88-019 ORD PROVIDING CODE OF ORDINANCES BE AMENDED BY REVISING SECTION 31-18 OF SAID CODE TO ESTABLISH WATER RATES FOR RESIDENTIAL, COMMERCIAL AND INDUSTRIAL CLASS CUSTOMERS ORDINANCE N0. 88-019 AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF PARIS, BE AMENDED BY REVISING SECTION 31-18 OF SAID CODE TO ESTABLISH WATER RATES FOR RESIDENTIAL, COMMER- CIAL AND INDUSTRIAL CLASS CUSTOMERS WHICH IS BASED UPON THE COST TO SERVE EACH CLASS; BY REVISING SECTION 31-19 ESTABLISHING A SEWER SERVICE RATE FOR CITY WATER CUSTOMERS AND FSTBLISHING TIiE COST TO USERS DISCHARGING OVERSTRENGTH SEWER; BY REVISING SECTION 31-20 TO ESTABLISH THE SEWF,R CHARGE TO CUSTOMERS WHO ARE NOT CITY WATER CUSTONI- ERS; PROVIDING FOR A PENALTY NOT TO EXCEED $2,000.00; REPEALING ALL ORDINANCES UR PARTS OF CRDINANCES IN CONFLICT IiEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF JliNE l, 1988. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section l. That Section 31-18 of the Code of Ordinances of the City of Paris, Paris, Texas, be amended so that such shall read as follows: "Sec. 31-18. Water Rates. (a) Charges for water furnished by the city under contract shall be as stated in the contract. (b) Charges f_or water furnished by the city are established as follows based upon meter size, base cost which includes the cost for the first increment of water, and a cost per 100 c.f. used above the first increment; SERVICE IN METER SIZE BASE COSTS EXCESS OF BASE 5/8" - 3/4" $5.65 for first 200 c.f. $1.25 for each additional 100 c.f. 1" - 2" $15.25 for first 1,000 c.f. $1.21 for each additional 100 c.f. Larger than 2" $39.45 for first 3,000 c.f. $1.21 for each additional 100 c.f." Section 2. That Section 31-19 of the Code of Ordinances of the City of Pari.s, Paris, Texas be amended so that such shall read as follows: "Sec. 31.19. Sewer Rates - For Customers using city water. (a) Charges for sewer service furnished by the city to residential, commercial and industrial customers shall be based upon water meter size, a base cost for the first increment of usage and a cost for each additional 100 c.f. above the first increment; as follows: SERVICE IN METER SIZE BASE COST EXCESS OF BASE 5/8" - 3/4" $4.77 for the lst 200 c.f. $1.77 for each additional 100 c.f. 1" - 2" $18.93 for the lst 1,000 c.f. $1.77 for each additional 100 c.f. Larger than 2" $36.63 for the lst 2,000 c.f. $1.77 for each additional 100 c.f." (b) Monthl.y residential customer wastewater volume shall be based upon meter water consumption by the customer up to the maximum amount represented by the three-month average of November, January and February of the previous fiscal year. In the event no historial water consumption data are available, customers will be billed at 70% of the current month water consumption until such time as historical data of water use are available. (c) Users desiring to discharge sewage into the city's sewerage system, the strength of which sewage exceeds two hundred fifty (250) parts per million BOD; two hundred fifty (250) parts per million of suspended solids, or thirty (30) parts per million of ammonia, and which is acceptable under Article III ef this chapter, may do so upon written permission of the city and by paying a monthly treatment charge in the amount of twenty-six cents ($.26) per pound of BOD in excess of the allowable BOD; seventeen cents ($.17) for each pound of total suspended solids in excess of the allowable suspended solids; and sixteen cents ($.16) per pound of ammonia (NH3) in excess of the allowable ammonia strength. The city shall make the necessary tests of the user's sewage strength to determine this charge. The charge prescribed by this subsection shall be in addition to the charges prescribed in subsection (a) hereof. The above described excessive strength surcharge rates may be recalculated immedi- ately after the adoption of the annual budget, using the amount budgeted as cost and actual operational characteristics for the most recently completed twelve (12) month period for plant loading. Such rates shall become eff_ective when adopted by the city council or on June 1, whichever occurs first." Section 3. That Section 31-20 of the Code of Ordinances of the City of Paris, Paris, Texas, be amended so that such shall read as follows: "Sec. 31-20. Sewer Rates For customers not using city water. (a) WastPwater service to customers who do not receive water service f.rom the City shall be billed monthly based upon 70% of consumption based upon information obtained from water supplier plus a service charge not to exceed $5.00 for collecting the water consumption information from the water supplier. (b) Commercial and industrial customers without sewer meters will be charged on the basis of 70% of the actual metered water consumption. Section 4. Any person violating any of the provisions of this ordinance shall be guilty of a Misdemeanor, and upon conviction shall be fined in any sum not to exceed $2,000.00, and each and every day's continuance of any violation of the above enumerated section shall constitute and be deemed a separate offense. Section 5. All ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. Section 6. This ordinance shall become effective on June 1, 1988.
