AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING THAT THE
CODE OF ORDINANCES, CITY OF PARIS, BE AMENDED BY REVISING SUBSECTIONS (b)
ANll (c) OF SECTION 34-22 OF SAID CODE TO ESTABLISH WATER RATES FOR
RESIDENTIAL, COMMERCIAL AND INDUSTRIAL CUSTOMERS WHICH IS BASED UPON THE
COST TO SERVE EACH CLASS; BY REVISING SUBSECTIONS (a) AND (c) OF SECTION
34-23 ESTABLISHING A SEWER SERVICE RAI'E FOR CITY WATER CUSTOMERS AND
ESTA$LISHING THE COST TO USERS DISCHARGING OVERSTRENGTH SEWER; PROVIDING
FOR A PENALTY NOT TO EXCEED $2,000.00; REPEALING ALL ORDINANCES OR PARTS OF
URDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFF'ECTIVE DATE OF
SEPTEMBER 1, 1991.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS:
Section 1. That Subsections (b) and (c) of Section 34-22 of the
Code of Ordinances of the City of Paris, Paris, Texas, be amended so that
such shall read as follows:
"Section 34-22. Water rates.
(b) Charges for water furnished by the City are estabiished
as follows based upon meter size, base cost which includes the
cost for the first increment of water, and a cost per ane hundred
(100) cubic feet used above the first increment:

(c) An optional charge for water furnished by the City to
customers serviced by meters greater than three (3) inches in
size the minimum monthly charge of which is guaranteed by the
customer of a minimum period of one (1) year is established as
follows:

Section 2. That Subsections (a) and (c) of Section 34-23 of the
Code of Ordinances of the City of Paris, Paris, Texas, be amended to read
as follows:
"Section 34-23. Sewer rates - For customers using
city water.
(a) Charges for sewer service furnished by the City to
residential, commercial and industrial customers shall be based
upon water meter size, a base cost for the first increment of
usage and a cost for each additional one hundred (100) cubic feet
above the first increment; as follows:

(c) Users desiring to discharge sewage into the city's
sewerage system, the strength of which sewage exceeds two hundred
fifty (250) parts per million Biochemical Oxygen Demand (BOD);
two hundred fifty (250) parts per million of Total Suspended
Solids (TSS), ar thirty (30) parts per million af ammonia (NH3),
and which is acceptable under Article III of this chapter, may do
so upon written permission ot the city and by paying a monthly
treatment charge in the amount of twenty-four cents ($.24) per
pound of Biochemical Oxygen Demand (BOD) in excess of the
allowable Biochemical Oxygen Demand (BOD); twenty-one cents
($.21) per pound of Total Suspended Solids (TSS) in excess of the
allowable Total Suspended Solids (TSS); and seventeen cents
($.17) per pound of ammoriia (NH3) in excess of the allowable
ammonia strength. The city shall make the necessary tests of the
user's sewage strength to determine this charge. The charge
prescribed by this subsection shall be in acidition to the charges
prescribed in subsection (a) hereof. The above described
excessive strength surcharge rates may be recalculated immedi-
ately atter the adoption of the annual budget, using the amount
budgeted as cost and actual operational characteristics tor the
most recently completed twelve (12) month period for plant
loading. Such rates shall becon►e effective when adopted by the
city council or on September 1, whichever occurs first."
Section 3. Any person violating any ot the provisions of this
ordinance shall be guilty of a Misdemeanor, and upon conviction shall be
fined in any sum not to exceed $2,000.00, and each and every day's
continuance of any violation of the above enumerated section shall
constitute and be deemed a separate offense.
Section 4. All ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
Section 5. This ordinance shall become effective on September l,
1991.
