84-005 ORD PROVIDING CODE OF ORDINANCES BE AMENDED BY ADDING ARTICLE IV TO CHAPTER 12 SAID CODE
ORDINANCE N0. $4-005
AN ORDINAPZCE OF THE CITY OF PARIS, PARIS, TEXAS,
PROVIDING THAT THE CODE OF ORDINANCES, CITY OF PARIS, BE
AMENDED BY ADDING ARTICLE IV TO CHAPTER 12, OF SAID CODE;
PROVIDItdG FOR THE ADOPTION OF THE STANDARD FIRE PREVENTION
CODE, 1982 EDITION AS REVISED BY 1983 REVISIONS; AND ESTAB-
LISHING PERMIT REQUIREriENTS TO BE USED WITH THE SAME;
PROVIDING FOR A PENALTY NOT TO EXCEED $1,000.00; REPEALING
ALL ORDINANCES CR PARTS OF ORDINANCES IN CONFLICT HEREWITH;
AND PROVIDING FOR AN EFFECTIVE DATE OF FEBRUARY 1, 1984.
BE IT ORDAINED BY THE CITY COUI`;CIL OF THE CITY OF
PARIS:
Section 1. That Chapter 12 of the Code of Ordi-
nances of the City of Paris, Paris, Texas, be amended by
adding thereto Article IV which shall read as follows:
'°Chapter 12. Fire Prevention and Protection
Article IV, Fire Prevention Code.
Section 12-151. Adopted.
For the purpose of establishing rules and
regulations for fire prevention relating to public
safety, health and general welfare within the City
of Paris and its extraterritorial jurisdiction
where applicable, that certain Fire Prevention
Code known as Star.dard Fire Prevention Code, 1982
Edition, as revised by 1983 revisions, save and
except such portions as are deleted, modified, or
amended by this article, is hereby adopted and
incorporated as fully as if set out at length
herein. A copy of such Code with said revisions
has been and is now on file in the office of the
City Clerk and the provisions thereof shall be
controlling as above stated.
Section 12-152. Additions.
The Standard Fire Prevention Code, 1982
Edition, as revised by 1983 revisions, as adopted
is hereby amended by adding the following para-
graph thereto:
18.206.1. Residential Fire Alarm Installation.
a. In addition to the requirements of
Section 18.206, every diaelling unit henceforth
constructed or placed within the City of Paris,
Paris, Texas shall have fire detection devices
capable of sensing products of combustion
installed which are supplied by a direct con-
nection to the 120 VAC electrical system.
b. Alarm devices operating from a battery
power source or those utilizing a cord for plug in
to electrical outlets are expressly prohibited in
such new construction; however, a battery power
source used as a backup to 120 VAC electrical
system is permitted and encouraged.
c. Installation, design and operation of all
residential single station alarms shall conforr.i to
PdFiPA 74 and P3FiPA 72 A and shall be listed by a
Pdationally accepted testing authority.
d. It shall be a violation of this code for
any person to remove, tamper, destroy, disconnect
or in any manner render detectors inoperative.
e. It shall be unlawful to maintain a
residence with an alarm which is not totally
operable.
Section 12-153. Amendment by deletions.
The Standa.rd Fire Prevention Code, 1982
Edition, as revised by 1983 revisior_s, is hereby
amended by deleting the following paragraphs
thereto:
18.205 - Fire Extinguishers in Auto and Trailer
Camps.
32.02 - Smoking.
Section 12-154. Ar.iendments by revision.
The Standa.rd Fire Prevention Code, 1982
Edition, as revised by 1983 revisions, as adopted
in hereby amended by changing the following
paragraptis to read as follows:
1.10- Compliance and Penalty.
(a) Any person operating or maintaining any
occupan.cy, premises, or vehicle subject to this
Code who shall permit any fire hazard to exist on
premises under his control or who shall fail to
take immediate action to abate a fire hazard when
ordered or notified to do so by the Fire Official
or his duly authorized representative shall be
guilty of a Class C misdemeanor, and upon con-
viction shall be fined in any sum not to exceed
$1,000.00 and each and every days continuance of
any violation of the Standard Fire Code, 1982
Edition, revised by 1983 revisions, as adopted, or
Chapter 12 of the Code of Ordir.ances of the City
of Paris shall constitute and be deemed a separate
offense.
2.01 - Board of Appeals and Adjustments
Designated.
The Board of Appeals established in. sub-
paragraph B of Section 17-19 of the Code of
Ordinances of the City of Paris is hereby des-
ignated to serve as the Board of Appeals and
Adjustment with regard to matters pertaining to
the Standard Fire Prevention Code with the powers
to recommend variances to the application of any
provision of said code and to pass on related
matters. The fire official, or his authorized
representative shall be and ex officio member of
said Board when acting with regard to the Fire
Prevention Code as shall serve as secretary to
said Board in such matters.
Section 7-04 - Burning operations.
(a) The burning of wrecked or discarded
automobiles or any part thereof of junk or any
waste materials associated with the wrecking
industry is permitted only as authorized by
Section 12-12.1 of this Code and the Texas Air
Quality Control Act.
(b) Rooms for handling waste materials shall
be separated by storage rooms by not less than one
hour occupancy separation constructed as specified
in the Building Code, Such rooms shall be provided
with approved exhaust systems to adequately remove
dust and lint.
Section 2. Any person violating any of the pro-
visions of this ordinance shall be guilty of a Class "C"
Misdemeanor, and upon conviction shall be fined in an.y sum
not to exceed $1,000.00, and each and every day's continu-
ance of any violation of the above enumerated section shall
constitute and be deemed a separate offense.
Section 3. All ordinances or parts of ordinances in
conflict herewith are hereby expressly repealed.
Section 4. This ordinance shall become effective on
February l, 1984.
