89-039 ORD PROVIDING CODE OF ORDINANCES BE AMENDED BY REVISING SECTION 29-31 29-32 AND 29-33 OF SAID CODE
ORDINANCE N0. 89-039
AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS,
PROVIDING THAT THE CODE OF ORDINANCES, CITY OF PARIS, BE
AMENDED BY REVISING SECTION 29-31, 29-32, and 29-33 OF SAID
CODE; PROVIDING THAT A PERMIT BE REQUIRED TO BUILD,
CONSTRUCT, LAY, ALTER, REMOVE, DEMOLISH, REPAIlZ OR REBUILD
ANY SECTION OR PORTION OF STREET OR BRIDGE, 'TO CONSTRUCT
ANYTHING OTHER THAN THAT HEREIN SPECIFICALLY PERMITTED, OR
GRADE IN THE RIGHT OF WAY EXEMPTING PUBLIC UTILITIES FROM
5UME FEE AND BOND REQUIREMENTS; PROVIUING FOR A PENALTY NOT
TO EXCEED $500.00; REPEALINU ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN
EFFECTIVE DATE OF NOVEMBER l, 1989.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PARIS:
Section l. That Section 29-31 of the Code of
Ordinances of the City of Paris, Paris, Texas, be amended so
that such shall read as follows:
"Sec. 29-31. Permit - Required.
It shall be unlawful for any person to build,
construct, lay, alter, remove, demolish, repair or
rebuild any section or portion of street or bridge,
to construct anything other than that herein
specifically permitted, or grade in the
right-of-way within the corporate city limits of
the City, without first obtaining a permit from the
city engineer."
Section 2. That Section 29-32 of the Code of
Ordinances of the City of Paris, Paris, Texas, be amended so
that such shall read as follows:
"Sec. 29-32. Same - Applicant's Bonct.
No permit required by section 29-31 shall be
issued, until the applicant files, in the office of
the city engineer, a bond in the sum of five
thousand dollars ($5,000.00), payable to the City,
is issued by a surety company approved by the city
attorney and licensed to operate in the state,
which bond shall be conditioned that the party so
bonded will fulfill all the requirements of this
article. Public utility companies are exempt from
the above bond requirement."
Section 3. That Section 29-33 of the Code of
Urdinances of the City of Paris, Paris, Texas, be amended so
that such shall read as follows:
"Sec. 29-33. Same - Fee.
The fee for a permit required by section 29-33
shall be twenty-five dollars ($25.00). If work is
begun without obtaining such permit, an additional
fee of ten dollars ($10.00) per day shall be
charged for each day's delay in obtaining the
permit. The payment of such fee shall not relieve
any person from prosecution for violating section
29-31. Public utility companies are exempt from
the payment of the above permit fee, however, they
are subject to the t:en dollar ($10.00) per day
delay fee."
Section 4. Any person violating any of the
provisions of this ordinance shall be guilty of a
Misdemeanor, and upon conviction shall be fined in any sum
not to exceed $500.00, and each and every day's continuance
of any violation of the above enumerated section shall
constitute and be deemed a separate offense.
Section 5. All ordinances or parts of ordinances in
conflict herewith are hereby expressly repealed.
Section 6. This ordinance shall become effective on
November l, 1989.
