86-010 ORD CONTAINING HEARING ON PROPERTIES LOCATED IN COP BELONGING TO VARIOUS OWNERS ORDINANCE N0. $6-010 AN ORDINANCE CONTAINING A HEARING ON PROPERTIES LOCATED IN THE CITY OF PARIS, TEXAS, BELONGING TO VARIOUS OWNERS, AND AN ORDINANCE OF THE CITY COUNCIL FINDING THE MATERIALS REMAINING IN THE PREMISES TO CONSTITUTE A NUISANCE AND TO BE A FIRE HAZARD TO LIFE AND PROPERTY AND A HAZARD TO THE LIFE AND WELFARE OF THE INHABITANTS OF THE AREA, AND ORDERING SAID RUBBISH, LUMBER AND REFUSE FROM THE STRUCTURES TO BE TORN DOWN AND REMOVED FROM THE PREMISES IN ORDER TO ABATE SUCH NUISANCE. WHEREAS, a public hearing was called to order by the Mayor of the City of Paris, Billy Joe Burnett, on the 12th day of May, 1986, at 7:00 o'clock P.M,, in the Council Room, City Hall, in the City of Paris, Texas; and, WHEREAS, the City Council finds that the Building Hazard Inspection Committee fixed a date for hearing on the resolution referred to the Committee by the City Council on the 13th day of January, 1986, and said Committee fixed said hearing at 10:00 o'clock A.M. on the 18th day of April, 1986, and the hearing was had thereon. That proper notice was given to the owner or owners of the structures located at the following addresses: 1101 S. Church Street, Lot 16, City Block 159 515 Woodlawn, Lot 1, City Block 116 505 Woodlawn, Lot 1, City Block 116 323 Pine Bluff, Lot 8, City Block 60 1439 West Campbell, Lot 2, City Block 232-A 755 7th N.E. Street, Lot 10, City Block 72-A That at said hearing the Committee listed the structures involved and introduced pictures of the various portions of the structures and various portions of the premises involved and a list of discrepancies in the structures located thereon. That the Committee found that each of the above structures was in such state of deterioration and dilapidation as to create a serious fire hazard to lif.e and property and that each of said buildings was dilapidated and was dangerous to life and property and dangerous structures to Iife and property. That said buildings are in such a state of dilapidation and decay that none of said structures are capable of repair. It is further found that the condi- tion of the premises and structures involved was such that the Committee recommended to the City Council that they be declared a nuisance and that the owners thereof be ordered by the City Council to tear down and remove the same from the lots involved. That said Committee filed a complete report of its hearing and its findings with the City Clerk of the City of Paris on the 23rd day of April, 1986; and, WHEREAS, the City Council further finds that proper notice was given to the owner or owners of the structures hereinafter listed. That at said hearing on the 18th day of April, 1986, the Committee listed the structures involved and introduced pictures of the various portions of the structures and various portions of the premises involved and a list of discrepancies in the structures located thereon. That the Committee found that each of the hereinafter listed structures was in such state of deterioration and dilapidation as to create a serious fire hazard to life and property, and that each of said buildings was dilapidated and dangerous to life and property and dangerous structures to life and property. That the owners of the property appeared before the Committee and requested time to repair the structures or the Committee found that the structures could be repaired. That it was the recommendation of the Committee that the structures be condemned or repaired and that the respective owners thereof be given the time to abate said nuisance by repair or removal as is set out iri cannection with each of such addresses, as follows: 1033 N. E. 8th Street, Lot 3, Block 3, Pickard Addition 100 days 1350 East Houston, Lot 5, City Block 33-C 120 days 137 West Sherman, Lot 22, Block 137 90 - 120 days 1610 15th N.E. Street, Lot 6, City Block 281 60 days 2225 S. Church Street, Lot 2, City Block 170-C 90 days 1420 llth N.W. Street, Lot 1, Block 9, Smith lst Addition 60 days 1475 7th N.W. Street, Lot 1, Block 1, North 7th Park Addition 60 days 340 N.W. 14th Street, Lot 2, City Block 230 60 days 727 Graham Street, Lot 6, City Block 45 120 days and it is so stated in the report of the Building Hazard Inspection Committee filed with the City Clerk of the City of Paris on the 23rd day of April, 1986; and, WHEREAS, the City Council has fully heard and con- sidered the testimony presented upon the hearing and a complete transcript of the testimony reported by the Build- ing Hazard Inspection Committee; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section 1. That the structures located at the following addresses: 1101 S. Church Street, Lot 16, City Block 159 515 Woodlawn, Lot l, City Block 116 505 Woodlawn, Lot 1, City Block 116 323 Pine Bluff, Lot 8, City Block 60 1439 West Campbell, Lot 2, City Block 232-A 755 7th N.E. Street, Lot 10, City Block 72-A arE a nuisance, and they are hereby declared a nuisance, in that they are dangerous to life and property, and that the same constitute a fire hazard to life and property, and that the respective owners are hereby ordered to abate such nuisance within thirty (30) days from the date hereof. The City Clerk is directed to furnish the owners a copy of this ordinance, in the event the addresses of said owners are known, and in the event the respective owners refuse to comply with this ordinance, the City Attorney, T. K. Haynes, is hereby directed to proceed to enforce this ordinance by the procedure provided form in Article III of Chapter 7 of the Code of Ordinances of the City of Paris. Section 2. That the structures hereinafter enumerated are a nuisance, and they are hereby declared a nuisance, in that they are dangerous to life and property, and that the same constitute a fire hazard to life and property, and that the respective owners are hereby ordered to abate such nuisances on or before the dates set out in connection with the addresses of eacYL of such structures, as follows: 1350 East Houston, Lot 5, City Block 33-C September 15, 1986 137 West Sherman, Lot 22, Block 137 September 15, 1986 1033 N.E. 8th Street, Lot 3, B1ock 3, Pickard Addition August 20, 1986 1610 15th N.E. Street, Lot 6, City Block 281 July 15, 1986 2225 S. Church Street, Lot 2, City Block 170-C August 15, 1986 1420 llth N.W. Street, Lot 1, Block 9, Smith lst Addition July 15, 1986 1475 7th N.W. Street, Lot 1, Block l, North 7th Park Addition July 15, 1986 340 N.W. 14th Street, Lot 2, City Block 230 July 15, 1986 727 Graham Street, Lot 6, City Block 45 September 15, 1986 The City Clerk is directed to furnish the owners a copy of this ordinance, in the event the addresses of said owners are known, and in the event the respective owners refuse to comply with this ordinance, the City Attorney, T.
