87-040 ORD SETTING DATE, TIME AND PLACE FOR PUBLIC HEARINGS BEFORE P&Z COMMISSION OF COP AND CITY COUNCIL ORDINANCE N0. 87-040 AN ORDINANCE SETTING A DATE, TIME AND PLACE FOR PUBLIC HEARINGS BEFORE THE PLANNING AND ZONING COMMISSION OF THE CITY OF PARIS AND THE CITY COUNCIL OF THE CITY OF PARIS ON THE PROPQSED ANNEXATION OF CERTAIN PROPERTY BY THE CITY OF PARIS, PARIS, TEXAS, AND APPROPRIATE ZONING UPON ANNEXATION, AND AUTHORIZING AND DIRECTING THE MAYOR TO PUBLISH NOTICE OF SUCH YUBLIC HEARINGS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section l. That public hearings be held by and before the Planning and Zoning commission af the City of Paris, Paris, Texas, on the 8th day of September, 1987, at 7:00 o'clock p.m. in the Council Room, City Hall, Paris, Texas; by and before the City Council of the City of Paris, Paris, Texas, in Regular Session convened on the lOth day of September, 1987, at 5:15 o'clock p.m., in the Council Room, City Hall, Paris, Texas; and by and before the City Council of the City of Paris, Paris, Texas, in Regular Session convened on the 14th day of September, 1987, at 7:00 o'clock p.m., in the Council Room, City Hall, Paris, Texas, giving all interested persons the right to appear and be heard on the proposed annexatiori and appropriate zoning upon annexation of the following described property: TRACT l: Situated in the Enoch Crow Survey, Lamar County, Texas and more particularly described as follows: BEGINNING at a point in the East boundary lirie of a tract of land conveyed to W. Elmer and Fleta Skidmore by deed recorded in Vol. 396, Page 418, Deed Records, Lamar County, Texas, said point being 500 feet North of and perpendicular to the North boundary line of U. S. Highway No. 82 and being in the present city limits line of the City oi Paris; THENCE North with the said East boundary line of said Skidmore tract, 300 feet more or less to the Northeast corner of said tract; THENCE West with the North boundary line of said Skidmore tract and continuing West with the North boundary line of a tract of land owned by Uonald R. Lewis, et al, 510 feet more or less to the East boundary line of a 16.5 acre tract of land conveyed W. T. Ford by deed recorded in Vol 274, Page 499, Deed Records of Lamar County, Texas; THENCE South with the East boundary line of said Ford tract, 305 feet more or less to the Northeast corner of a tract of land conveyed to Zed Smith, III and Michael B. Smith by deed recorded in Vol 611, Page 12 and Vol. 626, Page 901, Deed P.ecords, Lamar County, Texas; THENCE West with the North boundary line of said Smith tract and continuing West along the North boundary lines of properties owned by Hilliard and Sons, Inc., John Yerby and a tract owned by Hoyt and Charline Langley and Gerald and Nadine Farmer, 855 feet more or less to the Northwest corner of said Langley-Farmer tract, said point being in the East boundary line of 46th N.E. and being 764 feet North of and perpendicular to the North boundary line of U.S. Highway No 82; THENCE Westerly with a line that is 764 feet North of and parallel with the North boundary line of U.S. Highway No. 82, 1290 feet more or less to the center of a creek which runs North and South, said point being in the present city limits line; THENCE Southerly with said center line of creek and the present city limit line, 310 feet more or less to its intersection with a line that is 500 feet North of and parallel with the North boundary line of U.S. Highway No. 52; THENCE Easterly with said line that is 500 feet North of and parallel with the North boundary line of U. S. Highway No. 82 and the present city limit Zine, 2,050 feet more or less to the place of beginning and containing 15.75 acres, more or less. Highway No. 195, 2820 feet more or less to the Northeast corner of a 5.15 acre tract of land conveyed to Dean Jonzs and recorded in Vol 636, Page 283, Deed Records of Lamar County, Texas; THENCE South with the East boundary line of said Jones 5.15 acre tract, 686 feet to a point, the Northwest corner of a tract of land conveyed Charley A. Smith and wife, Ruth Smith by deed recorded in Vol. 295, Page 311 of said Deed Records; THENCE Easterly with the North line of said Smith tract and its easterly extension, 1,220 feet more or less to the Northeast corner of a 7 acre tract of land conveyed to W. L. Kelly and wife, Inez Kelley, recorded in Vol. 594, Page 229 of said Deed Records; THENCE South with the East line of said Kelly tract, 762 teet more or less to a point in the South boundary line of Smallwood Road, said point being in the present city limit line of the City of Paris; THENCE with the present city limit line, the following: THENCE West with the South boundary line of 5mallwood Road, 1,420 feet more or less to the Northwest corner of a tract of land owned by B. F. Reed and the most Northerly Northwest corner of the Elk Hollow Golf Course property; THENCE South with the Reed-Elk Hollow Golf Course common property line, 540 feet more or less to the Southeast corner of said Reed tract and an inside corner of the Elk Hollow Golf Course; THENCE West with the Reed-Elk Hollow Golf Course common property line, 500 feet to a point in the East boundary line of 36th N.E.; THENCE South with said East boundary line of 36th N.E., 640 feet to a point; THENCE Northwesterly continuing with the present city limit line, 1,710 feet more or less to the place of beginning and containing 93.4 acres more or less. TRACT 3: BEING situated in the Redin Russell Survey, the J. Amos survey and the F. B. Bourland Survey and more particularly described as follows: BEGINNING at a point in the North boundary line of Loop Highway No. 286 N.W., said point being the Southeast corner of a 2 acre tract of land conveyed Roland Cagle by deed recorded in Vol. 374, Page 362 of Deed Records, Lamar County, Texas and being in the present city limit line of the City of Paris; THENCE Narth with the East boundary line of said Cagle tract and the Northerly extension thereof, 870 feet more or less to a point in the East boundary line of an un-named county road, the Southwest corner of a tract of land conveyed L. J. Sims by deed recorded in Vol. 343, Page 272, Deed Records of Lamar County, Texas; THENCE continuing North with the East bound- ary line of said county road, 1,390 feet more or less to a point in the South boundary line of F.M. Highway No. 79; THENCE Northerly across F.M. Highway No. 79 to the Southwest corner of a tract of land con- veyed H. J. Boggs by deed recorded in Vol. 268, Page 176 of said Deed Records; THENCE North 280 feet more or less to the Northwest corner of said Boggs tract, said point being in the South line of the J. A. Watson Survey, No. 1023; THENCE East with the South line of said J. A. Watson Survey No. 1023, 2,120 feet more or less to a point in the West line of the J. A. Henson by deed recorded in Vol. 535, Page 207 of said Deed Records; THENCE East 312 feet with the North line of said Henson tract to an interior corner of same; THENCE North 120 feet to the most easterly Northwest corner of said Henson tract; THENCE East, 843 feet to a point in the West line of Lot 1-A, Wright Commercial Addition; Thence North with the West line of said Lot 1-A, Wright Commercial Addition, 270 feet more or less to the Northwest corner of said Lot 1-A; THENCE East with the North boundary line of said Wright Commercial Addition, 630 feet more or less to a point in the present city limit line of the City of Paris, said pcint being 600 feet North of and perpendicular to the center line of the outside lane of Loop 286 N.W.; THENCE Southwesterly with said City limit line that is parallel with and 600 feet North of the centerline of the outside lane of Loop 286, N.W., 3,640 feet more or less to a point in the South boundary line of F.M. Highway No. 79; THENCE Northwesterly with the South boundary line of said F.M. Highway No. 79 and city limit line, 1,070 feet more or less to the Northwest corner of a 25.871 acre tract of land owned by Paris Industries; THENCE South with the West line of said 25,871 acre tract, and city limit line 1200.44 feet to a point in the North boundary line of Loop 286 N.W.; THENCE Southwesterly with the North boundary line of Loop 286 N.W., and present city limit line 2,030 feet more or less to the place of beginning and containing 146.42 acres more or less; SAVE AND EXCEPT A 17.47 ACRE TRACT OF LAND DESCRIBED AS FOLLOWS: Being a tract or parcel of land situated abaut 22 miles North 50° West of the City of Paris, County of Lamar and State of Texas, a part of the B. F. Bourland Survey No. 70 and John Herrington Survey No. 436, and being described as follows: BEGINNING at a stake for corner in the North boundary line of Loop Highway 286 at the West boundary Iine of said Herrington Survey, said point being the Southwest corner of a 2.46 acre tract of land surveyed for M.S. Kimbell; THENCE North a distance of 2050 feet to a stake for corner at the Northwest corner of a 15 acre tract of land conveyed L.W. Martin by deed recorded in Vol. 364, page 278 of the Deed Records of said County and State; THENCE along the South boundary line of Farm Road 79 as follows: South 77° East a distance of 200 feet; South 79° East a distance of 211 feet to a stake for corner at the Northeast corner of said 15 acre tract of land; THENCE South 0°20' West a distance of 1795 feet to a stake for corner at the Southeast corner of said 2.46 acre tract of land; THENCE South 66°30' West along the North boundary line of said Loop Highway 286 a distance of 427 feet to the place oi beginning and contain- ing 17.47 acres of land. Section 2. That the Mayor of the City of Paris, Paris, Texas, is hereby authorized and directed to cause notice of such public hearings to be published once in the newspaper having general circulation in the City and in the above described territory not more that twenty (20) days nor less than ten (10) days prior to the date of such public hearings, all in accordance with the Municipal Annexation Act (Chapter 160, Acts of the 58th Legislature, Regular Session, 1963; compiled as Articie 970a, Vernon's Texas Civil Statutes). Section 3. It is hereby declared to be the inten- tion of the City Council of the City of Paris that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sen- tence, paragraph or section of this ordinance shall be declared uncontstitutional or invalid by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality or invalidity shall not affect any of the remaining phrases, clauses, sentences, paragraphs and section s of this ordinance, since the same would have been enacted by the city Council without the incorporation in this ordinance of any unconstitutional or invalid phrases, clauses, sentences, paragraphs or sections. It is further hereby declared to be the intention of the City Council of the City of Paris to exclude any area or areas described in the description of the property to be annexed, which are not within said City's jurisdiction to annex and that such area or areas should be carved out of the description of the property herein described by the valid judgment or decree of any court of competent jurisdiction, in order that such area or areas would not cause this annexation ordinance to be found to be invalid, voidable or void.
