AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS,
PROVIDING THAT THE CODE OF OKDINANCES, CI'I`Y OF PARIS, BE
AMENllED BY REVISING CHAPTER 2, ARTICLE IX BY AMENDING SECTION
TO THE PERSONNEL REGULATIONS OF SAID CODE; PkOVIDING
FOR A DIZUG F1ZEE WORKPLACE POLICY; REPEALING ALL ORDINANCES OR
YAR'TS OF ORDINANCES IN CUNFLICT HEREWITH; AND PROVIDING F0R
AN EFFECTIVE DATE OF JULY 1, 1991.
f'sE IT ORDAINED iiY THE CITY COUNCIL OF THE CITY UF PARIS:
Section I. That Chapter 2, Article IX of the Code of
Ordinances of the City of Paris, Paris, Texas, be amended by
amending Section to the Personnel Regulations so that
such shall reaci as follows:
"Sec. - llrug and Alcohol Testing Policy and
Procedures
D. DEFINITIONS
(8) Safety-sensitive positions ,neans jobs where
an employee s use of drugs or alcohol could create a
threat to satety whereby the employee's ability to
perform assigned duties is impaired and the performance
of thcse duties in such mental ar physical condition
creates or could create a safety hazard that has
caused, or could cause injury or harm to the employee
or other employees or citizens or damage to property,
including rnembers of the Fire and Yolice services.
(y) Serious injury means any injury which results
in a death, or an injury to an employee, passenger, or
other person which requires professional medical
treatment or which renciers the employee unFit to
perform routine duties, irzcludirig members of the Fire
and Police services.
E. APPLICANTS ANu EMPLOYEES SUBJECT T'0 TESTING
(1) The following classes of applicants will be
subject to drug and alcohol testing:
(3) The following empioyees may be subject to
drug and/or alcohol testi.ng:
(a) Those whose use of City equipment
results in serious injury to himself ar another
person or damages of $1,000.00 or more,
(b) Those who fall within the definition of
safety sensitive positions in Section D(8),
incluciing members of the Fire and Police services,
(c) Those whose duties regularly involve
repetitive exposure to drugs, (testing will be
conducted on a periodic, unannounced basis),
(d) Those where there are allegations
involving excessive use of force,
(e) Those who discharge a firearm resulting
in bodily injury, property damage or violation of
general orders.
Section 2. All ordinances or parts of ordinances in
conflict herewith are hereby expressly repealed.
Section 3. This ordinance shall become effective on
July 1, 1991.
