84-021 ORD SETTING DATE, TIME AND PLACE FOR PUBLIC HEARINGS BEFORE P&Z COMMISSION OF COP AND CITY COUNCIL ORDINANCE N0. 84-021 AN ORDINANCE SETTING A DATE, TIME AND PLACE FOR PUBLIC HEARINGS BEF(7RE THE PLAIINING AND ZONING COMMISSION OF THE CITY OF PARIS AND THE CITY COUNCIL OF THE CITY OF PARIS ON THE PROPOSED ANNEXATION OF CERTAIN PROPERTY BY THE CITY OF PARIS, PARIS, TEXAS, AND APPROPRIATE ZONING UPON ANrTEXATION, AND AUTHORIZING AND DIRECTING THE MAYOR TO PUBLISH NOTICE OF SUCH PUBLIC HEARINGS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section l. That public hea.rings be held by and before the Planning and Zoning commission of the City of Paris, Paris, Texas, on the 2nd day of April, 1984, at 7:00 o'clock p.m. in the Council Room, City hall, Paris, Texas; by and bPfore the City Council of the City of Paris, Paris, Texas, in Regular Session convened on the 5th day of April, 1984 at 5: i5 0' clock p.m. , in the Council Room, City Hall, paris, Texas and bv and before the City Council of the City of Paris, Texas, in Regular Session convened on the 9th day of April, 1984, at 7:00 o'clock p.m., in the Council Room, City Hall, Paris, Texas, giving all interested persons the right to appear and be heard on the proposed annexation and appropriate zonin.g upon annexatian of the following described property: Situated in Lamar County, Texas, being part of the Joseph Leach Survey No. 524, the Joshua Moore SurvPy No. 571, the Ed Crow Survey No. 208 and the John Guffey Survey No. 363 and being further ciescribed as follows: BEGINrIING at a point in the Nor_th boundary line of U. S. Highway No. 82 at its intersection with a Iine that is 600 feet east of and parallel to the centerline of the outside lane of Loop Highway 286 S. E., said point being in the present City Limit line of the City of Paris; THENCE in a Southeaster.ly direction with said line that is 600 feet east of and parallel to the outside land of Loop Highway 286 S. E., 2,000 feet more or less to a point in the North line of Lot 6, Block A of Morningside Estates; THENCE East, a distance of 0-08 feet more or less to the Northeast corner of said Lot 6, Block A of Morningside Estates; THEPdCE North 0° 26' East, a distarce of 628.5 feet to the Northwest corner of Lot 26, Block A of Morningside Estates; THENCE North 0° 20' West, a. distance of 619.5 feet to the northwest corr_er of a 19.607 acre tract of land conveyed H. Randall Grounds and A.T. Edzards, of record in. Volum.e 659, Page 892, of the Deed Records of Lamar county, Texas; THENCE South $9° 09' East, a distan.ce of 1,382.15 feet to the northeast corner of said 19.607 acre tract; said point being in the East line of the Joseph Leach Survey; THENCE North 0° 30'30" East with the east boundary line of said Leach Survey, a distance of 111.1 feet ta a point, said point being 500 feet South of the South boundary line of U. S. Highway No. 82; THENCE in an easterly direction with a line that is 500 feet South of and parallel to the South boundary line of U. S. Highway No. 82 to the most Northerly East boundary line of the Joshua Moore Survey; THENCE Northerly with the East boundary line of said Moore Survey, and the East boundary line of the John Guffey Survey, a distance of 1,120 feet to a point that is 500 feet north of the north boundary line of U. S. Highway No. 82; THENCE in a Westerly direction with a line that is 500 feet North of and parallel to the North boundary line of U. S. Highway No. 82 to its intersection with the East line of Block B of Sunrise Estates, said point also being in the center line of a creek that runs North and South ar.d said point also being in the present City Limit line of the City of Paris; THEr?CE in a Southerly direction along the centeriine of said creek, 530 feet more or less to a point in the North boundary line of U. S. Highway No. 82; THENCE Westerly with the North boundary line of U. S. Highway No. 82, a distance of 2,015 feet more or less to the place of beginning and con- taining 149 acres more or less. Section 2. That the Mayor of the City of Paris, Paris, Texas, is hereby authorized and directed to cause notice of such public hearings to be published once in ths newspaper having general circulation in the City and in the above described territory not m.ore that twenty (20) days nor less than ten (10) days prior to the date of such public hearings, all in accordance with the Municipal Annexation Act (Chapter 160, Acts of the 58th Legislature, Regular Session, 1963; compiled as Article 970a, Vernon's Texas Civil Statutes). Section 3. It is hereby declared to be the inten- tion of the City Council of the City of Paris that the sections, paragraphs, senten.ces, clauses and phrases of this ordinance are severable, and it any phrase, clause, sen- tence, paragraph or section of this ordinance shall be declared unconstitutional or invalid by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality or invalidity shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the city Council without the incorporation in this ordinance of any unconstitutional or invalid phrases, clauses, sentences, paragraphs or sections. It is further hereby declared to be the intention of the City Council of the City of Paris to exclude any area or areas described in the description of the property to be annexed, which are not within said City's jurisdiction to annex and that such area or areas should be carved out of the description of the property herein described by the valid judgment or decree of a.ny court of competent jurisdiction, in order that such area or areas would not cause this annexation ordinance to be found to be invalid, voidable or void.
