84-061 ORD PROVIDING CODE OF ORDINANCES BE AMENDED BY REVISING SECTION 31-3 SECTION 31-18 (a) AND (b) ORDINANCE N0. 84-061 AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF PARIS, BE AMENDED BY REVISING SECTION 31-3, SECTION 31-18 (a) AND (b); SECTION 31-19, SECTION 31-20, SECTION 31-24 (a) AND SECTION 31-29 OF SAID CODE; PROVIDING FOR THE REVISION OF THE WATER AND SEWER RATES AND SERVICE CHARGES; PROVIDING FOR Ar1 EXCESSIVE STRENGTH SEWAGE CHARGE FOR BOD, SUSPENDED SOLIDS, AND AMMONIA STRENGTH; PROVIDING FOR A PENALTY NOT TO EXCEED $200.00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATES OF JULY l, 1984 AND SEPTEMBER 10, 1984. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section l. That sub-paragraphs (a) and (b) of Section 31-18 of the Code of Ordinances of the City of Paris, Par.is, Texas, be amended so that such shall read as follows: "Sec. 31-18. Water rates. (a) Charges for water furnished by the city are hereby fixed at the following rates per cubic foot per month, for both domestic and commercial users, as registPred by the user's water meter: Cubic Feet of Water Used per Month Rate p $2.15 minimum bill, no water (5/8" meter) First 200 $1.61, per 100 c.f. Next 400 1.36, per 100 c.f. Next 1,900 1.07, per 100 c.f. Next 17,500 0.73, per 100 c.f. Next 80,000 0.48, per 100 c.f. Next 200,000 0.36, per 100 c.f. Next 700,000 0.31, per 100 c.f. Al1 over 1,000,000 0.29, per 100 c.f. That Section 31.19 of the Code of Ordinances of the City of Paris, Paris, Texas, be amended so that such shall read as follows: "Sec. 31-19. Sewer rates - For customers using city water. (a) Charges for sewer service furnished by the city to domestic and commercial customers who are also users of city water are hereby fixed at eighty (80) percent of the monthly charge for water based on the water used, as registered by the user's water meter. (b) The minimum monthly charge under sub- section (a) above sha11 be one dollar and seventy-two cents ($1.72). (c) The charge for sewer service for a single-family residence shall not exceed seventeen dollars ($17.00) per month, regardlPSS of inetered water consumption. (d) Users desiring to discharge sewage exceeds two hundred fifty (250) parts per million BOD; two hundred fif.ty (250) parts per milli_on of suspended solids or 30 parts per million of ammonia, and which is acceptable under Article 3 of this chapter, may do so upon written permission of the city and by paying a monthly treatment surcharge in the amount of $0.7339 per one million (1,000,000) gallons of sewage flow for each one part per million in excess of the allowable BOD; $0.5712 per one million (1,000,000) gallons of sewage flow for each one part per million in excess of the allowable suspended solids and $2.36 per one million (1,000,000) gallons of sewage flow for each one part per million in excess of the allowable ammonia strength. The city shall make the necessary tests of the user's sewage strength to determine this charge. The charge prescribed by this subsection shall be in addition to the charges prescribed in subsection (a)." Section 3. That Section 31-20 of the Code of Ordinances of the City of Paris, Paris, Texas, be amended so that such shall read as follows: "Sec. 31-20. Same - For customers r_ot using city water. Single-family residence sewerage customers, who are not also water customers of the city, shall pay a flat rate charge of seventeen dollars ($17.00) per month for sewerage service. All other sewerage customers, who are not also water users of the city, shall pay a flat monthly rate to be determined by the city manager." Section 4. That sub-paragraph (a) of Section 31-24 of the Code of Ordinances of the City of Paris, Paris, Texas, be amended so that such shall read as follows: "Sec. 31-24. Ileposit to assure payment. (a) Each purchaser or consumer of city water shall, at the time of making application for water service, make a deposit, with the division, in the following amount: (1) Resident consumers and business or commercial users, wherein water is not a part of their business operations, $35.00. (2) Cafes, restaurants and other similar businesses, $75.00. (3) Service stations, car washers and laundries, $200.00. (4) Tourist courts, hotels and motels $200.00. (5) Apartment houses, $50.00 for the first two (2) units and $20.00 for each additional unit, not to exceed a total of $250.00. Section 5. That Section 31-29 of the Code of Ordir_ances of the City of Paris, Paris, Texas, be amended so that such shall read as f_ollows: "Sec. 31-29. Disconnection or reconnection service charge. When it becomes necessary for the water department of the City of Paris to disconnect or reconnect water service the following schedule of charges shall apply: Schedule Charge 8 a.m, to 5 p.m., Monday through Friday $10.00 5 p.m. to 8 a.m., Monday through Frid.ay $20.00 Saturdays, Sundays and Holidays $20.00 There shall be no charge for temporary service to a building site; however, at the time of transfer from temporary ser.vice to permanent service, the above charge will be made." Section 6. Any person violating any of the pro- visions of this ordinance shall be guilty of a Class "C" Misdemeanor, and upon conviction shall be fined in any sum not to exceed $200.00, and each and every day's continuance of any violation of the above enumerated section shall constitute and be deemed a separate offense. Section 7. All ordinances or parts of ordinances in conflict herewith are her.eby expressly repealed. Section 8. The effective date of the amendment to Section 31-19(d) became effective on the lst day of July, 1984, as established in Ordinance No. 84-046.
