89-029 ORD CLOSING WALNUT STREET FROM WEST ROW LINE OF 28TH ST NE WEST TO EAST ROW LINE OF COLLEGIATE DRIVE ORDINANCE N0. $9-029 AN ORDINANCE CLOSING WALNUT STREET, FROM THE WEST-RIGHT-OF- WAY LINE OF 28th STREET N.E., WEST TO THE EAST RIGHT-OF-WAY LINE OF COLLEGIATE DRIVE; DECLARING NO NECESSITY OR NEED OF SAID STREET FOR CITY USE OTHER THAN FOR A UTILITY EASEMENT, WHICH IS EXPRESSLY RETAINED BY THE CITY OF PARIS; AND PROVIDING FOR AN EFFECTIVE DATE OF AUGUST 1, 1989. WHEREAS, it has been brought to the attention of the City Council of the City of Paris, that Walnut Street, beginning approximately at 28th Street N.E., West to the right-of-way of Collegiate Drive is of no use as a street to the City of Paris or to its citizens, but is of use and necessary to the City of Paris and its citizens for utility easement purposes, and the City Council so finds; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section l. That Walnut street, beginning approximately at 28th Street N.E., West to the right-of-way of Collegiate Drive, described in Exhibit A attached hereto, is hereby closed, with the City of Paris retaining a utility easement. BEGINNING at the Northeast corner of Lot 1, Block 7, Springlake Addition, same being in the West Boundary Line of 28th Street N.E. THENCE, S 89° 40' W, 120.4 feet to a point in the East Boundary Line of North Collegiate Drive, same being the Northwest corner of Lot 1, Block 7 of Springlake Addition. THENCE, N 0° 16' W, 40 feet to a point, the southwest corner of Lot 1, City Block 257D; THENCE, N 89° 40' E, 120.7 feet to a point in the West Boundary Line of 28th Street N.E., same being the Southeast corner of Lot 1, City Block 257D; THENCE, S 0° 16' E, 40 feet to the place of beginning.
