AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS,
PROVIDING THAT THE CODE OF ORDINANCES, CITY OF PARIS, BE
AMENDED BY REVISING SECTION 28-11 AND SECTION 28-12 OF SAID
CODE; PROVIDING THAT THE HOTEL OCCUPANCY TAX BE INCREASED TO
SEVEN (7) PERCENT AND THAT THE USE OF REVENUE DERIVED FRONI
SAME BE EXPENDED IN ACCORDANCE WITH STATE LAW; PROVIDING FOR
A PENALTY NOT TO EXCEED $200.00; REPEALING ALL ORDINANCES OR
PARTS OR ORDINANCES IN CONFLICT HEREWITH; AND PROVZDING FOR
AN EFFECTIVE DATE OF OCTOBER l, 1984.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PARIS:
Section 1. That Section 28-11 of the Code of Ordinances
of the City of Paris, Paris, Texas, be amended so that such
shall read as follows:
"Section 28-11. Tax I,evied.
(a) There is hereby imposed and levied a tax
upon the occupant of any xoom or space furnished
by any hotel where the cost of occupancy is at the
rate of two dallars ($2.00) or more per day, such
tax to be equal to seven (7) percent of the
consideration paid by any such occupant of any
such room or space in any such hotel, exclusive of
other occupancy taxes imposed by other units of
government.
(b) A portion of the Tax revenue derived
from the levy herein equal to at least one (1)
percent of the cost of the occupancy of hotel
rooms, shall be used for the purpose of advertis-
ing and conducting solicitation programs to
acquaint potential users with public meetings and
convention facilities, and for promotion of
tourism and advertising of the City and its
vicinity either by the City or through contract
with persons or organizations selected by the
City.
(c) All of the tax revenue derived from the
levv herein in excess of four (4%) percent may
only be used for the purposes enumerated in
sub-paragraphs (a) (b) and (c) of Section 28-12 of
the Code of Ordinances of the City of Paris.
(d) No more than one (l%) percent of the
consideration paid by an occupant of an hotel or
motel room may be spent on the arts as authorized
by sub-paragraph (d) of Section 28-12 of the Code
of Ordinances of the City af Paris."
Section 2. That sub-paragraph (e) of Section 2$-12
of the code of Ordinances of the City of Paris, Paris,
Texas, be amended so that such shall read as follows:
"Section 28-12. Use of revenue limited.
(e) historical preservation and restoration
projects or activities at or in the immediate
vicinity of convention center facilities or
historical preservation and restoration projects
or activities located elsewhere in the City that
would be frequented by tourist or visitors to the
City."
Section 3. Any person violating any of the provisions
of this ordinance shall be guilty of a Class "C" Mis-
demeanor, and upon conviction shall be fined in any sum not
to exceed $200.00, and each and every day's continuance of
any violation of the above enumerated section shall consti-
tute and be deemed a separate offense.
Section 4. All ordinances or parts of ordinances
in conflict herewith are hereby expressly repealed.
Section 5. This ordinance shall become effective
on October 1, 1984.
