ORDINANCE N0. 86-023
AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS,
PROVIDING THAT THE CODE OF ORDINANCES, CITY OF PARIS, BE
AMENDED BY REVISING ARTICLE 1, SECTION C(7) OF APPENDIX
B-1, FLOOD DAMAGE PREVENTION, ORDINANCE N0. 83-065 OF SAID
CODE; PROVIDING THAT AREAS OF SPECIAL FLOOD HAZARD BE
DELINEATED ON SUBDIVISIUN PLAT; PROVIDING FOR A PENALTY NOT
TO EXCEED $1,000.00; REPEALING ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN
EFFECTIVE DATE OF AUGUST 1, 1986.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PARIS:
Section l. That Article l, Section C(7) of
Appendix B-l, Flood Damage Prevention, Ordinance No. 83-065
of the Code of Ordinances of the City of Paris, Paris,
Texas, be amended so that such shall read as follows:
"ARTICLE l. STATUTORY AUTHORIZATION, FINDINGS OF
FACT, PURPOSE AND METHODS.
Section C. Statement of purpose.
It is the pu.rpose of this ordinance to
promote the public health, safety and general
welfare and to minimize public and private losses
due to flood conditions in specific areas by
provisions designed:
(7) To ensure that the potential buyers are
notified that the property is in a flood
area. Such notification to include but
not be limited to the delineation of
areas of special flood hazards or
flood-prone areas depicted on all
preliminary and final plats filed with
the City of Paris in accordance with the
Subdivision Ordinance of the City of
Paris which plats must be certified to
by a registered professional engineer
practicing and authorized to practice
civil engineering in the State of
Texas."
Section 2. Any person violating any of the pro-
visions of this ordinance shall be guilty of a Class "C"
Misdemeanor, and upon conviction shall be fined in any sum
not to exceed $1,000.00, and each and every day's continu-
ance of any violation of the above enumerated section shall
constitute and be deemed a separate offense.
Section 3. All ordinances or parts of ordinances in
conflict herewith are hereby expressly repealed.
Section 4. This ordinance shall become effective on
August 1, 1986.
