AN ORDINANCE CONTAINING A HEARING ON PROPERTIES LOCATED IN THE
CITY OF PARIS, TEXAS, BELONGING TO VARIOUS OWNERS, AND AN ORDINANCE
OF THE CITY COUNCIL FINDING THE MATERIALS REMAINING ON THE PREMISES
TO CONSTITUTE A NUISANCE AND TO BE A FIRE HAZARD TO LIFE AND PROPERTY
AND A HAZARD TO THE LtFE AND WELFARE OF THE INHABITANTS OF THE AREA,
AND ORllERING SAID RUBBISH, LUNIBER AND REFUSE FROM THE STRUCTURES TO
BE TORN DOWN AND REMOVED FROM THE PREMISES IN ORDER TO ABATE SUCH
NUISANCE.
WHEREAS, a public hearing was called to order by the Mayor of
the City of Paris, Eric S. Clifford, on the 8th day of March, 1990,
at 5:15 o'clock P.M., in the Council Room, City Hall, in the City of
Paris, Texas; and,
WHEREAS, the City Council finds that the Building Hazard
Inspection Committee fixed a date for hearing on the resolutions
referred to the Committee by the City Council on the 13th day of
November, 1990, and said Committee fixed said hearing at 10:00
o'clock A.M. on the 26th day of January, 1990, and the hearing was
had thereon. That proper notice was given to the owner or owners of
the structures located at the following addresses:
1310 W. Sherman, Lot 4, Block 218
1154 W. Cherry, Lot 10, Block 84
323 2nd N.E. Street, Lot 10, Block 58
255 13th S.W. Street, Lot 9, Block l, Walkers lst Addition
658 12th N.W. Street, Lot 22, Block 84
1629 15th N.E. Street, Lot 4, Black K, East Park Addition
1430 lOth N.E. Street, Lot 13, B1ock P, East Park Addition
541 15th S.W. Street, Lot 13, Block 229
711 Wood, Lot 3, Block 93-C
That at said hearing the Committee listed the structures involved and
introduced pictures of the various portions of the structures and
various portions of the premises involved and a list of discrepancies
in the structures located thereon. That the Committee found that
each of the above structures was in such state of deterioration and
dilapidation as to create a serious fire hazard to life and property
and that each of said buildings was dilapidated ancl was dangerous to
life and property and dangerous structures to life and property.
That said buildings are in such a state of dilapidation and decay
that none of said structures are capable of repair. lt is further
found that the condition of the premises and structures involved was
such that the Committee recommended to the City Council that they be
declared a nuisance and that the owners thereof be ordered by the
City Council to tear down and remove the same from the lots involved.
That said Committee filed a complete report of its hearing and its
findings with the City Clerk of the City of Paris on the 5th day of
February, 1990; and,
WHEREAS, the City Council further finds that proper notice was
given to the owner or owners of the structures hereinafter listed.
That at said hearing on the 26th day of January, 1990, the Committee
"listed the structures involved and introduced pictures of the various
portions of the structures and various portions of the premises
involved and a list of discrepancies in the structures located
thereon. That the Committee found that each of the hereinafter
listed structures was in such state of deterioration and dilapidation
as to create a serious fire hazard to life and property, and that
each of said buildings was dilapidated and dangerous to life and
property and dangerous structures to life and property. That the
owners of the property appeared before the Committee and requested
time to repair the structures or the Committee found that the
structures could be repaired. That it was the recommendation of the
Committee that the structures be condemned ur repaired and that the
respective owners thereof be given the time to abate said nuisance by
repair or removal as is set out in connection with each of such
addresses, as follows:
1310 West Sherman, Lot 4, Block 218 30 days to repair
323 2nd N.E. Street, Lot lU, Block 58 30 days to contract
3 mos. to repair
225 13th S.W. Street, Lot 9, Block 58 30 days to repair
and it is so stated in the report of the Building Hazard Inspection
Committee filed with the City Clerk of the City of Paris on the 5th
day of February, 1990; and,
WHEREAS, the City Council has fully heard and considered the
testimony presented upon the hearing and a complete transcript of the
testimony reported by the Building Hazard Inspection Committee; NOW,
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS:
Section 1. That the structures located at the following
addresses:
1254 West Cherry, lot 10, Block 84
65$ 12th N.W. Street, Lot 22, Block 84
1629 15th N.E. Street, Lot 4, Block K, East Park Addition
1430 lOth N.E. Street, Lot 13, B1ock P, East Park Addition
541 15th S.W. Street, Lot 13, Block 229
711 Wood, Lot 3, Block 93-C
are a nuisance, and they are hereby declared a nuisance, in that they
are dangerous to life and property, arid that the same constitute a
fire hazard to life and property, and that the respective owners are
hereby ordered to abate such nuisance within thirty (30) days from
the date hereof. The City Clerk is directed to furnish the owners a
copy of this ordinance, in the event the addresses of said owners are
known, and in the event the respective owners refuse to comply with
this ordinance, the City Attorney, T. K. Haynes, is hereby directed
to proceed to enforce this ordinance by the procedure provided for
in Article III of Chapter 7 of the Code of Ordinances of the City of
Paris.
Section 2. That the structures hereinafter enumerated are a
nuisance, and they are hereby declared a nuisance, in that they are
dangerous to life and property, and that the same constitute a fire
hazard to life and property, and that the respective owners are
hereby ordered to abate such nuisances on or before the dates set out
in connection with the addresses of each of such structures, as
follows:
1310 West Sherman, Lot 4, Block 218 April 12, 1990
to repair
323 2nd N.E. Street, Lot 10, Block 58 April 12, 1990
to make contract and
June 12, 1990
to repair
225 13th S.W. Street, Lot 9, Block 58 April 12, 1990
to repair
The City Clerk is directed to furnish the owners a copy of this
ordinance, in the event the addresses of said owners are known, and
in the event the respective owners refuse to comply with this
ordinance, the City Attorney, T. K. Haynes, is hereby directed to
proceed to enforce this ordinance by the procedure provided for in
Article III of Chapter 7 of the Code cf Ordinances of the City of
Paris.
