86-026 ORD DECLARING STATE OF EMERGENCY UNDER SECTION 31-28 OF CODE OF ORDINANCES ORDINANCE N0. 86-026 AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, DECLARING A STATE OF EMERGENCY UNDER SECTION 31-28 OF THE CODF. OF ORDINANCES OF THE CITY OF PARIS; PROVIDING THAT THE CODE OF ORDINANCES, CITY OF PARIS, BE AMENDED BY REVISING SECTION 31-28 OF SAID CODE; PROVIDING FOR THE EMERGENCY RATIONING OF CITY OF PARIS WATER; PROVIDING FOR A PENALTY NOT TO EXCEED $200.00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF JULY 28, 1986. WHEREAS, the City Council of the City of Paris did meet at a Special Meeting on the 28th day of July, 1986 and considered an emergency item for rationing of water due to the City of Paris Water Department's inability to meet the unrestricted needs of its water customers; and, WHEREAS, it is found that the Water Department cannot meet the unrestricted demands of its customers and therefore an emergency exists; and, WHEREAS, emergency measures must be taken to insure that the citizens of Paris are afforded fire protection; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section 1. That a state of emergency uiider Section 31-28 of the Code of Ordinances of the City of Paris is hereby declared. Section 2. That the Code of Ordinances of the City of Paris, Paris, Texas, be amended by revising Section 31-28, to read as follows: "Sec. 31-28. Fmergency rationing of water. The City Council may upon finding that the Water Department of the City of Paris is approach- ing the condition of not being able to meet the demands of its customers, authorize the Mayor of the City of Paris to declare a state of emergency when the Water Department of the City cannot meet the demands of its customers and afford fire protection to the City of Paris. When such an emergency has been declared, it shall be unlawful for any water customer to make outside use of city water for such period of time as the Mayor may set, and thereafter it shall be unlawful for any water customer with an even address number to make outside use oi city water on odd numbered days of the month and for dny water customer with an odd address number to make outside use of city water on even numbered days of the month, except all customers are permitted to make outside use of city water for the period beginning at 7:00 o'clock A.M. Sunday and ending 7:00 o'clock A.M. Monday, until such time as the Mayor declares the state of emergency to cease." Section 3. Any person violating any of the pro- visions of this ordinance shall be guilty of a Class "C" Misdemeanor, and upon conviction shall be fined in any sum not to exceed $200.00, and each and every day's continuance of any violation of the above enumerated section shall constitute and be deemed a separate offense. Section 4. Al1 ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. Section 5. This ordinance shall become effective on July 28, 1986.
