84-006 ORD PROVIDING CODE OF ORDINANCES BE AMENDED BY REVISING CHAPTER 24 OF SAID CODE ORDINANCE N0. 84-006 AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDIr1G THAT THE CODE OF ORDINANCES, CITY OF PARIS, BE AMENDEU BY REVISING CHAPTER 24, OF SAID CODE; PROVIDING FOR THE ADOPTION OF THE STANDARD PLUMBIrIG CODE, 1982 EDITION, AND ESTABLISHING FEES TO BE USED WITH THE SAME; PROVIDING FOR A PENALTY NOT TO EXCEED $1,000.00; REPEALING ALL ORDI- Pv'ANCES OR PARTS OF ORDINAIICES IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF FEBRUARY l, 1984. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section l. That Chapter 24 of the Code of Ordi- nances of the City of Paris, Paris, Texas, be amended so that such shall read as follows: "Chapter 24. PLUMBING AND GAS CODES Article I. PLUMBING CODE Section 24-1. Adopted For the purpose of esrablishing rules and regulations for the ir_stallation, alteration or repair of pipes, fitting ard fixtures for water, «nd sewer in all buildings and structures and on all property now erected or to be erected, changed, constructed, reconstructed, repaired or altered in the City of Paris, Texas, and outside the City of Paris, if same be connected to either the city water or sewage systems, and further regulating the construction, erection, enlarge- ment, alteration or repair of all piping, fittings, fixtures, etc., used for the conduction of water, sewage and in or on and about any and all preMises in. the City of Paris and outside the boundaries of the City of Paris if same be con- nected to either the city water or sewage systems, that certain plumbing code known as Standard Plumbing Code, 1982 Edition, save and except such portions as are deleted, modified or amended by this article, is hereby adopted and incorporated as fully as if set out at length herein. A copy of such Code has been and is now on file in the office of the City Clerk and the provisions thereof shall be controlling as above stated. Section 24-2. Amendments. The Standard Plumbing Code, 1982 Edition, as adopted is hereby amended by adding the following paragraphs thereto: 104.1.1. Persons who may obtain a permit. Plumbing permits may be obtained by the following : (a) Any person having a current Master Plumber License issued by the Texas State Board of Plumbing Exar:liners. (b) Any person for plumbing work to be done by that persor. in a buildir.g owned and occupied by that person as a. homestead. (c) Any appliance dealer or employee of an appliance dealer who is acting as an appliance insta.llatior_ or service r-ian in connecting appliances to existing piping installations. 105.3. Permits not transferable. Each permit issued under this Code shall be personal to the Permittee. No such permit shall be assigned or transferred to another person and no person shall permit another person to obtain a permit in his name or perMit any plumbing or gas fitting work to be performed under his permit by any person other than a person authorized to do the same. 105.4. False statement or bad faith. Any person who shall willfully make any false statement in order to obtain a permit shall be guilty of a r.misdemeanor and subject to the penalty provided herein. Bad faith or unreasonable delay in performance of plumbing work shall be deemed a sufficient reason for subjecting the plumber so offending to a susper_sion of the permit and no further perriit shall be issued until such act of bad faith or unreasonable delay has been corrected. Section 24-3. Section 1209.1 - Water Supply Control shall be changed to read as follows: An approved stop and waste shut off valve shall be installed in the water service pipe on the property side of the meter, adjacent to the city meter box. The valve shall be enclosed in a plastic valve box with a removable cover equipped with a cut off key. There shall be a six (6) foot r_linimum separation of the valve from any sewer cleary out plug. Section 24-4. Appendix H shall be changed to read as follows: Table of Fees: For issuing each permit $ 2.00 In addition: For each plumbing fixture or tr_ap or set of fixtures of one trap (including water and drainage piping) 1.50 For each house sewer 2.00 For each house sewer having to be replaced or repaired 2.00 For each water heater and/or vent 2.00 For each gas piping system of 1 to 5 outlets 3.00 For each gas piping system of 6 or more, per outlet 0.50 For irstallation of water piping for water treating equipment 2.00 Lawn sprinkler systern inspection for 5 sprinkler heads or less 2.00 Each additional sprinkler head over 5 0.25 For reinspection 10.00 That the above table of fees shall apply in the event that application for permit is made prior to the beginning ef any plumbing work requiring a permit. That in the event any pluMb- ing work requiring a permit is commenced without having procured a permit, as provided herein, then there shall be a fee, in addition to the above table of fees, of $20.00 per day for each day delayed in procuring said permit." Section 24-5. Penalty. Section 110 of the Standard Plumbing Code, 1982 Edition, is amended to read as follows: Any person, firLn or corporation or agent who shall violate a provision of this code or fail to comply therewith or with any of the provisions thereof, or violate a detailed statemer_t or plan submitted and approved thereunder shall be guilty of a Class C misdemeanor, and upon conviction shall be fined in any sum not to exceed $1,000.00 and each and every days continuance of any vio- lation ef the Standard Plumbing Code, 1982 Edition or Chapter 24 of the Code of Ordinances of the City of Paris shall constitute and be deemed a separate offense. Section 2. Any person violating any of the pro- visions of this ordinance shall be guilty of a Class "C" Misdemeanor, and upon conviction shall be fined in any sum not to exceed $1,000.00, and each and every day's continu- ance of any violation of the above enumerated section shall constitute and be deerned a separate offense. Section 3. Al1 ordinances or parts of ordinances in conflict herewith ar.e hereby expressly repealed. Section 4. This ordinance shall become effective on February l, 1984.
