85-051 ORD PROVIDING CODE OF ORDINANCES BE AMENDED BY REVISING SECTION 31-18 OF SAID CODE TO INCREASE WATER RATES AND ESTABLISH READINES TO SERVE FEE ORDINANCE N0. $5-051 AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF PARIS, BE AMENDED BY REVISING SECTION 31-18 OF SAID CODE TO INCREASE THE WATER RATES AND TO ESTABLISH A READINESS TO SERVE FEE, PROVIDING FOR NO FEE FOR WATER TAP FOR STANDBY FIRE PRO- TECTION AND ELIMINATING THE FIXED RAW WATER FEE AND PROVIDING FOR SUCH RATE TO BE ESTABLISHED BY CONTRACT; BY REVISING SECTION 31-19 ESTABLISHING THE SEWER SERVICE RATE FOR CITY WATER CUSTOMERS AT 80% OF THE MONTHLY CHARGE FOR READINESS TO SERVE AND WATER SERVICE, ESTABLISHING AN UPPER LIMIT FOR SINGLE FAMILY AND RESIDENCE CUSTOMERS AT $20.00, INCREASING THE COST TO USERS DISCHARGING OVERSTRENGTH SEWER; AND REQUIRING THE ANNUAL RECALCULATION OF SAID CHARGES; BY REVISING SECTION 31-20 TO INCREASE THE SEWER CHARGE TO CUSTOMERS WHO ARE NOT CITY WATER CUSTOMERS TO $20.00; BY REVISING SECTION 31-25(a) BY PROVIDING FOR A FIVE (5) DAY NOTICE PRIOR TO CUTOFF FOR DELINQUENCY, BY REVISING SECTION 31-26 TO PROVIDE FOR DISCONTINUANCE OF WATER SERVICE FOR FAILURE TO PAY BILL AFTER THE EXPIRATION OF TWENTY-ONE (21) DAYS FOLLOWING THE BILLING DATE AND THE RECEIPT OF FIVE (5) DAYS WRITTEN NOTICE OF SAID DELINQUENCY, BY REVISING SECTION 31-91(g) PROVIDING THAT CHARGE RATES FOR EXCESSIVE SURCHARGE WILL BE AS STATED IN SECTION 31-19 OF THE CODE OF ORDI- NANCES; BY REVISING SECTION 31-91(k)(2) CHANGING THE EFFEC- TIVE DATE OF RECALCULATED SURCHARGES FROM SEPTEMBER 1 TO OCTOBER 1 OR THE EFFECTIVE DATE AS SET BY THE CITY COUNCIL, WHICHEVER OCCURS FIRST; PROVIDING FOR A PENALTY NOT TO EXCEED $200.00; REPEALING ALL ORDINANCES OR PARTS OF ORDI- NANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF OCTOBER 1, 1985. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section l. That Section 31-18 of the Code of Ordinances of the City of Paris, Paris, Texas, be amended so that such shall read as follows: "Sec. 31-18. Water Rates. (d) Charges for raw water, either pumped or taken direct from the source, shall be fixed by contract authorized by the city council of the City of Faris. Section 2. That Section 31-19 of the Code of Ordinances of the City of Paris, Paris, Texas, be amended so that such shall read as follows: "Sec. 31-19. Sewer Rates - For customers using city water. (a) Charges for sewer service furnished by the city to domestic and commercial customers who are also users of city water are hereby tixed at eighty (80) per cent of the monthly charge for readiness to serve and water used, such use to be as registered by the user's water meter. (b) The charge for sewer service for a single-family residence shall not exceed twenty dollars ($20.00) per month, regardless of inetered water consumption and total monthly bill. (c) Users desiring to discharge sewage into the city's sewerage system, the strength of which sewage exceeds two hundred fifty (250) parts per million BOD; two hundred fifty (250) parts per million of suspended solids, or thirty (30) parts per million of ammonia, and which is acceptable under Article III of' this chapter, may do so upon written permission of the city and by paying a monthly treatment charge in the amount of one dollar fifty-one and nine tenths cents ($1.519) per one million (1,000,000) gallons of sewage flow for each one part per million in excess of the allowable BOD; one dollar thirty-three and nine tenths cents ($1.339) per one million (1,000,000) gallons of sewage flow for each one part per million in excess of the allowable suspended solids and four dollars eighty-nine and one tenths cents ($4.891) per one million (1,000,000) gallons of sewage flow for each one part per million in excess of the allowable ammonia strength. The city shall make the necessary tests of the user's sewage strength to determine this charge. The charge prescribed by this subsection shall be in addition to the charges prescribed in subsection (a) hereof. The above described excessive strength surcharge rates will be recalculated immedi- ately after the adoption of the annual budget, using the amount budgeted as cost and actual operational characteristics for the most recently completed twelve (12) month period for plant loading. Such rates shall become effective when adopted by the city council or on October 1, whichever occurs first." Section 3. That Section 31-20 of the Code of Ordinances of the City of Paris, Paris, Texas, be amended so that such shall read as follows: "Sec. 31-20. Same - For customers not using city water. Single-family residence sewerage cus- tomers, who are not also water customers of the city, shall pay a flat rate charge of twenty dollars (520.00) per month for sewerage service. All other sewerage cus- tomers, who are not also water users of the city, shall pay a flat monthly rate to be determined by the city manager." Section 4. That sub-paragraph (a) of Section 31-25 of the Code of Ordirtances of the City of Paris, Paris, Texas, be amended so that such shall read as follows: "Sec. 31-25. Billing; when and where payable. (a) The division shall render bills for readiness to serve and water service or for sewer service furnished by the City of Paris to any person, firm or corporation on a monthly basis, with such billing being rendered on or about the same day each month. Bills a.nd accounts shall be due and payable on or before the 21st day following the billing date and shall become delinquent on the 22nd day after said billing date." Section 5. That Section 31-26 of the Code of Ordinances of the City of Paris, Paris, Texas, be amended so that such shall read as follows: "Sec. 31-26. Discontinuance of water service for failure to pay. If any person shall fail to pay the bill for readiness to serve and water service or for sewer service rendered to such person by the city before the expiration of twenty-one (21) days following the billing dare, the water service of such person may be discon- tinued after such person has received at least five (5) days written notice that they are subject to termination of service, which notice shall include their right to a hearing concerning the same, such service may be terminated and shall not again be resumed until such person shall have paid the delin- quent water and sewer bill in full, together with the reconnection fee as required by Section 31-29 of this Chapter. It shall be unlawful for any person other than a duly authorized employee of the city, to reconnect such service." Section 6. That subparagraph (g) of Section 31-91 of the Code of Ordinances of the City of Paris, Paris, Texas, be amended by deleting the remainder of the paragraph appearing after "CHARGE RATES FOR EXCESSIVE SURCHARGE" and adding thPreunder "excessive strength surcharge rates are established in Section 31-19 of this Chapter." Section 7. That subparagraph (2) of paragraph (k) of Section 31-91 of the Code of Ordinances of the City of Paris, Paris, Texas, be amended so that such shall read as follows: "(k) Total surcharges: (2) Excessive strength surcharge rates will be calculated immediately after the adoption of the annual budget using the amount budgeted as cost and actual operational characteristics for the most recent completed twelve (12) month period for plant loading. Such rates shall become effective when adopted by the city council or on October 1 annually, whichever occurs first." Section 8. Any person violating any of the pro- visions of this ordinance shall be guilty of a Class "C" Misdemeanor, and upon conviction shall be fined in any sum not to exceed $200.00, and each and every day's continuance of any violation of the above enumerated section shall constitute and be deemed a separate offense. Section 9. All ordinances or parts of ordinances in conflict herewith are herPby expressly repealed. Section 10. This ordinance shall become effective on October 1, 1985.
