by Bobby Myers,
secon d ed by Russell McCain. Motion carried 6 ayes and 1 nay (Carl
Lucas opposed the allowance of a small sign).

Winkleman & Associates, by Michael Clark, is requesting that the property located
on part of Lot 1, Block A of the Paris CVS Addition, being number 561 Clarksville
Street, be designated as Historic Overlay District No. 13 (HD-13) (Downtown
Historic District No. 2). The property is currently zoned Central Area (CA), and this
overlay zoning will not affect the existing use. This request is not inconsistent with
the Comprehensive Plan.

I have reviewed the preliminary plat of the above referenced addition. It appears that the
prelimmary plat complies with the City of Paris subdivision regulations with the following
exceptions:
1. Provide a phone number for the owner.
2. Sho"v the lot as Block A, Lot 1.
3. Show the current zoning. . _.-- . .. .
4. Add the following note to the plat "Preliminary Plat for Inspection Purpose Only".
5. Add a five-foot utility easement along the frontage of West Oak Ave.
6. Include lot 9 into the preliminary plat.
I recommend approval of the preliminary plat upon completion of the above items.

I recommend approval of the replat upon completion of the above items. A building permit will
not be issued until the replat is filed at the courthouse.
