86-027 ORD PROVIDING CODE OF ORDINANCES BE AMENDED BY REVISING SECTION 26 1/2 -9 (d) AND (i) SECTION 26 1/2 -11 AND BY ADDING SECTION 26 1/2 -33 TO SAID CODE
ORDINANCE N0. 86-027
AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS,
PROVIDING THAT THE CODE OF ORDINANCES, CITY OF PARIS, BE
AMENDED BY REVISING SECTION 26Z-9 (d) AND (i), SECTION
262-11 AND BY ADDING SECTION 262-33 TO SAID CODE; PROVIDING
FOR HEIGHT RESTRICTIONS FOR BILLBOARDS AND GROUND AND POLE
SIGNS; PROVIDING FOR A SPECIFIC USE FERMIT; PROVIDING FaR A
PENALTY NOT TO EXCEED $200.00; REPEALING ALL ORDINANCES OR
PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR
AN EFFECTIVE DATE OF SEPTEMBER l, 1986.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PARIS:
Section l. That the Code of Ordinances of the City
of Paris, Paris, Texas, be amended by revising Section 262-9
(d) and (i) so that such shall read as follows:
"Sec. 262-9. Prohibited Signs.
(d) Ground signs. The size of ground signs
shall be limited to one square foot per front foot
of property upon which the same is placed;
however, under no circumstances shall such sign
exceed 300 square feet in area and 15 feet in
height. No ground sigr shall be erected within 20
feet of any residence."
(i) Pole signs. The size of pole signs
shall be limited to one square foot per front foot
of property upon which the same is placed;
however, under no circumstances sha11 such sign
exceed 300 square feet in area and 15 feet in
height except that pole signs may exceed 15 feet
when erected adjacent to an elevated portion of
Loop 286 or adjacent to an elevated portion of any
Farm to Market, Texas or United States highway
nutside of Loop 286 and upon the granting of a
special use permit. No pole sign shall be erected
within 20 feet of any residence."
Section 2. That the Code of Ordinances of the City
of Paris, Paris, Texas, be amended by revising Section
262-11 so that such shall- read as follows:
"Sec. 262-11. Same Construction.
No billboard or ground sign constructed of
wood or other combustible material shall be
erected in the fire limits nor within 50 feet of
any frame building, nor within 25 feet of any
building having unprotected openings in the wall
on the side nearest the billboard, provided;
however, that posts and braces supporting a ground
sign, and the skeleton fraine of a billboard not
exceeding 15 feet in height abave the curb level,
may be wood; and there may also be a wood moulding
or border, not over 8 inches wide around the edge
of such structure. The lower edge of every such
billboard shall be not less than 3 feet above the
ground, and the space between the lower edge of
the billboard and the ground shall be left open or
mav be closed with lattice work which leaves at
least 50% of the space open. The upper edge of
the billboard shall be not more than 30 feet above
the ground."
Section 3. That the Code of Ordinances of the City
of Paris, Paris, Texas, be amended by adding Section 262-33
so tha.t such shall read as fol_lows:
"Sec. 262-33. Specific Use Permit.
A sign permitted to be constructed upon the
issuance of a special use permit shall only be
issued a permit after the application for such
permit has beeri submitted to the Special Use Board
composed of the Mayor of the City of Paris or his
designated representative, the Chairman of the
Planning and Zoning Commission, the City Engineer,
the Traffic Safety Coordinator and the Director of
Community Development."
Section 4. Any person violating any of the pro-
visions of this ordinance shall be guilty of a Class "C"
Misdemeanor, and upon conviction sha11 be fined in any sum
not to exceed $200.00, and each and every day's continuance
of any violation of the above enumerated section shall
constitute and be deemed a separate offense.
Section 5. All ordinances or parts of ordinances in
conflict herew?th are hereby expressly repealed.
Section 6. This ordinance shall become effective on
September 1, 1986.
