08-B Water Deposit Ord DRAFT ORDINANCE NO. f:attomey\ordwork\current\ Amend 34-28(aXl) - Deposits for Water Customers Ord October 17, 2005 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, AMENDING SECTION 34-28(a)(1) OF THE CODE OF ORDINANCES OF THE CITY OF PARIS, DEALING WITH DEPOSITS TO ENSURE PAYMENT FOR RESIDENTIAL WATER, SEWER, AND GARBAGE SERVICE, TO ALLOW CUSTOMERS TO TRANSFER THEIR DEPOSIT WITHOUT INCREASE FOR CUSTOMERS WHO HAVE MAINTAINED THEIR ACCOUNTS WITHOUT DELINQUENCY FOR THE PERIOD OF TIME THE CITY MAINTAINS BILLING RECORDS ON SUCH DELINQUENCIES, NOT TO EXCEED TEN YEARS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council has previously authorized the increase of deposits for residential customers of City water, sewer, and/or garbage service to cover the cost of account delinquencies; and, WHEREAS, the City Council desires to allow those customers with good payment history who have not appeared on the City's water cut-off list for the period of time the City maintains such cut-off records, not to exceed ten years, to transfer their accounts from one location to another location without increase of the amount of the deposit; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That Section 34-28(a)(1) of the Code of Ordinances of the City of Paris, addressing deposits by residential consumers and customers of City water, sewer, and/or garbage service, shall be and is hereby amended to read as follows: "Sec. 34-28. Deposit to assure payment. (a) Each purchaser, consumer, or customer of City water, City sewer, or City residential garbage collection service, as such services are provided by the City under its Code of Ordinances, shall, at the time of making application for such water, sewer, or garbage service, make a deposit, with the City, in the following amount: 1. Residential consumers and customers of City water, sewer, and/or garbage service (including transferred accounts), $150; provided, 1 I however, those residential consumers and customers who transfer their account to another location within the City who have not appeared on the City cut-off list for delinquency during the period of time that the City maintains billing records for such delinquency, not to exceed the last ten (10) years, shall be entitled to transfer their account to another location within the City without increasing their deposit. * * *" Section 3.
