87-048 ORD PROVIDING CODE OF ORDINANCES BE AMENDED BY REVISING SECTION 28-11, SECTION 28-12 AND SECTION 28-17 OF SAID CODE ORDINANCE N0.87'048 AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF PARIS, BE AMENDED BY REVISING SECTION 28-11, SECTION 28-12 ANI7 SECTION 28-17 OF SAID CODE; PROVIDING THAT THE USE OF REVENUE DERIVED FROM SAME BE EXPENDED IN ACCORDANCE WITH STATE LAW; PROVIDING FOR A PENALTY NOT TO EXCEED $500.00; REPEALING ALL ORDINANCES OR PARTS OR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF OCTOBER 1, 1987. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section l. That Section 28-11 of the Code of Ordinances of the City of Paris, Paris, Texas, be amended so that such shall read as follows: "Section 28-11. Tax Levied and Restrictions on Use. (a) . . . (b) All of the tax revenue derived from the levy herein may only be used for the purposes enumerated in Section 28-12 of this Chapter and shall not be used for the general revenue purposes or general governmental operations of the city. (c) No more than one per cent of the consid- eration paid by an occupant of a hotel or motel room may be spend on the arts as authorized by subparagraph (d) of Section 28-12 of this Chapter." Section 2. That Section 28-12 of the Code of Ordinances of the City of Paris, Paris, Texas, be amended so that such shall read as follows: "Sec. 28-12. Use of rPVenue limited. The revenue derived from the hotel occupancy tax herein levied under the authority granted in Article 1269j-4.1 Vernon's Texas Civil Statutes may only be used to promote tourism and the convention and hotel industry and such use is limited to the following: (a) . . . (b) . . . (c) For general promotional and tourist advertising of the city anci its vicinity and conducting a solicitation and operating a program to attract con- ventions and visitors either by the city or through contracts with persons or organizations selected by the city; (d) . . . (e) . . . Section 3. That Section 28-17 of the Code of Ordinances of the City of Paris, Paris, Texas, be amended so that such shall read as follows: "Sec. 28-17. Penalty. Any individual, association or corporation violating any portion or provision of this arti- cle, upon conviction, shall be fined in any sum not to exceed $500.00, and each and every day's continuance o£ any violation of this article shall constitute and be deemed a separate offense." Section 4. Any person violating any of the provisions of this ordinance, upon conviction, shall be fined in any sum not to exceed $500.00, and each and every day's continu- ance of any violation of the above enumerated section shall constitute and be deemed a separate offense. Section 5. All ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. Section 6. This ordinance shall become effective on October 1, 1987.
