03 City Council Min 9-26-05 REGULAR MEETING OF THE CITY COUNCIL, CITY OF PARIS September 26, 2005 1.The City Council of the City of Paris met in regular session at 6:00 P. M. Monday, September 26, 2005, at the Love Civic Center, 2025 South Collegiate Drive, Paris, Texas. Present:Mayor Pro Tem:Richard Manning Council Members:Tim Ray; Karen Wilkerson; and Rick Poston City Staff:Tony N. Williams, City Manager; Larry W. Schenk, City Attorney; and Janice Ellis, City Clerk Absent:Mayor:Curtis Fendley Council Members: Mary Ann Fisher and Don Wilson The meeting was called to order by Richard Manning, Mayor Pro Tem. 2.Public Hearing on proposed amendments to the City Manager’s Budget for fiscal year 2005-2006 for the City of Paris. Mayor Pro Tem Manning opened the public hearing and asked for anyone speaking in favor of this item to do so. No one spoke in support of this item. Mayor Pro Tem Manning asked for anyone speaking against this item to do so. With no one speaking, Mayor Pro Tem Manning closed the public hearing. 3.ORDINANCE NO. 2005-051: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, ADOPTING A BUDGET FOR THE ENSUING FISCAL PERIOD BEGINNING OCTOBER 1, 2005, AND ENDING SEPTEMBER 1, 2006, AS AMENDED, IN ACCORDANCE WITH THE CHARTER OF THE CITY OF PARIS; APPROPRIATING THE VARIOUS AMOUNTS THEREOF; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. Motion to approve was made by Council Member Wilkerson and seconded by Council Member Ray. Motion carried - 4 ayes, 0 nays. 4.Consideration of and action on an ordinance setting the tax rate for the year 2005 for the City of Paris. A.Approval of a rate of 0.5665 per $100.00 for maintenance and operational expenditures. Motion to approve was made by Council Member Poston and seconded by Council Member Ray. Motion carried - 4 ayes, 0 nays. B.Approval of a rate of 0.12575 per $100.00 for debt service. Motion to approve was made by Council Member Poston and seconded by Council Member Wilkerson. Motion carried - 4 ayes, 0 nays. C.ORDINANCE NO. 2005-052: AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, FIXING THE TAX RATE AND THE TAX LEVY AND LEVYING AD VALOREM TAXES FOR THE CITY OF PARIS FOR THE YEAR 2005 UPON TAXABLE PROPERTY WITHIN THE CITY OF PARIS IN CONFORMITY WITH THE CHARTER PROVISIONS AND ORDINANCES OF THE CITY; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. Motion to approve was made by Council Member Wilkerson and seconded by Council Member Ray. Motion carried - 4 ayes, 0 nays. CONSENT AGENDA A motion to approve was made by Council Member Ray and a second by Council Member Wilkerson, the Council voted four (4) for and none (0) opposed to approve and adopt the Consent Agenda, Items 5, 6A, 6B, 6C, 6D, 7A, 7B, 7C, 7D, 7E, and 7F as follows: 5.Approval of minutes from previous City Council meetings. (8-17-05) 7.Consideration of and action on the following resolutions: A.RESOLUTION NO. 2005-119: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, APPROVING AND AUTHORIZING A PROFESSIONAL SERVICES AGREEMENT WITH THE AMERICAN RED CROSS, LAMAR COUNTY CHAPTER TO PERFORM CERTAIN SPECIALIZED SERVICES ON BEHALF OF THE CITY OF PARIS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. B.RESOLUTION NO. 2005-120: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, APPROVING AND AUTHORIZING A PROFESSIONAL SERVICES AGREEMENT WITH THE CHILDREN’S ADVOCACY CENTER TO PERFORM CERTAIN SPECIALIZED SERVICES ON BEHALF OF THE CITY OF PARIS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. C.RESOLUTION NO. 2005-121: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, APPROVING AND AUTHORIZING A PROFESSIONAL SERVICES AGREEMENT WITH FAMILY HAVEN CRISIS CENTER TO PERFORM CERTAIN SPECIALIZED SERVICES ON BEHALF OF THE CITY OF PARIS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. D.RESOLUTION NO. 2005-122: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, APPROVING AND AUTHORIZING A PROFESSIONAL SERVICES AGREEMENT WITH NORTHEAST TEXAS COUNCIL ON ALCOHOL AND DRUG ABUSE (NETCADA) TO PERFORM CERTAIN SPECIALIZED SERVICES ON BEHALF OF THE CITY OF PARIS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. E.RESOLUTION NO. 2005-123: A RESOLUTION OF THE COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, APPROVING AND AUTHORIZING A PROFESSIONAL SERVICES AGREEMENT WITH MODELS OF THE MAKER TO PERFORM CERTAIN SPECIALIZED SERVICES ON BEHALF OF THE CITY OF PARIS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. F.RESOLUTION NO. 2005-124: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, APPROVING AND AUTHORIZING A PROFESSIONAL SERVICES AGREEMENT WITH CASA FOR KIDS TO PERFORM CERTAIN SPECIALIZED SERVICES ON BEHALF OF THE CITY OF PARIS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. 8.Consideration of and action on the following ordinances: A.ORDINANCE NO. 2005-053: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING THAT ORDINANCE NO. 1710, THE ZONING ORDINANCE OF THE CITY OF PARIS, TEXAS, BE AMENDED BY REVISING SECTION 8-201(16) OF SAID ORDINANCE TO AMEND THE DEFINITION OF “HOME OCCUPATION”; ADOPTING A NEW SECTION 8-500 TO THE ZONING ORDINANCE ESTABLISHING PERMISSIBLE AND IMPERMISSIBLE HOME OCCUPATIONS AND PROVIDING FOR A PERMIT TO OPERATE A HOME OCCUPATION; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING A PENALTY; AND PROVIDING AN EFFECTIVE DATE. Council Member Ray expressed concern about the noise factor in residential neighborhoods from occupations, such as musicians. He thought there should be some time restrictions. Lisa Wright informed Council there was a time restriction included in the Ordinance. Council Member Wilkerson inquired as to signs and permits for home occupations. Lisa Wright told Council that the person is allowed to have a one square foot sign and the person will be required to obtain a permit from her department. Motion to approve was made by Council Member Poston and seconded by Council Member Ray. Motion carried - 4 ayes, 0 nays. 9.Consideration of and action on the following resolutions: A.RESOLUTION NO. 2005-125: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, APPROVING AND AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION (TxDOT) FOR THE TEMPORARY CLOSURE OF STATE RIGHT-OF-WAY IN SUPPORT OF THE 2005 FESTIVAL OF PUMPKINS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. Motion to approve was made by Council Member Wilkerson and seconded by Council Member Ray. Motion carried - 4 ayes, 0 nays. 10.Possible future agenda items. Council Member Poston wants an agenda item giving an overview to the Council on safety training for employees. 11.Citizens Forum. Billy Bell - Cleveland Street, does not feel like the city manager and part of the council were honest with the people about the trash election. He doesn’t think the street overlays will last on the streets for seven years, nor does he think the sign ordinance is necessary with regard to blinking lights. 12.Referrals. th Thou Chan - Lot 1, City Block 255-A, 204 25 Street N.E. - requests a change in zoning from One-Family Dwelling to a Two-Family Dwelling District. 16.Adjournment.
