91-028 ORD PROVIDING CODE OF ORDINANCES BE AMENDED BY REVISING SECTION 28-17 ORDINANCE N0. 91-028 AN OKDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF PARIS, BE AMENDED BY REVISING SECTION 28-17 OF SAID CODE; PROVIDING FOR SIUN CONTRACTORS'S BOND AND LIABILITY INSURANCE; PROVIDING FOR A PENALTY NOT TO EXCEED $500.00; REPEALING ALL ORDINANCES OlZ PARTS GF ORDINANCES IN CONFLtCT HEREWITH; ANli PROVIDING FOK AN EFFECTIVE DATE OF JULY 1, 1991. BE IT ORDAINED BY THE CITY CUUNCIL OF THE CITY OF PARIS: Section 1. That 5ection 28-17 of the Code of Ordinances of the City of Paris, Paris, Texas, be amended so that such shall read as follows: "Section 28-17. Sign contractor's bond and liability insurance No license for the installation, erection and maintenance of signs shall be issued to any person or shall any person install, erect, or maintain any sign or medium of display or advertising, electric or atherwise, until such person has filed with the city clerk, a surety bond in the sum of one thousand dullars ($1,000.00). Such bond shall be approved by the building ofticial and city attorney acid shall be conditioned for the installation and erection of signs in accordance with the provisioris of this Code, ordinarices of the City and the laws of the State, and shall provide for the indemni- fication of the City for any and all damages or liability which may accrue against it by reason of faulty installation, erection, deniolition, repair, removal or defects in, or collapse of, any sign for a periad of one (1) year after erection and for such period of time that such sign is maintained or serviceci by or under the direction of the maker of such bond. Such bond shall further provide for the indemnification of ariy person, who shall, while uporâ–º public property or in any public place, incur damage for which the principal named in the bond is legally liable. When any sign contractor's license has been caiicelled as provided by section 2$-16, such liceiz5e shall not be reriewed until the contractor furnishes an additi j~00 001), guaran~ amount of one thousand dvliars teeing COIIIPLIaI1C° with the provisions of this chapter, which bond shall be rcr a period of two (2) years following renewal ot the license. In addition to the above bond, edch contractor agrees to indemnify, save, keep and hold harmless the City of Paris, hereinafter referred to as "CITY", from and against any and all demands, debts, liabil- ities, suits, claims and causes of action of every kind and character whatsuever for damage or injuries to persons and/or property occurring on the leased premises resulting from LICENSEE, his invitees, agents, servants or employees' use, and CITY shall not be liable to LICENSEE, his invitees, agents, servants, employees or visitors due to the improvements located thereon, or hereafter con- structed, or any other condition of the premises being improperly coxistructed, maintained or being or becoming out of repair, LICENSEE hereby waiving any defects therein and agrees to hold and save CITY harmless from all claims for any such damages or injuries, and LICENSEE must at all times during the term of this ag,reement, and any exterisions thereof, keep and iaintain in full force and eftect a policy or policies of insurance, providing at least $250,000.00 per person and $500,000.00 tor any single occurrence for bodily in~ury or death and $100,000.00 tor any single occurrence far injury to or destruction of property, indemnifying all persons for any and all damages, personal irjuries or property damages sustained in or upon the premises of said .leased property, or any part thereof, as the result of the negligence of LICENSEE, his irivitees, agents, servants or employees, and shall pay a11 premiums due thereon when due. It is expressly provided that such insurance policy or policies shall and must be written and issued by e reputable insurance company or companies, with CI'IY as an additional insured, subject to approval by the City Attorney of the City of Paris, and LICENSLE or his insurance carrier or carriers shall deliver a copy of any such policies to the City Clerk of the City of Paris, 150 lst S.E. Street, Paris, Texas 75460, or furnish to said City Clerk a current letter or certiiicate from such company or companies, evidencing the fact that such insurance is in full force and efiect at all times durir,g this Iease and any extension thereof and specifically noting therean that CITY is an additional insured. All such policies shall be written so that the CITY will be notified of caricellation or of any restric- tive amendment of the policies at least thirty (30) days prior to the eftective date of such cancel- lation or amendment. Notice shall be by certified rnail, return receipt requested, addressed to the CITY at the following address: City Clerk, City of Paris, P. U. Box 9037, Paris, Texas 75461- 9037. Section 2. Any person violating any of the pro- visions of this ordinance shall be guilty ot a Misdemeanor, and upon conviction shall be fined in any sum not to exceed $500.00, and each and every ddy's cuntinuance of any violation of the above enumerated section shall constitute and be deemed a separate ofiense. Section 3. All ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. Sectiorl 4. This ordinance shall become effective on July l, 1991.
