83-059 ORD SETTING DATE, TIME AND PLACE FOR PUBLIC HEARINGS BEFORE P&Z COMMISSION OF COP AND CITY COUNCIL CRDINANCE NO. 83-059 AN ORDINANCE SETTING A DATE, TIME AND PLACE FOR PUBLIC HEARINGS BEFORE THE PLANNING AND ZONING COMMISSION OF THE CITY OF PARIS AND THE CITY COUNCIL OF THE CITY OF PARIS ON THE PROPOSED ANNEXATION OF CERTAIN PROPERTY BY THE CITY OF PARIS, PARIS, TEXAS, AND APPROPRIATE ZONING UPON ANNEXATION, AND AUTHORIZING AND DIRECTING THE MAYOR TO PUBLISH NOTICE OF SUCH PUBLIC HEARINGS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section l. That public hearings be held by and before the Planning and Zoning commission ot the City of Paris, Paris, Texas, on the 3rd day of October, 1983, at 7:00 o'clock p.m, in the Council Room, City Hall, Paris, Texas; and by and before the City Council of the City of Paris, Paris, Texas, in Regular Session convened on the 17th day of October, 1983, at 7:00 o'clock p.m., in the Council Room, City Hall, Paris, 'I'exas, giving all interested persons the right to appear and be heard on the proposed annexation and appropriate zoning upon annexation of the following described property: Situated about 3 miles East from the City of Paris, County of Lamar and State of Texas, a part of the Joseph Leach Survey, Abstract No. 524, and being part of a 34.34 acre tract of land described as Third tract in Deed of Trust Records in Volume 108, Page 165 of the! Deed of Trust Records of said County and State, which is a part of the same land described in a Deed from Charles Manton et ux to S. E. Smith on January l, 1902, of record in Volume 102, Page 464, and the land conveyed S. E. Smith by J. G. Marshall, January 18, 1902, of record in Volume 103, Page 6, of said Deed Records of said County and State, and being turther described as follows: BEGINNING at an iron pin for corner in the East Boundary line of said Leach Survey, situated South 00 30' 30" West with the East Boundary Line ot said Leach Survey a distance of 611.1 feet from the Northeast corner of said 34.34 acre tract, same being in the South Boundary Line of U. S. Highway 82; THENCE South 01 31' 30" West, with the East Boundary Line of said Leach Survey, a distance of 619.5 feet, a fence post for corner; THENCE North 89° 46' West a distance of 176.37 feet to a concrete monument for corner, the Northeast corner of Morningside Estates, Part 10, as shown by Plat that is duly recorded in the Plat Records of said county and State; THENCE North 88° 49' West a distance of 248.6 feet to a concrete monument for corner; THENCE North 89° 07' West a distance of 947.83 feet to an iron pin for corner, the North- west corner of said Morningside Estates, Part 10; THENCE North 0° 20' West a distance of 619.5 teet, an iron pin for corner; THENCE South 89° 09' East a distance oi 1382.15 feet to the place of beginning and con- taining 19.607 acres of land, more or less. Section 2. That the Mayor of the City of Paris, Paris, Texas, is hereby authorized and directed to cause notice of such public hearings to be published once in the newspaper having general circulation in the City and in the above described territory not more that twenty (20) days nor less than ten (10) days prior to the date of such public hearings, all in accordance with the Municipal Annexation Act (Chapter 160, Acts of the 58th Legislature, Regular Session, 1963; compiled as Article 970a, Vernon's Texas Civil Statutes). Section 3. It is hereby declared to be the inten- tion of the City Council of the City of Paris that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sen- tence, paragraph or section of this ordinance shall be declared unconstitutional or invalid by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality or invalidity shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the city Council without the incorporation in this ordinance of any unconstitutional or invalid phrases, clauses, sentences, paragraphs or sections. It is further hereby declared to be the intention ot the City Council of the City ot Paris to exclude any area or areas described in the description of the property to be annexed, which are not within said City's jurisdiction to annex and that such area or areas should be carved out of the description of the property herein described by the valid judgment or decree of any court of competent jurisdiction, in order that such area or areas would not cause this annexation ordinance to be found to be invalid, voidable or void.
