88-015 ORD CONTAINING HEARING ON PROPERTIES LOCATED IN COP BELONGING TO VARIOUS OWNERS ORDINANCE N0. 33r015 AN ORDINANCE CONTAINING A HEARING ON PROPERTIES LOCATED IN THE CITY OF PARIS, PARIS, TEXAS, BELONGING TO VARIOUS OWNERS, AND AN ORDINANCE OF THE CITY COUNCIL FINDING THE MATERIALS REMAINING ON THE PREMISES TO CONSTITUTE ANUISANCE AND TO BE A FIRE HAZARD TO LIFF AND PROPERTY AND A HAZARD TO THE LIFE AND WELFARE OF THE I:]HABITANTS OF THE AREA, AND ORDERING SAID RUBBISH, LtTMBER AND REFUSE FROM THE STRUCTURES TO BE TORN DOWN AND REMOVED FROM THE PREMISES IN ORDER TO ABATE SUCH NUISANCE. WHEREAS, a public hearing wds called to order by the Mayor of the City of Paris, Billy Joe Burnett, on the llth day of Apri1, 1988, at 7:00 o'clock P.M., in the Council Room, City Hall, in the City of Paris, Texas; and, WHEREAS, the City Council finds that the Building Hazard Inspection Committee fixed a date for hearing on the resolutions referred to the Committee by the City Council on the 16th day of February, 1988, and said Committee fixed said hearing at 10:00 o`clock A.M. on the 18th day of March, 1988, and the hearing was had thereon. That proper notice was given to the owner or owners of the structures located at the following addresses: 449 W. Provine, Lot 1, Block 89, 1423 S. Main Street, Lot 10, Block 5, Texas & Pacific Addition. 762 Wood, Pt. Lot 4, Block 2, Pickard Addition. 536 3rd N.E,, Lot 15A, Block 60A. 424 2nd N.E., Lot 5, Block 59, 1027 8th N.W., Lot 10, Block l, E. S. Connors Addition. 779 Ash, Pt. of Lot 2, Block 2, Pickard Addition. 789 Ash, Pt. of Lot 1, Block 2, Pickard Additiori. 445 4th N.W., Lot 3, Block 540 1221 Martin Luther King Jr. Drive, Lot 7, Block 268, 102$ Shiloh, Lot 5, Block 86, That at said hearing the Committee listed the structures involved and introduced pictures of the various portions of the structures and various portions of the premises involved and a list of discrepancies in the structures located thereon. That the Committee found that each of the above structures was in such state of deterioration and dilapidation as to create a serious fire hazard to life and property and that each of said buildings was dilapidated and was dangerous to life and property and dangerous structures to life and property. That said buildings are in such a state of dilapidation and decay that none of said structures are capable of repair. It is further found that the condi- tion of_ the premises and structures involved was such that the Committee recommended to the City Council that they be declared a nuisance and that the owners thereof be ordered by the City Council to tear down and remove the same from the lots involved. That said Committee filed a complete report of its hearing and its findings with the City Clerk of the City of Paris on the 25th day of March, 1988; and, WHEREAS, the City Council further finds that proper notice was given to the owner or owners of the structures hereinafter listed. That at said hearing on the 18th day of March, 1988, the Committee listed the structures involved and introduced pictures of the various portions of the structures and various portions of the premises involved and a list of discrepancies in the structures located thereon. That the Committee found that each of the hereinafter listed structures was in such state of deterioration and dilapidation as to create a serious fire hazard to life and property, and that each of said buildings was dilapidated and dangerous to life and property and dangerous structures to life and property. That the owners of the property appeared before the Committee and requested time to repair the structures or the Committee found that the structures could be repaired. That it was the recommendation of the Committee that the structures be condemned or repaired and that the respective owners thereof be given the time to abate said nuisance by repair or removal as is set out in connection with each of such addresses, as follows: 1058 Tudor, Lot 6, Block 69A 90 days 203 25th N.W., Lot l, Block 2, SpPrry's Third Addition 180 days 202 Brame, Lot 14, Block 137 180 days 504 15th S.E., Lot l, Block 112C 30 days 1611 W. Henderson, Lot 5, Block 234 To be torn down when owner secures other housing and it is so stated in the report of the Building Hazard Inspection Committee filed with the City Clerk of the City of Paris on the 4th day of April, 1988; and, WHEREAS, the City Council has fully heard and con- sidered the testimony presented upon the hearing and a complete transcript of the testimony reported by the Building Hazard Inspection Committee; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section 1. That the structures located at the following addresses: 449 W. Provine, Lot 6, Block 69A. 960 15th N.W., Lot 6, Block 232. 1423 S. Main Street, Lot 10, Block 5, Texas & Pacific Addition. 762 Wood, Pt. Lot 4, Block 2, Pickard Addition. 536 3rd N.E., Lot 15A, Block 60A• 424 2nd N.E., Lot S, Block 59. 1027 8th N.W., Lot IU, Block 1, E. S. Connors Addition. 779 Ash, Pt. of Lot 2, Block 2, Pickard Addition. 789 Ash, Pt. of Lot I, Block 2, Pickard Addition. 445 4th N.W., Lot 3, Block 54• 1221 Martin Luther King Jr. Drive, Lot 7, Block 268. 1028 Shiloh, Lot 5, Block 86, are a nuisance, and they are hereby declared a nuisance, in that they are dangerous to life and property, and that the same constitute a fire hazard to life and property, and that the respective owners are hereby ordered to abate such nuisance within thirty (30) days from the date hereof. The City Clerk is directed to furnish the owners a copy of this ordinance, in the event the addresses of said owners are known, and in the event the respective owners refuse to comply with this ordinance, the City Attorney, T. K. Haynes, is hereby directed to proceed to enforce this ordinance by the procedure provided for in Article III of Chapter 7 of the Code of Ordinances of the City of Paris. Section 2. That the structures hereinafter enumerated are a nuisance, and they are hereby declared a nuisance, in that they are dangerous to life and property, and that the same constitute a fire hazard to life and property, and that the respective owners are hereby ordered to abate such nuisances on or before the dates set out in connection with the addresses of each of such structures, as follows: 1058 Tudor, Lot 6, Block 69A August 20, 1988 203 25th N.W., Lot 1, Block 2, Sperry's Third Addition November 20, 1988 202 Brame, Lot 14, Block 137 November 20, 1988 504 15th S.E., Lot 1, Block 112C June 20, 1988 1611 W. Henderson When owner secures other housing The City Clerk is directed to furnish the owners a copy of this ordinance, in the event the addresses of said owners are known, and in the event the respective owners refuse to comply with this ordinance, the City Attorney, T. K. Haynes, is hereby directed to proceed to enforce this ordinance by the procedure provided for in Article III of Chapter 7 of the Code of Ordinances of the City of Paris.
