AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS,
PROVIDING THAT THE CODE GF ORDINANCES, CITY OF PARIS, BE
AMENDED BY ADDING ARTICLE III TO CHAPTER 15 OF SAID CODE;
PROVIDING FOR A UNIFORM POLICY GOVERNING SM0KING IN THE WURK
ENVIRONMENT AND COMMON WORK AREAS OF CITY OF PARIS
EMPLOYEES; PROVIDING FOR A FENALTY NOT TO EXCEED $200.00;
REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF MAY l,
1987.
WHEREAS, recent research has revealed serious health
hazards from inhaling secondhand or "passive" smoke; and,
WHEREAS, the City of_ Paris has the responsibility for
providing all employees with a healthy and productive
working environment; and,
WHEREAS, in order to protect the health and welfare of
those employees, as well as to protect the rights of smokers
and nonsmokers, it is riecessary to restrict smoking in work
environment and common areas except in areas designated as
smoking areas; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PARIS:
Section l. That the Code of Ordinances of the City
of Paris, Paris, Texas, be amended by adding Article III to
Chapter 15 so that such shall read as follows:
"ARTICLE III. SMOKING POLICY
Sec. 15-31. Smoking Policy.
The following is hereby adopted as the
uniform policy on smoking in the work environment,
and common work areas for the benefit of all City
of Paris employees:
A. Guiding Principle: The goal of the smoking
policy is to provide a smoke-free working
environment for City of Paris employees and
citizens who visit municipal facilities.
B. Policy: Smoking is prohibited in all City of
Paris enclosed work and common work areas
except in designated smoking areas.
Sec. 15-32. Smoking Areas.
The city will establish one or more sepa-
rately ventilated, indoor smoking rooms or outdoor
shelters at facilities which have no existing area
where smokers may go to smoke without exposure to
significant health or safety hazards, or within
the available break or lunch time. Such areas
shall contain ashtrays, containers, or other
facilities for extinguishment of smoking mate-
rials, be set apart or separated from nan-smoking
areas, and include adequate, separate ventilation
which minimizes the effect of smoke in adjacent
non-smoking areas.
Sec. 15-33. Applicability.
The city smoking policy applies to all
enclosed work and common areas occupied by city
employees, whether owned, rented or leased by the
city; to all employees, contractors or visitors,
and during all hours and days of the years. The
policy applies equally to all private offices out
of fairness to other employees who must leave
their work sites to smoke, and because most
private offices are connected to common ventila-
tion systems.
Sec. 15-34. Notification.
a. No Smoking signs shall be posted in all
areas where smoking is prohibited.
b. The Personnel Director is authorized to
announce the terms of the smoking policy
to all employees working for the city
immediately after adoption of this
ordinance.
c. All city job announcemetits will include
notification of the smoking policy which
sha.ll be a term and condition of employ-
ment with the City of Paris.
Sec. 15-35. Penalty.
Any person violating any of the provisions of
this ordinance shall be guilty of a Class "C"
Misdemeanor, and upon conviction shall be fined in
any sum nat to exceed $200.00.
Sec. 15-36. Exceptions.
It is a defense to prosecution under this
section that the areas in which the offense takes
place does not have prominently displayed a
reasonably sized notice that smoking is prohibited
by Article III of Chapter 15 of the Code of
Ordinances of the City of Paris and that an
offense is punishable by a fine not to exceed
$200."
Section 2. Any person violating any of the pro-
visions of this ordinance shall be guilty of a Class "C"
Misdemeanor, and upon conviction shall be fined in any sum
not to exceed $200.00.
Section 3. A1l ordinances or parts of ordinances in
conflict herewith are hereby expressly repealed.
Section 4. This ordinance shall become effective on.
May 1, 1987.
