BACKGROUND:
The City received a HOME Program grant from the Texas Department of Housing and Community
Affairs to build up to eleven new homes for qualified low- and moderate-income homeowners. A
' request for proposals was issued for construction of the homes. Based on the proposals received, the
staff recommends awarding the construction contract to Whitaker Homes.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
AWARDING THE BID FOR THE CONSTRUCTION OF SINGLE-FAMILY
HOMES UNDER A HOME PROGRAM GRANT RECEIVED FROM THE TEXAS
DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS (TDHCA), IN
THE CITY OF PARIS, TEXAS TO WHITAKER HOMES, THE LOWEST
RESPONSIBLE BIDDER; MAKING OTHER FINDINGS AND PROVISIONS
RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Paris did heretofore, advertise for bids for
furnishing plant, labor, materials, and equipment, and for performing all work required for
the construction of up to eleven (11) new homes under a Home Program Grant, Contract
No. 1001273 received from the TDHCA in the City of Paris, Texas which bids were received
until 10:00 o'clock a.m., Wednesday, the 4th day of April, 2012; and,
WHEREAS, the lowest responsible bid providing the best value to the City was
received from Whitaker Homes, 2550 Lamar Ave., Paris, Texas, and the bid should be
awarded to Whitaker Homes in accordance with the unit prices bid and the other terms
and conditions set out in the bid documents attached hereto as Exhibit "A"; and,
WHEREAS, the form of the bid for such home construction project, included in
Exhibit "A" attached hereto, should in all things be approved, and the City Manager should
be authorized to execute the necessary documents for the home construction project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS:
Section 1. That the findings set out in the preamble of this resolution are hereby
in all things approved.
Section 2. That the bid of Whitaker Homes, 2550 Lamar Ave., Paris, Texas, for the
construction of up to eleven (11) new homes under a Home Program Grant received from
TDHCA Contract No. 1001273 in the City of Paris, Texas is hereby accepted as the lowest
responsible bid which provides the best value to the City and the contract for this project is
hereby let conditioned upon said contractor meeting all of the terms and specifications
included in the bid documents attached hereto as Exhibit "A".
Section 3. That the City Manager be, and he is hereby, authorized and directed to
execute, on behalf of the City of Paris, the necessary documents with Whitaker Homes as
described in Exhibit "A" attached hereto.
Section 4. That this resolution shall be effective from and after the date of
passage.

Concentrated Employment Program, Hometown Plan, or the U.S. Employment

or on referral fram any source, and to employ such person, if otherwise eligible and if
a vacancy exists.
D. To insert this plan in all bid documents and to require all bidders on subcontract to
submit an affirmative action plan including utilization goals and the specific steps
planned to accomplish these goals.
E. To insure that subcontracts (greater than $10,000) which are a typically let on a
negotiated rather than a bid basis in areas other than the project area are also let on a
negotiated basis, whenever feasible, in a covered project azea.
F. To formally contact unions, subcontractors, and trade associations to secure their
cooperation in this effort.
G. To insure that all appropriate project area business concerns aze notified of pending

GENERAL [NSTRUCTIONS AND NOTES
The City of Paris is soliciting proposals for the construction of single-family homes within the city limits of
Paris. The homes will be constructed on the site of the existing home of the owner aRer their existing home
has been demolished. One to eleven homes will be constructed under a HOME Program grant received from
the Texas Department of Housing and Community Affairs (TDHCA).
All proposals must be submitted by the bidder to the City of Parts, 135 SE in SL., Paris, TX 75460 on or
before 10:00 a.m. on the 4th day of April 2012. Bids will be publicly opened and read aloud Apri14, 2012
at 10:15 a.m. The City will select the general contractor that submits the most favorable bid and is
qualified to do the work with the lowest combined basQ bid for the house plans including alternatives
selected by the City.
Without limiting any uf the other obligations or liabilities of the bidder (cantractor), the contractor and
each subcontractor shall, during the term of the cantaract, acquire and maintain the hereinafter stipulated
minimum insurance with companies duly authorized to do business in State of Texas. Certificates of each
policy shall be delivered to the City before any work is started. The minimum insurance requirements are
as follows:
1. Workers' Compensation as required by state law;
2. Comprehensive generat liability fully insuring contractor liability for injury to or death, in the
amount of at least $250,000;
3. Comprehensive automobile and truck liability insurance in accordance with state law; and
4. A performance bond on the part of the contractor for 100 percent of the contract price. A
"performance bond" is one executed in connection with a contract to secure fulfillment of all the
contractor's obligations under such contract
5. A payment bond on the part of the contractor for 100 percent of the contract price. A"payment
bond" is one executed in connection with a contract to assure payment as required by law of all
persons supplying labor and material in the execution of the work provided for in the contract
All contractors will be required to bid on the home based on the attached construction drawings/plans and
construction specifications. All houses will be constructed to meet the Texas Minimum Construction
Standards, including certain accessibility requirements, Residential Enerp+ Code and local/state codes.
The Contractor must ensure employees/applicants for employment are not discriminated against because
of race, color, religion, sex or national origin. Section 3 of the HUD Act of 1968 (12 U.S.C. 1701u) as
amended, and implementing regulations at 24 CFR Part 135 is applicable to this project
Since the City will be funding this hame with a grant received from TDHCA, payment for work will be made
only upon completion of the various stages of the home and after progress and final inspections have been
made and approved by the City or by their designated representatives. Payment will be made within 45
business days after the approval of each invoice. Construction of the home shall be completed within 120
days frvm the date a notice to proceed is issued to the contractor unless a longer time period has been
stipulated as part of the bid price. Construction must begin within 10 working days from the issuance of
the notice to proceed.
All bid proposals must include, at a minimum:
1. Bid Sheet;
2. Detailed bid sheet for each plan;
3. Contractor Application, which lists contractor's qualifications, experiences, and work references;
and
4. Affidavits included in bid packet
5. Evaluation Form
6. A full set of house plans, if submitting an alternative plan bid.

Bidding procedures, bidder selection, and any subsequent bidder appeal wili be conducted in accordance
with the applicable local, state, and federal procurement regulations and protest procedures established by
the City of Paris in compliance with 24 CFR 85.36.
Bidder Eligibtlity:

Potential Disqualification Factors:

conditions and/or scope of the work to be performed. Any bid exemption, variation, adjustment, or
modifications without written approval by the City prior to submission will disqualify bidders.
3. The bid package must be submitted in a sealed envelope. Bids shall not be submitted fn any
manner whereby the amounts of bid or bids may be disclosed, examined or read prior to the time of
the bid opening.

HOME Bidder Protest Procedures
Bidding procedures, bidder selection and subsequent bidder protest or appeals will be
conducted in accordance with applicable local, State and Federal procurement regulations and
protest procedures established by the City in compliance with 24 CFR 85, as applicable, and 24
CFR 92.
Any protest of the proposed award of the bid to the bidder deemed the lowest responsible
bidder must be submitted in writing to the City Manager no later than 5:00 p.m. on the third
(3`d) business day following the bid opening.
The initial protest must contain a complete statement of the basis for the protest.
The protest must state the facts and refer to the specific portion of the document or the
specific statute that forms the basis for the pratest. The protest must inciude the name,
address and telephone number of the person representing the protesting party.
A subcontractor of a party filing bid on this project may not submit a Bld protest. A party may
rely on the Bid Protest submitted by another bidder, but must timely pursue its own protest.
The procedure and time limits set forth in this Section are rnandatoty and are the bidder's sole
and exclusive remedy in the event of a Bid Protest. The bidder's failure to fully comply with
these pracedures shall constitute a waiver of any right to further pursue the Bid Protest.
The City shall review all timely protests prior to awarding of a bid. The City shall not be
required to hold an administrative hearing to consider a timely protest, but may do so at their
option. At the time of the City's consideration of the award of the bid, the city shall also
consider the merits of any timely protests. The City may either accept the protest and award
the bid to the next lowest responsible bidder, or reject the protest and award to the {owest
responsible bidder. Nathing in this section shall be construed as a waiver of the City's right to
reject all bids.

3.3. Notice W Prnceed. The Contcactor will begin work within ten (10) days of the issuance of the Notice to
Proceed (unless otherwise stipulated).
3.4. The number of work days must be set aut in the contract.
3.5. Upon completion of the work and acceptance by the Contract Administtator and the homeowner, the
Certificate of Final Inspcction and Verification is issued and the Wetranty Period begins,
3.6. Thirty (30) days aRer the issuance of the Final Inspectioa end Verification, all retainage is released to the
Contractor, execpt in cases where it is determined that the retainege should not be released.
3.7. Compensation

A. The Contractor will submit in writing to the Contract Administrator, a list of items, their costa, and

schedule of values submitted by the Contractor prior to construction, or the Itemization of Bid
Form if no schedule is submitted.
B. The Contract Administrator will inspect such work as eoon as possible (usuatly within one (1)

Contractor for work for which payment is authorizcd,

3.9. All work must be done with skilled craftsmen and accomplished with care.
3.10. All materials used must be new (unleas otherwiso specified in the Project manual) and of a good qualiry.
3.11. Product Submittals - contractor must provide samples to the Homeowner for Belection for ail materiale as
cited in the individual specifications and provido reasflnable time to the homeowner to make selecbons
Contractor must provide written submittal with the homeowner`s signawrc of apprnval to the Contract
Administrator. Items to be submitted for approval: paint, flooring materiels, brick, shingles, color of vinyl

4.0 Project Cloec-Ont
4.1. Cleaning: Remove all construction debris from the site. Clean aad mop all resilient floors. Clean all new
and existing paint from other finished sorfaces including window glass and mirrors.
4.2. Qperating Items: Leave all newly instatled items in operating condition. Light gas water heater pilots and
gas heater pilots. Start all systems.
4.3. Prepaiation of Structune: Prepare structwe for homeowner's occupancy.

4.4. Hardware: All hardware to be put id operating condidon. New keys must be turned over to homeowner as
work is compieted.
4.5, Utilities: Use exisring or provide own at Contractor's expensc if existing is insufficient. Homeowner must
provide a11 existing utilities as is and must be responsible for continuous maintenance and payment of
existing utilities. Contractor will be responsible to determine utility eeeds to provide adequate sanitary
facility and to safely opecate equipment at all dmes on site.
4.6. Unforeseen damage or Change in Scope of Work: Discovery of defective elements made known W the
Contractor before or during the construction process must be brougtrt w the immediate attention of the
Contract Administcator in wdting. When repaics are made, the repairs must reasonably mateh the
surrounding materials in original design aad dimension as appmved by the Contract Adtninistrator.
4.7. Where additional work is necessary to make repairs or to correct unforesezn dangerous conditions, the
Contractor must submit to the Conttact Administrator a work write-up of the work, cost of such work, and
the time necessary for such work. Unless it is deteTmined there exists an immediate health and safety
danger, NO WORK MUST BE AUTHORIZED until xgreed apon in wridng by the homeowner,
Contraetor, and Contract Adminietrator. Compensation for additional work will be negotiated in the
following maanet:
A. The deletion of work proposed, but not started; or if that ie not possible;
B. An inccease to the dollar amount of the contract, however, epproval of such increase require the
homeowner, contractor, Contract Administrator, and State of Texas HOME program written
approval.
C. Addidonsl Work - No other work must be done to the project other than the work agreed upon in
writing by the homeowner, Contract Administrator and contractor or as necessary to romove
iaunediato hoakth and safety dangers during the construction phase.
4.8. The Job Sitc
A. At the job site the contractor must obtain and display all pecmits and inspection tags as requirod by
the local Inspection Department.
B. The Contraotor must use the site and its fecilitiea only for the constiuction stipalated in the "work
write-up". The electrical, sanitary waste, water, and gas systems must be uscd only for
conshvction pwposes and dwiag the eonstruction phase or dwing warranty work.
C. Any discrepancy in the contract documents must immediately be brought to the attention of the
Coatract AdminisUator.

A. All on-site fill material must be soil or soil rock mixture which is free of organic matt,et or other

5.2. Methods
A. Exterior. The site must remain in a clean and neat condition and at the end of the project must be
cleartd of all material, trash, and debris. Planting of grass must not be permitted until all clean-up
is completc.
B. Demolition: Debris and structures must be removed completcly from premises and site must be
leveled and clean so as to prevent the ponding of water.
C. Excavating: Excevate to grade specified in the drawings. Where excavations are not ehown in
drawings, excavate as required form installation. Depressions resuldng from i+emoval of site
obstructions must be filled as necessary to level site to originat or specified grade.
D. Sub-grade preparadon: Clearing, scarifying, and re-compaction must be completed es specified, if
not specified it must be completed as required for installation.
E. Structural fill must bc compacted to 95%.
F. Paved areas fill must have a minimum of 6b' of fill eompacted to 90'/0.
6.0 Concrete
6.1. Materials
A. Alt concrete must have a minimal- 28 day compression strength of 2500 psi with a maximum
slump of 6b'.
B. All reinforcing steel must comply with ASTM designation A 615 Grade 40, and must be clean and
fiEe of nist.
C. All welded steel wire fabric must comply With ASTM designation A 185.
D. Concrete must not be placed over grass, roots, or foreign materials.
E. All Portland cement must comply with the requiroments of ASTM C150, CSA A-S, or AASHTO
M85.
F. Cement used at or below grade must comply with the requirements of Type 1.
G. Cement used above grade must comply with Type 1.
H. Fill dirt must be clean, compacted, and free &om harmful materials.
1. All materials used for concrete forms must be sound and clean and must be removcd after the
concrete reaches final set. Voids and honeycombed surfaces must be filled with cement grout.
All concrete is to be poured when the temperature ie at forty degrces Faheenheit (40 F) or above
and rising. If the surface temperature is over ninety degrees Fahrenheit (90 F) steps to cooi the

6.5. Slab on Grade
A. All eonerete stabs must be poured tuonolithieally and be a minimum of 4" thick. Reinforcing
must be 6b'x 6d, Number 6 welded wire fabric unless otherwise spocified. Top of slab poured on
existing grade must be a minimum of hb' above surroundiag soil level. All slab designs and
executions must concur with the reyuirements of the Southere Building code.
A. Before concr+ete is poured, a slab iaspectaon must be requested from the Contract Administrator
and then pass inspection. A!l slabs and driveways muat meet Contract Administrator codes.
B. Walks must be poured monolithic to expaasion joints. Reinforcing must be 6b' x 6b', number 10
welded wiro fabric. Width must be a minimum of 36b, wide with a broom finish. Control joints
must be spaced the width of the waik. Expansion joints roust be spaced at a maximuro of 203, at
all radius points, elevation changes (i.e. steps, porches, etc.) and at back of curb. Expaosion joint
material can be'hb' asphalt impregnated material or'/sb' redwood. Slab thickness must be a
minimum of 4b.
C. Driveways must be monolithic poured slab with a broom finish and a minimum thickness of 4",
Reinforcing must be 6d x 6t/ number 10 welded wire fabric. The slab will be powed on a 2d,
sand cushion (compacted). Expansion joints will be spacai a msximum of 20 linear feet not to
exceed 30 sq. yands in one block. Expansion joints will be used at all radius poiots, sidewalk
intersections and house slab tio-ins. Expansion joint materisls can be h", asphalt impregnated
material or'/:,,, redwood.
E. Exterior beams must have a minimum width at top of beam of 18`d, and may taper down to 14d at
the bottom. Exurior beams to have a minimum of 4, #5 (5/8 b') rebars, two (2) at the top and two
(2) at the bottom, set on 3/8t/ stirrups or #6 wire mesh cut to fit. Exterior beam must txtend a
minimum of 6'd into undisturbed soil. Exterior beam must be a minimum of 243 in height.
F. Interior beams must be minimum of 18b', in height and should have two #4 (1/2t!) rebats side by
side 6`d, off bottom of beam set in 3/8b' stinups or #6 wire mesh cut to fit at 33 O/C. Interior
beams width to be 16b' in width at top and may taper to 8b at bottom. #4 rebar to have a
minimum lap of 12". #5 rebar to have a minimum lap of 15". Interior beam to extend 3b', below
undistiurbed soil.
G. All slab and beam specifications listed herc must be used unless thc Contract Administrator's
Building Code requirements or specifications exeeed these specifications. All siab designs and
executions must concur with the requirements of the Soathern Building code.

6.11. Foundation Drainage - When existing grades or excavations atlow water to accumulate under the structwe,
a drainage diteh must be dug so water must drain away from the house. Ditch must be tocated as per
individual speciflcation. Open ditches which constitute a trippinQ hazard must be replaced with French
drains. Freneh drain will be constructed of 6d perforated PVC drain field linc and installod in a ditch at
least 12b in depth and 8d wide. The ditch wili be back flled with P gravel and the dmin line protected

B. When house is W be raised or lowered, temporary connections must be provided to have
continuous operation of all systems by the homeowner. Any iptemtption of aervice must not
exceed 28 hours. Homeowner must be notified at least 24 hows prior to expxtad intorruption,
and must be nodfied when system is once again operational.
C. Relocau house lines to new or relceated fixtures. Install new venting to new fixture locations.
All lines must be located in wall cavities and under foundation Inclnde roof jacks and flashing
where ner.essary.
D. If lines can be repaired they must be repaired as needed to be in good operating condition and free
of defects.

A. New or replaced Kitchen sink must be new stainless sta16" deep double basin, 30" sclf rim unit
installed in kitchen to include strainers/drain plugs, water and waste line eorreetions. Rim must be
sealed to countertop with standard sealer (i.e. plumbers putty, dap sealer, etc). Water lines must
have cut off vatves at sink. Faucets must be a washerkss, cartridge type, sin$le lever unit unless
otherwise spocified. Unit must be chrome plated braes.
B. New or replaced lavatory - replace with a cast imn porcelain enamel unit if damaged. Mount
securely to wail frame located as per plans. Faucet must be washerless, chrame plaitd brass dual
control unit with water, DWV, and cut off vatves. Vanity unit, when specified, must have
monolithic sink and top of resin cast marble, base must be wood veneer on front and sides.
C. New or replaced Tub Unlt - install new white enaroeled stcel tub unit as per plans. To include new
trap overflow and drain with stop vslvc, and waur and waste connections. Valve must be
washerless and high quality chrome plated brass unit with dual control, jewel handles. Install
plumbing access.
D. New or replaced Shower Tub Unit - install new white fiberglass showerltub unit as per plans. To
include new rap overtlow and drain with swp valve and water connections. Valve must be
washerless and high quality chrome plated brass unit with dual control, jewel handles.
E. New or replaced Water Closet - install new white round bowl vitroous china low-flow type unit as
per plans. To have new tank gaskets, flow valve assembly, handle, mountings, lid and seat, snd

fittings. Fumace must be thermostatically coaVolled, high efficiency, forced sir, sutomatic fan
control unit. $TU output and number of unita tnust be determined in the individual Specifications.
Unit must have gas shutoff located adjacent to the unit. The unit must be installed by a licensed
HVAC contractor.
B. Install new water heater to be 30 gallon high efficiency, gas find automa6c tank type heater
located ss per plans. Unit must include all new venting and conneccions. Gas outlet and cut off
must be located at front of water heater c[oset. Fresh air inlets are required at top and bottom to
allow combustion air to vent from t6e outside. Installation must be according to SBCC.
20.5. Pipiag
A. New or replaced Drain, waste, and vent lines must be standard weight galvanized stetl pipe with
cast iron drainage Sttings, or standard weight cast iron soil pipe and Sttings or schedule 40
polyvinyl chloride pipe and fittings. All piping passing through the roof must be properly flashed.
Must have clean-out located at exterior of house.
B. New or replaced Water lines must be type "L" copper, located inside wall cavities. After
installation they must be pt+essure testod with 125 psi for 30 minutes prior to coverage. A
dielxtric fitting is required between piping of diesimilar metals. A(1 water tines above ground and
not inside an insulatod wall cavity or ceiling/attic space will be $+eeze protecW with'/i',

1.0 Overvlew
1.1 The pwpose of the Texas Minimum Conswction Stsndards ('I'MC Stamdards) is to ensure that all Texans
who raxive new or cehabilitated hoosing scrvices tFu+ough pr°gmms funded by the Texas Department of
Housing and Communiry Affairs (TDHCA) live in housing that is safe, decent and affordable. Furthermoro,
the Texas Minimum Conswction Standards should ensure that the investraent of public and homoowner
fuads is designed to increase the valuo of the PropertY,lenBthen the term of affordability, and prese►ve
habitsbility.
1.2 All work carried out with tt►e assistance of funds provided through the TDHCA must be carried out in
accordance with these standards, mast meet mintmum sPec'fications snd unless othenvise defitkd must mcet
or exceed industry end trade standards.
1.3 Dcfinitions and Acronyms
A. AOME Program means the HOME Inveshnent Partnerships Program as a program of the Texas
Departmet►t of Housing ar►d CommunitY Affairs•
B. TDHCA is an acronym for Texas Department of Housing and Community Affairs.
C. TMC Standards is an acronym for Texas Minimum Construction Standards. TMC Standards was
formerly knowr► as the Texas Minimum New and Rehabilitation Conshuction Standards
1.4 Inspections
A. Inspections must be carried out using the appmpriste'TMC Standards chxlcliets• Ali rooms,
service porches, exterior areas, out buildiags, crawl spaces and attie sPaces must be mcluded in all
inspections. Inspectiona will include all issues ineluded on the checklist but, when not indieatcd,
any evidecrt deficiency or hazerd will be noud. Whti► cural ProPectY is inspxted, a11 out buildings
used by the household for swraSe, garage, etc., will be includod with all yard areas. Otlierwise all
buildings and yard spaoe incfuded on an individual lot will be inspeoud• Once HOME funds are
~vested, all iospected anas must meet TMC Standards• No exceptions or deletions will be
permitted.
1.5 Work Write-Ups
A. Wodc write-ups should be written with enough detail w specify, each ium to be repaired, quantity
of materials to be used end exact location of each repair. Each item should relate to a specific
inspeetion ittm and should have a specific line item cost estimate•
1.6 Cost Estitnatas
A. Cost esdmates should be detailed for each repair item. F.ach rePair item must reference a specific

1.7 Responsibilities
A. Homeowners are responsible for completing epplicetion materia]s, returning aU t+eqttited
documentation within the dme frame stated on the app(ication materials and responding to any
inquiries regar,ding applicadon deficiencies. A homeowner who fails to do these things within a
timely manner will be disqualifed for services.
B. Homeowrters who are selected for services must undetstand the budget limitations of the program
and will be briefed on what services they will receivo. Homeowners must underacand that a
thorough inspecpon of thcir homes may ncsuit in a"walk away" if necessary repairs exceed the
program's previously established budget Homes that are denIed on this basis may be prioritized
for reconsmuction when reconstruction funds are available. To complete necessary repairs within
the established budget, homeowners, if thty are physically able, may be sska{ to perform "svveat
equity" tasks such as eleaning yard areas. These tasks should be completed prior to contracted
services.
C. It is the homeowner's responsibility to review all contractual materia(s ineluding specificstions,
work write-ups and contracts prior to signing a HOME agnoement. Items t6at are rwt spocified in
writing including type of materials, colors and etc_ an not part of the HOME agt+eement The
scope of services must be discussed in a pre-construcNon conference at whieh time the homeowner
will receive a copy of all related construction materials including specifications, write.ups and
agreements. It is recomrnended each item of the work wriu-up be initisled as approved by the
homcowncr. The homeowner's signahue on the HOME agreement wili serve to acknowledge
awareness of all such documents.
D. It is the homeowner's responsbi]ity t;o aRange access to convactors for rehabilitation construcdon
services including punc6 list items and warisnry work. If reasonabk and timely acce,ss is denied to
a contractor who is attempting to make a good faith effon to make roquired repairs, the
homeowner will become responsible for these repairs.
E. Except when acccss is permitted for c+ehabilitation services, secwity of the property;s the
homeowners responsibility. Movemont, storage and seauity of personal propercy;s the
homeowners responsibility. Personal Property damaged, displaced or missing during the
rehabilitation phase of services should be reported immediately to the Contract Administrator but it
is up to the homeowner to pursue damages for such lossea. It is recommended that a thorough
photographic and wtitten inventory be completed prior to rehabiiitation.
F. Durintg rehabilitation the homeownec will not affect repair areas and will malce a reaconable effort
to stay away from the constcuction zone.
G. The homeowner must approve each itemized draw that the contiactor r+equests and must make a
reasonable effort to inspc.ct each item for which the contractor is claiming payment gy signing the
"contractor request for payment" the homeowner is verifying that to the best of their
understanding, each of the noted repair items has been completed according to the wribten
specifications. If the homeowner is not satis8ed with a particular item of repair that is beiag
presentod for payment the homaowner may delete this item(s) untll such nepair is rectified.
However, if the homeowner refuses to s{gn, and the repair is done according to spec;fications, the
homeowner may be responsble for payment to the contractor far time 1pst. Any such conflicts
must be solved by the Contract Adminishator according to the specifications.

H. Except for reconstruction or other required intemuptions, tho homoowner must provide all exisang
utilities for use by the contractor (as thcy relate to the construction) and must be responsible for
continuons maintenance and payment of existing utilities.
1.8. In order W mett TDHCA Standards, contractors are responsible for, and must meet minimum requiremtnts
as follows:
A. Ail contractocs must cazry and providc groof of a current general liability policy of at kast onc
hundred thousaed dollars (5100,000).. This policy should cover all work done under the HOME
pmgram and be pra-paid through the period of the contract. No geographic, time or other
limitation that excludes the NOME program will be acceptable.
B. All contracWrs must be verifiod by T"DHCA as not being debarred by the Fedecal Governmtnt.
Any contractor who is current(y debarred will not be eligible for payment and should not becomc
party to a HOME Program funded project.
C. Whenever possible, Contract Administrators will give opportunities W Historioally Underutilized
Businesses (HUBS) and will malce an affirniative effort to eneourage bids from such contcactors.
D. Whenever possible, opportunities must be given to locally owned busit►esses and low-income
residents of a given area. This must be establishal in a"Local Oppodunity (Scction 3) Pla4."
E. In addition to these requirements, a Contract AdministraWr tnay eatablish his/her own fair and
evenly applied criteria for contractor selection. T6ese may inelude but are not limited to;
l. Workers compensation inswance;
2. Verification of quality of work references;
3. Verification of credit referenees, and;
4. Verification of established line of credit
1.9 An approved contractor list may bc created but must be accessible to all spplicants who mcet the fair and
reasonable criteria pre-established by the Contract Administrator. Such criteria should be published as an
element of the Program Policy and Procedures and must be made available in writing upon demand by
interested parties. It is recommended that the published criterie, along with an advertisement to bid, be
posted in a public place. Any advertisement to bid shouid allow reasonable time for an interested party to
meet the criteria nquired by the Contract AdministraWr.
1. 3 0 Contcactors will be selccted through an itemiud bid process. A sealed bid is the prefured method for
selecang bids. If the modified bid process is beiaQ fopowed, the homeowner may sdxt any bid that is
within I S% of the coat estirnate. Howover, the low bid is always preferred and the homoowner should state
their preference for a higher bidder in writing. If the homoowner has defemed contractor selectios to the
Contract Administmbnr the lowest and best bid will be selected.
1.11 Contractors will adherc to tho terms of the rehabilitation contact including these performance standards
and the gentral specifications. Whenever the need for clarifieation irsults in a change, such issues will
result in a written chaage order prior to any work being completed. No work will be approved except that
which is established in the contract and in wriuen approved change orders. Any unforesxn or hidden
condition should be reported to the Conhact Administrator immediately. Any item that conflicts with these
standards sttould be reported immediately by the contcactor.
1.12 Whenever possible the contractor will tnake an effoR to minimize tho impact of the consWction on the

homeowner. Work must be carried out swiftly and directly. Electric, water, sewer aad gas sayice will not
be intenuptcd for mor+e than twelve (12) hours without written appraval by the homeowner. Heat will be
provided at all timcs during winter months. Doors, windovvs and any other largc openings or air teaks will
be repaired on the same day. The work area must be secured at all times.
1.13 The work area must be left clean and frce from clutter at the end of each day and the contractor and not the
6omeowner will be responsible for scorage of materials and tools.
1.14 Prior to the commencement of construction the homeowner will artatige to move and store any valuable
personal property that might be damaged during the course of construct;on. If property is damaged through
negligence of the contractor, ariangements will be made by the conhactor to reimburse the homeowner,
1.15 T'he contraetor must use the site and its facilities only for speeified construction. The electrical, water,
sewer and gas systems must be used only for construction purposes and during the construcdon phase only.
1.16 Any discrepancy in the contract documents raust be bmught to the attention of the Contraet Adrninistrator
immediately.
1.17 Failure of contractors to mcet TDHCA critoria can result in;
A. Conhactors not being eligble for payment, and
B. Contractor should not become party to any HOME Program fund+ed project.
1.18 The coatracting sequence for housing rehabilitation projects must be; Invitation to Bid, Bid Opening, and
Contract Award.
A. Within ten (14) days of notificaNon of the contract award, the sucassful bidder must provide the
Coatract Administrator with;
B. A list of sub-contracWrs, and
C. Certificates of insuranco from the issuing company thet must show current coverage in the atnount
stipulated in the contract documents and with a tbirty (30) day notice of cancellation of insurance
to the Contract Adrninistrator for; general liability with completed operational coveiage, velvcle
liability, and statutory workman's compensation (as required).
1.19 Within ten (10) days of receiving the issuance of the Notice to Procoed, the contractor must begin work.
1.20 The number of work days must be set out in the contract. Upon completion of the work acceptance by the
Contract Administrator and homeowner, the Certificau of Final Inspcction is issued and the Warranty
Period begins.
1.21 Thirty (30) days after the C,ertificato of Final Inspection date, the statutory amount retained is released to
the contractor, cxcepcing in cases where it is detemiined that the retsined should not be released,
1.22 It is recommended that payments are made when the projects reaches 400/o, 70%, and 100% compledon
and at 30 days after Certificate of Final Inspection is issued.
1.23 All requests for payments will be made in writing by the contractor to the Contract Administrator and will
include a tist of items, their costs, and a sum of the item costs.
1,24 The work to be paid should be besed solely on completod itcm9 from the schedule of values submitted by
the contractor prior to conshvcdoa or the Itemizetion of Bid Form if no schedule submitted.

1.25 The Contract Admmistrator wiU inspect such work as soon as possible (ususlly within one business day)
from receipt of such request.
1.26 The Contract AdministcaWr will provide a completed Contractor Request for Paymant form to the
conhactor. The contractor must sign for the work for wFvch payment is authorized and t6en request the
homeoamer to exccutc the Contractor Request for Payment form. Payments will bc made thereafter.
1.27 All materials used must be new (untess otherwise speciSed in the Project Manual) and of a good quality.
All work must be done with skilled craftsmen and aceomplished with care. Contractor must provide
samples to the homeowner for seloction for all materials as cited in the individual specificarions and
provide reasonable timc to the homeowner to make selections. Contractor must submit a letter to the
Contract Administrator, signed by the homeowner, stating that the homeowner approves of colois and
yuality of items such as, but not limited to; paint, flooring materials, brick, shingles, vinyl siding,
door/window/drawer hardware, and counter tops.
1.28 Upon completion of conswction, the contractor wiil;
A. Remove all construction debris from the site;
B. Clean and mop all resilient floors;
C. Clean all new and existing paint from other 5nished surfaces including window glass and mirrors;
D. Leave all newly installed items in operating condition;
E. Light gas water heaur pilots, stove/oven pilots and gas 6eater pilots;
F. Start all other electrical and mechanical systems;
G. Put all hardware in operating condition;
H. Deliver new keys to homeowners as hardwart is installed.
1.29 Discovery of defective elements made known to the coetractor before or dwing the conswction process
must be brought to the immcdiatc attention of the Contract Administrator in writing. When repaiis are
made, tF►e repairs must reasonably match the surrounding materials in original design and dimension as
approved by the Contract Administrator.
1.30 Where additional work is necessary to maice repaire or to correct unforeseen dangeroua conditions, the
wntractor must submit to the ContraR:t Adminiatrator a proposal consisting of what type of work ie
needed, the cost of such work, and the time nxessary for such work to bc completed. Unless it is
detecmined there exists an immodiate health and safety danger, NO WORK MUST BE A[TTHORIZED
until agreed upon in writing by the homeowner, contractor, aad Conhact Administrator.
1.31. Compensation for additional wocic will be aegotiated in the following manner,
A. The deletion of work proposed, but not started; or if that is not possible;
B. An increase to the dollar amount of the contract (if funds are available).
1.32 No other work must be doae to the project other than the work agraed upon in writing by the homeawner,
Contract Administrator and contractor or as necessary to remove immediate health and safety dangers
during the construction phase.

A. The lot or defined site must be fi+ee of debris, garbage or other accumulations of site stored items
that create possibilities of infestations. The site should be general(y Level, well drained, and
accessiblo.
2.2 Hazardous and Substandar+d Conditions
A. Hazardous and substandard conditions must include any condition that ttu+eatens the health and or
safety of the occupants. Substandard conditions include any condition that throatens, defeats or
wi111ead to the lack of functional viabiliry of a single feature of a home. These conditions must
include but not be limited to:
1. Accumulatzd debris, waste, or garbage either in enclosed areas such as storage buildings
orin yard areas;
2• Deteriorated and/or imeparable outbuildings, sheds, wells, privies, or other shuctuces
that sie no longer in use or are made unusable by their condition;
3. Hoies, ditches, cxposed meter boxes or other condidons that create a tripping hazard,
excluding drainage ditches that are part of a desigaed disinage system;
4. Rodents, insocts, or other infestations;
5. Standing water or depressions that hold water during wet weather, ltaking water
supplY, percoladng or leaicing sewage;
6. Exposed pipes, railings or other installations creating tripping hazards;
7. Damaged, missing or deteriorated wallcways, steps and decks that create trippin8
hazards or are otherwise unsafe;
8. Stairways or steps with two steps or more and without s functional rail.
3.0 Ancillary Imprnvemenb
3.1 Minimum Ancillary Irnprovemenfs Standards
A. All walkways and decks should be continuous and usable, free from tripping hazards or othor
defects.

A. Wherever possible, a habitable room in a dweqing or dwelling unit must have a ceiling height of
not less tlmn 7'-6". At teast %2 of the floor area of every habitable room locatod above the V floor,
must have a ceiling height of 7'-6". The floor area of that part of any room whero the ceiling
height is less than 7'-6" must not be considered as part of the floor area in computing the total
floor area of the room for the purpose of determining maximum floor area.
B. Wbet+e the ceiling height of a habitabie room is less than 7' and it would be cost-proWbitive to
raise said ceiling, the requiremcnt may be waived provided the Contract Administrator does so in
writing.

C. Leveting must be done in such a manner as to be permanent and must be completed before other
work begins.
D. New posts must be conerete piers or-treated wood posts, of a species that hes a neturel resistance
to decay.
E. Cedar posts and shims must be treated to prevent rot and deterioration.
F. When leveling, grades must be established from existing concrete porehes, fireplaces and
chimneys.
G. When leveling is complete, doors, windows, and openings must be reasonabiy plumb, level, and

H. Correct over spans by installing stringers and/or floor joists. Stringers are W be placed on concretc

I. All sills must have 12" minimum clearance above the gcound when leveling is to be done unless

12.1 Minimum Electrical Standards
A. Thc minimum electrical servicz for each dwelling aad/or dwelling unit must be 100 amps, or as
adjusted and approved, in writing, by the electzical inspector of the ciry in the absenee of a city
electrical inspcctor, the rohabilitation technician for the city/state, may make a detecmination that a
lower service is adequate, provided that such detemination is in writin8 vvith the basis for such
determination included. Furthermore, lesser service should be approved by the service provider.

16.0 Water Aeaters
16.1 Minirnum Water Heater Standards
A. All water heaters will have at least thirty gallons storage capacity. Will be able to eupply a
continuous flow of hot water of at least 102 degrees F, and will be prnperly installed with both gas
and or electric shut-off valvts as well as cold water supply shut-off valves.
B. Each unit should be equipped with a functioning prossure r+elease valve (TPL) which must rolease
presaure at 150 P.S.I. and/or 210 degrees F. Water released mast be exhausted to the exterior of
the building.
C. Each water heater must be enclosed (except whcre otherwise permitted by the SBCCI) in e sealed
closet designed for this purpose with combustion air drawn from outside the living area. Any gas
water heater installed in garage sreas will be lceated at least 18" above the floor in order W prevent
combustion of fuel vapors.

all work iisted above within 120 days after the Effective Date of this Contract, subject to
extensions approved by the Owner and the Contract Administrator for the period of any

Owner or Contractor). The Cantracfor agrees that time is of the essence of this Contract.
The Contractor agrees to pay a fixed unit price per consecutive calendar day for delays
beyond the Contract date fixed for reaching "Final Completion". For failure to complete the
project within the allotted time, the Contractor acknowledges, and agrees to pay liquidated
damages in the amount of $ 75.00 (Seventy-frve dollars) per day for each consecutive
calendar day (or portion thereofl that the project remains incomplete or unfinished until the

3. CONTRACT PRICE: The Contractor agrees to accomplish work as described in the
Schedufe of Wor1c in accordance with each and every term and condition of this Contract,

4. PROGRESS PAYMENTS: The Contractor agrees that the total contract price shall be paid
in one or more payments, based upon the value of the work completed at the time the
progress payment is made. Such progress payments shall be disbursed at the time and in
the amounts specified in the Payment Schedule, after inspection and approval of the work
by Owner and the Contract Administrator, less a holdback of 10 percent of the price of work
completed. The holdback shall be retained until final payment in order to protect the Owner
from any default by the Contractor. In the event the Contractor defaults, the holdback shall
be disbursed in accardance with Part II, paragraph 10 of this Contract. Final payment shall
be due upon satisfactory compleUon and acceptance of the work as in compliance with this
Contract by the Owner and the Contract Administrator, permit sign-off, submission of
satisfactory waiver(s) of liens or a bond satisfactory to the Owner and Contract
Administrator indemnifying the Duvner against any lien, and submission of ali waRanties
and guarantees. The Owner shall not withhold payment to the Contractor except for
noncompliance with the terms of this Contract, and shall not request the Contractor to
perform work outside the soope of this Contract as a condition of receiving payment. The

5. WARRANTY: The Contractor wairants that all improvements, hardware and fixtures of

PAYMENT SCHEDULE
Progress payments to the Contractor under this Contract for work completed may be requested
by the Contractor in the amounts and at the intervals specified below. All payments (except #he

The final payment shall include the holdback amounts remaining due if preceded by acceptance
of the worlc by the Contract Administrator and Owner, submission of satisfactory waiver of liens
or a bond satisfactory to the Owner and Contract Administrator indemnifying the Owner against
any lien, and submission of all warranties and guarantees.

PART II. Standard Terms
1. INSURANCE: During the continuance of the work under the Contract, the Contractor and all
subcontractors shail:
a. Maintain worker s compensation and employer's liability insurance in amounts
sufficient to protect themselves and the Owner from any Iiability or damage for
injury (including death) to any of their employees, including any liability or
damage which may arise by virtus of any statute or law in foroe or which may

3. CHANGE ORDERS: The Contractor agrees not to make any changes in the Sc,hedule of
Work or the Specifications without written authorization by the Owner and written
concuRence by the Contract Administrator.
4. PERMITS AND CODES: The Contractor agrees to secure and pay for all necessary permits
and licenses required for the Contractor's performance of this Conbract in compliance with
applicable local requirements; including local building and housing codes, where applicable,
whether or not specffied in the Schedule of Work or Specifications.
5. HOLD HARMLESS: The Contractor agrees to defend, indemnify, and hold the Owner and
the City of and its e{ecctted officlals, offlcers and employses harmless from any
roperty damage, sickness,
liability or claim for damages because of bodily injury, death, p
disease or loss and expense arising from the Contractor's performance of this Contract.

7. FEDERAL LABOR STANDARDS: If this Contract (1) concems the rehabilitation of
residential properties containing twelve (12) or more units or (2) calls for e price of $2,000

or more for the rehabilitation, in whole or in part, of nonresidential praperty or the
nonresidential portion of mixed-use property, the Contractor agrees to abide by Federal
Labor Standards regulations.
8. CONDITION qF PREMISES: The Contractor agrees to keep the premises broom clean and
orderly and to remove all debris as needed during the course af the worC, in order to
maintain work conditions which do not cause health or safety hazards.
9. LEAD-BASED PAINT: The Contractor agrees to use na lead-based paint in the Contractor's
performance of work under this Contract. "Lead-based paint" means any paint containing
more than six one-hundredths ar one (1) per csnt fead by weight (caiculated as lead metal)
in the total nonvolatile content of the paint or the equivalent measure of lead in the dried
film of paint aiready applied.
10. TERMENATION: The Contractor agrees that the Owner shall have the right to declare the
Contractor in default if the Contractor fails to fumish materials or pertorm work in
accordance with the provisions of this Contract. In such event the Owner shall be
responsible for providing written notice to the Contractor by registered mail of such defauit.
if the Contractor fails to remedy such defauit within fifteen (15) days of such notice, the
Owner shail have the right to select one or more substitute oontractors acceptable to the
Contract Administrator. If the expense of finishing the worlc exceeds the balance not yet
paid to the Contractor on this Contract, The Contractor shall pay the difference to the
Owner. The Owner may use any holdback amount to compensate substitute contractors
selected pursuant to this paragraph, and the Contractor shall have no further right to our
interest in the holdback amount.
11. DISPUTE RESOLUTION: All claims or disputes between Ovmer and Contractor, or
between Owner and Contract Administrator ar between Contractor and Contract
Administration arising out of or related to the construction and/or rehabilitation work
perfomned on the HOME assisted property shall be decided by arbitration in accordance
with the consbruction industry arbitratian rules of the American Arbitration Associatian. The
homeowner, contractor andlor Contractor Administrator shaN submit all disputes or claims,
regardless of the extent of the worC's progress, to an arbitrator who is mutually agreed upon
by all parties. Notice of the demand for arbitration shall be filed in writing with the other
party to this agreement, and shall be made within a reasonable amount of time after the
dispute has arisen. The award rendered by the arbitrator shall be final, and judgment may
be entered upon it in acoordance with applicable law in any court having jurisdiction tfiereof.
12. INSPECTION: The U.S. Govemment, the Texas Department of Housing and Communiry
Affaits, the Contract Administrator, and their designees shall have the right to inspect al1
work perFormed under this Contract. The Contractor and Owner will take all steps
necessary to assure that the U.S. Govemment, the state, and the Contract Administrator, or
their designees, are permitted to examine and inspect the Property, and atl contracts,
materials, equipment, payralls, and conditions of employment pertaining to their work,
including all relevant data and records. By such inspection, the U.S. Govemment, the State
af Texas, and the Confract Administrator assume no responsibility to the Owner for
defective material or work under this contract or to either party for any breach of this
Contract by the other.
13. FINANCIAL INTEREST OR BENEFIT: AI1 Contract Administrators are required to comply
with 24 CFR 92.356. The parties to this Contract agree that none of the following shall have

any financial interest or benefit, direct or indirect, in this Contrdct.
a. Any officer or employee of the Contract Administrator who exercises any functian
or responsibility in connection with administration of a HOME Program contract;
b. Any member of the goveming body of the Contract Administrator;
c. Any member of the goveming body of the locafity (as defined by 24 CFR 510.4
(m):
d. Any member of or delegate to the Congress of the United States;
e, Any person employed by HUD at a grade level of GS-9 or above.
14. EQUAL OPPORTUNITY: The Contractor agrees to abide by all federal, state or local
regulations retative to equal opportunity for all persons, without discrimination as to race,
color, religion, national origin, sex, familial status, or disability. On agreements of $10,000
or more, the Contractor agrees to abide by the following provisions of Executive Order
11248, and agrees to incorporate such language in all contracts for $10,000 or more which
he/she may enter into in connection with this agreement.
During the performance of this Contcact, the Contractor agrees as follows:
a. The Contractor wili not discriminate against any employee or applicant for
employment because of race, color, religion, sex, national origin, disability or
familial status. The Contractor will take affirmative acNon to ensure that
applicants are employed, and that employees are treated during employment
without regard to their race, color, religion, sex, national origin, disability or
familial status. Such action shall include, but not be limited to the following:
employment, upgrading, demotion, or transfer recruitment or recruitment
advertising; layoff or terminatfon; rates of pay or ather forms of compensation;
and selection for training, including apprenticeship. The Contractor agrees to
post in conspicuous places, available to employees and applicants for
employment, notices provided by the municipality setting forth the provisions of
this nondiscrimination clause,
b, The Contractor will, in all solicitations or advertisements for employees placed by
or on behalf of the Contractor, state that all qualified applicants will receive
consideration for employment without regard to their race, color, religion, sex,
national origin, disability or familial status.
C. The Contractor will send to each labor union or representative of workers with
which he/she has a collective bargaining agreement or other contract or
understanding, a no#ice advisfng the said labor union or worker's representative
of the Contractor commitments under this section and shall post copies of the
notice in conspicuous places available to employees and applicants for
employment.

d. The Contractor wiN compfy with all provisions of Executive Order 11246 of
September 24, 1965, and of the rules, regulations, and relevant orders of the
Secretary of Labor.
e. The Contractor will fumish afl information and reports required by Executive
Order11246 of September 24, 1965, and by the nules, regulations, or orders of
the Secretary of Labor or the Secretary of Housing and Urban Development, or
pursuant thereto, and will permit access to hismer designees, and the Secretary
of Labor for purposes or investigation to ascertain compliance with such rules,
regulations, and orders.
f. In the event of the Contractor's nancomplfance with the nondiscrimination
clauses of this contract or with any of the said rules, regulations, or orders, this
contract may be cancelled, terminated, or suspended in whob or in part and the
Contractor may be declared ineligible for further govemment contracts or
federally assisted construction contracts in accordance with procedures
authorized in Executive Order 11246 of September 24, 1965, and such other
sanction may be imposed and remedies invoked as provided in Executive Order
11246 of September 26, 1965, or by rule, regulation, or order of the Secretary of
Labor, or as otherwise provided by law.
g. The Contractor will include a statement prohibiting discrimination against all
persons with regard to race, color, rellgion, national origin, sex, disability or
familial status and will incfude the provisions of paragraph 13 (a) through 13 (g)
of this Contract in every subcontract or purchase order unless exempted by
rules, regulations or orders of the Secxetary of Labor issued pursuant to Section
204 of Executive Order 11246 of September 24, 1965, so that such provisions
will be binding upon each subcontractor or vendor. The Contractor will take such
action with respect to any subcontract or purchase order es the property owner
or the Secretary of Housing and Urban Development may direct as a means of
enforcing such provisions, including sanctions for noncompliance, pravided,
however, that in the event the Contractor becomes involved in, or threatened
with, iitigation with a subcontractor or vendor as a result of such direction by the
property owner or the Secretary of Housing and Urban Development, the
Cantractor may request the United States to enter into such litigation to protect
the interest of the Secretary of Housing and Urban Development of the United
States.
15. TRAINING, EMPLOYMENT AND BUSINESS OPPORTUNITIES: The Contractor agrees to
abide by the following provisions and to include them in any subcontract into which the
Contractor enters perfoRnance of this Contract.
a. The work to be perfonned under this contract is on a project assigned under a
program providing direct federal financial assistance from the Department of
Housing and Urban Develapment and is subject to the requirements of Section 3
of the Housing and Urban Development Act of 1968, as amended, 12 U.S. C.
1701 u. Section 3 requires that to the greatest extent feasible opportunities for
training and employment be given to lower income persons residing within the
localiry or the training and employment be given to lower income persons
residing within the locality or the metropolitan area (or non-metropolitan county)
in which the project is located, as determined by the Secretary of Housing and

Urban Development, and contracts work in connection with the project be
awarded to business concerns which are located in, owned in substantial part by
persons residing in the same metropolitan area (or non-metropolitan county) as
the project.
b. The parties to this contract wiil comply with the provisions of said Section 3 and
regulations issued pursuant to thereto by the Secretary of Housing and Urban
Development set forth in 24 CFR Part 135, and ail applicable rules and orders of
the Department issued thereof prior to the execution of this contract. The parties
to this contract certify and agree that they are under no oontractual or other
disability, which would prevent them irom complying with these requirements.
c. The Contractor will send to each labor organization or representative of workers
with which they have a collective bargaining agreement or other contract or
understanding, if any, a note advising the said labor organiiation or workers'
representative of his commitments under the Section 3 clause and shall post
copies of the notioe in conspicuous places available for employees and
applicants for employment or training.
d. The Contractor will include this Section 3 clause in every subcontract for work
connected with the project and will, at the direction of the applicant for, or
recipient of, federal finsncial assistance, take appropriate action pursuant to the
subcontraat update finding that the subcontractor is in violation of regulations
issued by the Secretary of Housing and Urban Development, 24 CFR Part 135.
The Contractor will not suboontract with any suboontractor where it has notice or
knowledge that the latter has been found in violation of regulations under 24 CFR
Part 135 and will not let any subcontract unless the subcontractor has first
provided it with a preliminary statement of ability to comply with the requirements
of these regulations.
e. Compliance with the provisions of Section 3, the regulations set forth in 24 CFR
Part 135, and all applicable rules and orders of the Department issued
thereunder prior to tha exewtion of the contract shall be a condition of the
federal financial assistance provided to the project, binding upon the applicant or
recipient for such assistance, its successors, and contractors and subcontractors,
its successors, and assigns tv those sanctions specifled by the grant or loan
agreement or contract through which federal assistance is provided, and to such
sanctions as are specified by 24 CFR Part 135.
