83-026 ORD PROVIDING CODE OF ORDINANCES BE AMENDED BY REVISING SECTION 12-12 OF SAID CODE ORDINANCE N0. 83-026 AN ORDINANCE OF THE CITY OF YARIS, PARIS, TEXAS, PROVIDING THAT THE CODE OF ORDIPdANCES, CITY OF PARIS, BE AMENDED BY REVISING SECTION 12-12 OF SAID CODE; PROVIDING FOR A PERMITTING PROCEDURE FOR OUTSIDE FIRES; PROVIDING FOR A PENALTY NOT TO EXCEED $200.00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IP1 CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF JUNE l, 1983. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section 1. That Section 12-12 of the Code of Ordinances of the City of Paris, Paris, Texas, be amended so that such shall read as follows: "Sec. 12-12.1 Outside Fires and Perr.iits for Same. "(a). It shall be unlawful for any person to burn trash, brush, grass, leaves, paper, cloth, trees, boards, planks, lumber or any other charac- ter of debris or inflammable material whatsoever out of doors in the City of Paris unless the same is contained in a fireproof container with a top that prevents the escape of sparks or cinders, unless such person has procured through the fire chief or his designee a permit permitting such burning. "(b). Outside burning permits shall be issued by the fire chief or his designee. A fee of $50.00 shall accompany any request for burning permit, such fee shall cover the inspection of the area and the material to be burned. In the event a permit is issued, it will subject to the requirements composed therein and all cost in meeting such requirements shall be born by the person requesting the permit. The requirements may include but are not limited to firelanes, civilian or fireman century watches, burn pits, extinguishing agents, the laying of firehose or the presence of other firefighting equipment. Any requirement for firefighting equipment or personnel of the City of Paris will be charged to and paid for by the permittee. The fire chief or his designee shall consider humidity, permissible wind conditions, susceptibility of vegetation to combustion, the proximity of residences and other structures, composition of material to be burned, smoke, heat and duration of burn. "Sec 12-12.2. Pluisance Fires. It shall be unlawful for any person or firm to burn any trash, rubbish, garbage or animal matter in such a manner as to create a foul and offensive odor of such extent to be detected on any adjoining property. "Sec 12-12.3. Open Flame Torches It shall be unlawful for any person to install, erect or maintain any open flame torch on any premises within the corporate limits of the City of Paris unless a permit is obtained for the installation of erection of such torch. Before beginning installation or erection of any open flame torch in the city, an applicant must submit a written request to the office of the fire marshal and include a plot plan showing the location of torches and their proximity to build- ings, vegetation and other combustibles, drive- ways, parking areas, streets and walkways. Cutaway drawings of the devise and the method of installation must also be submitted. All torch devices proposed to be installed must bear the seal of approval of the American Gas Association or other nationally recognized safety testing laboratories. If, after due consideration of the above items, a permit is issued, the installation must be made under the following conditions: (1) No combustibles, including shrubbery, shall be located within then (10) feet of the open flame. (2) A regulated orifice shall be placed within the supply line of each torch of such size to prevent a flame of over eighteen (18) inches in height above the burner outlet when the valve is fully open. (3) Gas shall be delivered to the device at a pressure not greater than the pressure normally provided for residential installations. (4) The height of the bottom of the burner of the torch shall be at least eight (8) feet above the adjacent ground level. (5) Torches adjacent to streets, parking areas, driveways, or walkways shall be curbed or otherwise barricaded to prevent mechanical damage. (6) Torches shall not be located closer than ten (10) feet to any street parking area, driveways or walkways. (7) Torches shall not be installed closer than ten (10) feet to any building or combustible material. (8) Installations shall be made in keeping with the regulations of the plumbing division of the City of Paris." Section 2. Any person violating any of the pro- visions of this ordinance shall be guilty of a Class "C" Misdemeanor, and upon conviction shall be fined in any sum not to exceed $200.00, and each and every day's continuance of any violation of the above enumerated section shall constitute and be deemed a separate offense. Section 3. All ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. Section 4. This ordinance shall become effective on June 1, 1983.
