ORDINANCE N0. $7-044
AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS,
PROVIDING THAT THE CODE OF ORDINANCES, CITY OF PARIS, BE
AMENDED BY REVISING SECTIONS 1-6, 6-28 (b), 7-37 (b),
12-154, 14-4, 15-25, 24-5, 24-13, 31-44 OF SAID CODE;
PARAGRAPH 23-100, SECTION 23, APPENDIX A TO SAID CODE; AND
ARTICLE 6, SECTION A, APPENDIX B-1 TO SAID CODE; PROVIDING
FOR INCREASE IN MAXIMUM FINE FOR ORDINANCES THAT GOVERN FIRE
SAFETY, ZONING, OR PUBLIC HEALTH AND SANITATION, INCLUDING
DUMPING OF REFUSE HERETOFORE SET AT $1,000.00 to $2,000.00
AND FOR OTHER ORDINANCE ViOLATIONS FROM $200.00 to $500.00
AS AUTHORIZED BY RECENT LEGISLATION; REPEALING ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDIIv"G FOR AN EFFECTIVE DATE OF SEPTEMBER l, 1987.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PARIS:
Section 1. That Section 1-6 of the Code of Ordi-
nances of the City of Paris, Paris, Texas, be amended so
that such shall read as follows:
"Sec. 1-6. General penalty; continuing
violations.
Whenever in this Code or in any ordinance of
the city an act is prohibited or is made or
declared to be unlawful or an offense or a misde-
meanor, or wherever in such Code or ordinance the
doing of any act is required or the failure to do
any act is declared to be unlawful, and no
specific penalty is provided therefor, the vio-
lation of any such provision of this Code or any
such ordinance shall be punished by a firie of not
exceeding five hundred dollars ($500.00); provided
however, that no penalty shall be greater or less
than the penalty provided for the same or a
similar offense under the laws of the state. Each
day a.ny violation of this Code or any ordinance
shall continue shall constitute a separate
offense."
Section 9. That Section 6-28 (b) of the Code of
Ordinances of the City of Paris, Paris, Texas, be amended so
that such shall read as follows:
"Sec. 6-28. Penalty.
(a) . . .
(b) Any person violating any provision of
this chapter dealing with fire safety or zoning
shall be guilty of a misdemeanor and upon con-
viction sha11 be fined any sum not to exceed two
thousand dollars ($2,000.00), and each day's
continuance of any such viol_ation shall be deemed
a separate offense."
Section 3. That Section 7-37 (b) of the Code of
Ordinances of the City of Paris, Paris, Texas, be amended so
that such shall read as follows:
"Sec. 7-37. Penalty.
(a) . . .
(b) Any person violating any of the pro-
visions of this ordinance shall be guilty of a
Misdemeanor, and upon conviction shall be fined in
any sum not to exceed two thousand dollars
($2,000.00), and each and every day's continuance
of any violation of the above enumerated section
shall constitute and be deemed a separate
offense."
Section 4. That SectioTi 12-154 of the Code of
Ordinances of the City of Paris, Paris, Texas, be amended so
that such shall read as follows:
"Sec. 12-154. Amendments by revision.
The Standard Fire Prevention Code, 1982
Edition, as revised by 1983 revisions, as adopted,
is hereby amended by changing the following
paragraphs to read as follows:
1.10. Compliance and Penalty.
(a) Any person operating or maintaining
any occupancy, premises or vehicle subject to
this code who shall permit any fire hazard to
exist on premises under his control or who
shall fail to take immediate action to abate
a fire hazard when ordered or notified to do
so by the fire official or his duly
authorized representative shall be guilty of
a misdemeanor, and upon conviction shall be
fined in any sum not to exceed two thousand
dollars ($2,000.00) and each and every day's
continuance of any violation of the Standard
Fire Code, 1982 Edition, revised by 1983
revisions, as adopted, or Chapter 12 of the
Code of Ordinances of the City of Paris shall
constitute and be deemed a separate offense."
Section 5. That Section 14-4 of the Code of
Ordinances of the City of Paris, Paris, Texas, be amended so
that such shall read as follows:
"Sec. 14-4. Penalty.
Any person violating any of the provisions of
this ordinance shall be guilty of a Misdemeanor,
and upon conviction shall be fined in any sum not
to exceed two thousand dollars ($2,000.00), and
each and every day's continuance of any violation
of the above enumerated section shall constitute
and be deemed a separate offense."
Section 6. That Section 15-25 of the Code of
Ordinances of the City of Paris, Paris, Texas, be amended so
that such shall read as follows:
"Sec. 15-25. Penalty.
Any person violating any of the provisions of
this ordinance shall be guilty of a Misdemeanor,
and upon conviction shall be fitied in any sum not
to exceed two thousand dollars $2,000.00, and each
and every day's continuance of any violation of
the above enumerated section shall constitute and
be deemed a separate offense."
Section 7. That Section 24-5 of the Code of Ordi-
nances of the City of Paris, Paris, Texas, be amended so
that such shall read as follows:
"Sec. 24-5. Amendment of penalty provisions.
Section 110 of the Standard Plumbing Code,
1982 Edition, is amended to read as follows:
Any person, firm or corporation or agent who
shall violate a provision of this code or fail to
comply therewith or with any of the provisions
thereof, or violate a detailed statement or plan
submitted an approved thereunder, shall be guilty
of a misdemeanor, and upon conviction shall be
fined in any sum not to exceed two thousand
dollars ($2,000.00) and each and every day's
continuance of any violation of the Standard
Plumbing Code, 1982 Edition, or Chapter 24 of the
Code of Ordinances of the City of Paris shall
constitute and be deemed a separate offense."
Section 8. That Section 24-13 of the Code of
Ordinances of the City of Paris, Paris, Texas, be amended so
that such shall read as follows:
"Sec. 24-13. Amendment of penalty provision.
Section 114 of the Standard Gas Code, 1982
Edition, is amended to read as follows:
Any person, firm or corporation or agent who
shall violate a provision of this code or fail to
comply therewith or with ang of the provisions
thereof, or violate a detailed statement or plan
submitted and approved thereunder, shall be guilty
of a misdemeanor, and upon conviction shall be
fined in any sum not to exceed two thousand
dollars ($2,000.00), and each and every day's
continuance of any violation of the standard Gas
Code, 1982 Edition, or Chapter 24, Article Ii of
the Code of Ordinances of the City of Paris shall
constitute and be deemed a separate offense."
Section 9. That Section 31-44 of the Code of
Ordinances of the City of Paris, Paris, Texas, be amended so
that such shall read as follows:
"Sec. 31-44. Penalty for violation of article
provisions.
Any person violating any of the provisions of
this ordinance shall be guilty of a Misdemeanor,
and upon conviction shall be fined in any sum not
to exceed two thousand dollars $2,000.00, and each
and every day's continuance of any violation of
the above enumerated section shall constitute and
be deemed a separate offense."
Section 10. That Paragraph 23-100, Section 23 of
Apper.dix A to the Code of Ordinances of the City of Paris,
Paris, Texas, be amended so that such shall read as follows:
"Sec. 23. Penalty for Violations.
23-100 Any person violating any of the pro-
visions of this ordinance shall, upon a
conviction, be fined any sum not exceeding two
thousand dollars ($2,000.00); and each and every
day that the provisions of this ordinance are
violated shall constitute a separate and distinct
offense. In additioti to the said penalty provided
for, the right is hereby conferred and extended
upon any property owner owning property in any
district, where such property owner may be
affected or invaded, by a violation of the terms
of the ordinance, to bring suit in such court or
courts having jurisdiction thereof and obtain such
remedies as may be available at law and equity in
the protection of the rights of such property
owners."
Section 11. That Article 6, Section A of Appendix
B-1 to the Code of Ordinances of the City of Paris, Paris,
Texas, be amended so that such shall read as follows:
"ARTICLE 6. ENFORCEMENT
Section A. Penalty for violation.
Any person violating any of the provisions of
this ordinance shall be guilty of a Misdemeanor,
and upon conviction shall be fined in any sum not
to exceed two thousand dollars $2,000.00, and each
and every day's continuance of any violation of
the above enumerated section shall constitute and
be deemed a separate offense."
Section 12. All ordinances or parts of ordinances iri
conflict herewith are hereby expressly repealed.
Section 13. This ordinance shall become effective on
September l, 1987.
