86-040 ORD CONTAINING HEARING ON PROPERTIES LOCATED IN COP BELONGING TO VARIOUS OWNERS ORDINANCE N0. 86-040 AN ORDINANCE CONTAINING A HEARING ON PROPERTIES LOCATED IN THE CITY OF PARIS, TEXAS, BELONGING TO VARIOUS OWNERS, ANU AN URDINANCE OF THE CITY COUNCIL FINDING THE MATERIALS REMAINING ON THE PREMISES TO CONSTITUTE A NUISANCE AND TO BE A FIRE HAZARD TO LIFE AND PROPERTY AND A NAZARD TO THE LIFE AND WELFARE OF THE INHABITANTS OF THE AREA, AND ORDERING SAID RUBBISH, LUMBER AND REFUSE FROM THE STRUCTURES TO BE TORN DOWN AND P,EMOVED FROM THE PREMISES IN ORDER TO ABATE SUCH NUISANCE. WHEREAS, a pubJ_ic hearing was called to order by the Mayor of the City of Paris, Billy Joe Burnett, on the 16th day of October, 19£36, at 5:15 o'clock P.M. , in the Council Room, City Hall, in the City of Paris, Texas; and, WHEREAS, the City Council rinds that the Building Hazard Inspection Committee fixed a date for hearing on the resolutions referred to the Committee by the City Council on the llth day of August, 1986, and said Committee fixed said hearing at 10:00 o'clock A.M. on the 19th day of September, 1986, and the hearing was had thereon. That proper notice was given to the owner or owners of the structures located at the following addresses: 442 4th N.W., Lot 2A, Block 55 1311 12th N.E., Lot 9, Block 269 700 Block of Tudor Street, Lot 12, B1ock 71-A 1100 142 N.W., Lot 1, Block 1, C.C. Hopkins Addition (City Block 232) 1640 Fitzhugh, Lot 35, Block A, East Park Addition 201 E. Center, Lot 1, Block 20, Fairview Addition 948 15th N.W., Lot 7B, Block 232 778 Hickory, Lot 10-I1, Block 7, Williams Addition 500 Block of Center Street, Block 17-18, Fairview Addition 522 lst N.E. Street, Lot 2, Block 92 530 lst N.E. Street, Lot 2, Block 92 757 7th N.E. Street, Lot 18, Block 72-A That at said hearing the Conunittee listed the structures involved and introduced pictures of the various portions of the structures and various portions of the premises involved and a list of discrepancies in the structures located thereon. That the Committee found that each of the above structures was in such state of deterioration and dilapidation as to create a serious fire hazard to life and property and that each of said buildings was dilapidated and was dangerous to life and property and dangerous structures to life and property. That said buildings are in such a state of dilapidation and decay that none of said structures are capable of repair. It is further found that the condi- tion of the premises and struc:tures involved was such that the Committee recommended to the City Council that they be declared a nuisance and that the owners thereof be ordered by the City Council to tear down and remove the same from the lots involved. That said Committee filed a complete report of its hearing and its findings with the City Clerk of the City of Paris on the 30th day of September, 1986; ard, WHEREAS, the City Council further finds that proper notice was given to the owner or owners of the structures hereinafter listed. That at said hearing on the 19th day of September, 1986, the Committee listed the structures involved and introduced pictures of the various portions of the structures and various portions of the premises involved and a list of discrepancies in the structures located thereon. That the Committee found that each oi the herein- after listed structures was in such state of deterioration and dilapidation as to create a serious fire hazard to life and property, and that each of said buildings was dilapidated and dangerous to life and property and dangerous structures to life and property. That the owners of the propert_y appeared before the CoLnmittee and requested time to repair the structures or the Committee found that the structures could be repaired. That it was the recommenda- tion of the Committee that the structures be condemned or repaired and that the respective owners thereof be given the time to abate said nuisance by repair or removal as is set out in connection with each of such addresses, as follows: 1830 Fitzhugh, Lot 11, Block A, East 90 days Park Addition 720 Tudor, Lot 9, Block 63 60 days 622-627 N.E. 14th, Lots 6-7, Block 3, Hicks First Addition 90 days and it is so stated in the report of the Building Hazard Inspection Committee filed with the City Clerk of the City of Paris on the 30th day of September, 1986; and, WHEREAS, the City Council has fully heard and con- sidered the testimony presented upon the hearing and a complete transcript ot the testimony reported by the Building Hazard Inspection Committee; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section l. That the structures located at the following addresses: 442 4th N.W., Lot 2A, Block 55 1311 12th N.E., Lot 9, Block 269 700 Block of Tudor Street, Lot 12, Block 71-A 1100 142 N.W., Lot 1, Block l, C.C. Hopkins Addition (City Block 232) 1640 Fitzhugh, Lot 35, Block A, East Park Addition 201 E. Center, Lot 1, Block 20, Fairview Addition 948 15th r1.w., Lot 7B, Block 232 778 Hickory, Lot 10-11, Block 7, Williams Addition 500 Block of Center Street, Block 17-18, Fairview Addition 522 lst N.E. Street, Lot 2, Block 92 530 lst N.E. Street, Lot 2, Block 92 757 7th N.E. Street, Lot 18, Block 72-A are a nuisance, and they are hereby declared a nuisance, in that they are dangerous to life and property, and that the same cor_stitute a fire hazard to life and property, and that the respective owners are hereby ordered to abate such nuisance within thirty (30) days from the date hereof. The City Clerk is directed to furnish the owners a copy of this ordinance, in the event the addresses of said owners are known, and in the event the respective owners ref_use to comply with this ordinance, the City Attorriey, T. K. Haynes, is hereby directed to proceed to enforce this ordinance by the procedure provided form in Article III of Chapter 7 of the Code of Ordinances of the City of Paris. Section 2, That the structures hereinafter enumerated are a nuisance, and they are hereby declared a nuisance, in that they are dangerous to life and property, and that the same constitute a fire hazard to life and property, and that the respective owners are hereby ordered to abate such nuisances on or before the dates set out in connection with the addresses of each of such structures, as follows: 1830 Fitzhugh, Lot 11, Block A, East Park Addition January 20, 1987 720 Tudor, Lot 9, Block 63 December 20, 1986 622-627 N.E. 14th, Lots 6-7, Block 3, Hicks First Addition January 20, 19$7 The City Clerk is directed to furnish the owners a copy of this ordinance, in the event the addresses of said owners are known, and in the event the respective owners refuse to comply with this ordinance, the City Attorney, T. K. Haynes, is hereby directed to proceed to enforce this ordinance by the procedure provided for in Article III of Chapter 7 of the Code of Ordinances of the City of Paris.
