87-018 ORD PROVIDING CODE OF ORDINANCES BE AMENDED BY ADDING PARAGRAPH (12) TO SECTION 6-21 CHAPTER 6 OF SAID CODE ORDINANCE N0. $7'018 AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF PARIS, BE AMENDED BY ADDING PARAGRAPH (12) TO SECTION 6-21, CHAPTER 6 OF SAID CODE; PROVIDING FOR INSURANCE REQUIREMENTS FQR FUEL AND OIL SALES PF.F,MITTEES; PROVIDING FOR A PENALTY NOT TO EXCEED $200.00, F..XCEPT THAT A PENALTY NOT TO EXCEED $1,000.00 IS IMPOSED FOR FIRE SAFETY OR ZONING VIOLATIONS; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF APRIL l, 1987. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section 1. That Section 6-21, Chapter 6 of the Code of Ordinances of the City of Paris, Paris, Texas, be amended b, adding paragraph (12) so that such shall read as follows: "Sec. 6-21. Fuel and oil sales. (12) The operator must provide insurance as ~ollows: (a) Public liability insurance. Permittee shall maintain in force public liability insurance for personal injury or death and property damage in the minimum sum of one million dollars ($1,000,000.00) arising out of any one accident or other cause, with the City of Paris shown to be an additional insured thereon. (b) Third party excess liability insurance. Permittee shall require of the petroleum product supplier a policy of third party excess liability insurance in the minimum amount of five million dollars ($5,000,000.00), with the City of Paris shown to be an additional insured thereon." Section 2. Any person violating any of the pro- visions of this ordinance shall be guilty of a Class "C" Misdemeanor, and upon conviction shall be fined in any sum not to exceed $200.00, except that a penalty not to exceed $1,000.00 is imposed for fire safety and zoning violations, and each and every day's continuance of any violation of the above enumerated section shall constitute and be deemed a separate offerise. Section 3. All ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. Section 4. This ordinance shall become effective on Apri1 l, 1987.
