2609 ORD SETTING DATE, TIME AND PLACE FOR PUBLIC HEARINGS BEFORE P&Z COMMISSION OF COP AND CITY COUNCIL ORDINANCE N0. 2609 AN ORDINANCE SETTING A DATE, TIME AND PLACE FOR PUBLIC HEARINGS BEFORE THE PLANNING AND ZONING COMMISSION OF THE CITY OF PARIS AND THE CITY COUNCIL OF THE CITY OF PARIS ON THE PROPOSED ANNEXATION OF CERTAIN PROPERTY BY THE CITY OF PARIS, TEXASAND,DIRECTINGAND AND AUTHORIZ SUCH PUBLIC HEARINGS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section l. That public hearings be held by and before Paris, the Planning and Zoning Commission of the City of Paris, Texas, on the lst day of March, 1982, at 7:00 o'clock P. M., in the Council Room, City Hall, Paris, Texas; and by and Paris, Texas, before the City Council of the City of Paris, in Special Session convened on the lst day of March, 1982, at 6:00 o'clock P. M., at Montgomery's Exxon Service Station, Highway 82 :•7est, Route 5, Paris, Texas; and by and before the City Council of the City of Paris, Paris, Texas, in Regular Session convened on the 8th day of March, 1982, at 7:00 o'clock P. M., in the Council Room, City Hall, Paris, Texas, giving all interested persons the right to appear and be heard on the proposed annexation and appropriate zoning upon annexation of the following described property: Situated in the County of Lamar and State of Texas, a part of the Isaac Cruse Survey and being more particularly described as follows: BEGINNING at a point in the South Right-of-way of U. S. Highiaay No. 82, said point being in the tiaest City Limit Line of the City of Paris, Texas, said point being West, a distance of 92 feet from the Northeast corner of an 18 acre tract of land out of the Isaac Cruse Survey, conveyed to James L. led BrockwaY and 5wife, Pagee356f1Deed March 7, 1957, re Records, Lamar County, Texas; THENCE along the South Right-of-way of U. S. Highway No. 82, West, a distance of 777.2 feet to a point, said point being the Northwest Corner of an 18 acre tract of land conveyed Curtis McDaniels and wife, Kay McDaniels, by deed filed June 23, 1980, re- corded in Volume 625, Page 930, Deed Records, Lamar County, Texas; THENCE South along the West Boundary Line of said McDaniels 18 acre tract of land, a distance of 504 feet to a point; THENCE East parallel with the South Right-of-way of U. S. Highway No. 82, a distance of 777,2 feet to a point in the West City Limit Line of the City of Paris; THENCE North along the existing city limit line of the City of Paris, a distance of 504 feet to the place of beginning and containing 8.99 acres of land more or less. Section 2. That the Mayor of the City of Paris, Paris, Texas, is hereby authorized and directed to cause notice of such public hearings to be publislied once in the newspaper having general circulation in the City and in the above de- scribed territory not more than twenty (20) days nor less than ten (10) days prior to the date of such public hear- ings, all in accordance with the Municipal Annexation Act (Chapter 160, Acts of the 58th Legislature, Regular Session, 1963; compiled as Article 970a, Vernon's Texas Civil Statutes). Section 3. It is hereby declared to be the intention of the City Council of the City of Paris that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, para- graph or section of this ordinance shall be declared un- constitutional or invalid by the valid judgment or decree of any court of competent jurisdiction, such unconstitution- ality or invalidity shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any unconstitutional or invalid phrases, clauses, sentences, paragraphs or sections. It is further hereby declared to be the intention of the City Council of the City of Paris to exclude any area or areas described in the de- scription of the property to be annexed, which are not within said City's jurisdiction to annex and that such area or areas should be carved out of the description of the property herein described by the valid judgment or decree of any court of competent jurisdiction, in order that such area or areas would not cause this annexation ordinance to be found to be invalid, voidable or void.
