AN ORDINANCE SETTING A DATE, TIME AND PLACE FOR PUBLIC
HEARIPIGS BEFORE THE PLANNING AND ZONING COMMISSION ON THE
CITY OF PARIS AND THE CITY COUNCIL OF THE CITY OF PARIS Oi1
THf", PROPOSED ANNEXATION OF CERTAIN P ROPERTY BY THE CITY OF
PARIS, PARIS, TEXAS, AND APPROPRIATE ZONING UPON ANNEXATION,
AND AUTHORIZING AND DIRECTING THE MAYOR TO PUBLISH NOTICE OF
SUCH PUBLIC HEARINGS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS:
Section l. That public hearings be held by and before
the Planning and Zoning Commission of the City of Paris,
Paris, Texas, on the 6th day of July, 1982 at 7:00 o'clock P.M.,
in the Council Room, City Hall, Paris, Texas; and by and
before the City Council of the City of Paris, Paris, Texas,
in Special Session convened on the 6th day of July, 1982,
at 6:00 o'clock P.M., on property 250 feet East of Fashions
of Paris at the North boundary of Stone Ave, Paris, Texas;
and by and before the City Council of the City of Paris,
Paris, Texas, in Regular Session convened on the 12th day of
July, 1982, at 7:00 o'clock P.M. in the Council Room, City Hall,
Paris, Texas, giving all interested persons the right to appear
and be heard on the proposed annexation and appropriate zoning
upon annexation of the following described property:
A tract of land situated in Lamar County, Texas
being part of the Reddin Russell Survey #786, and
being part of the 94.07 acre tract of land willed
to Estelle Council and being shown in an Affidavit
as recorded in Volume 305, Page 455, Deed Records
of said county and state, and further described as
follows:
BEGINNING at the intersection of the North line
of Stone Ave, in the City of Paris and the East
Right-of--way of ~S Highway 271;
THENCE S 85 51' E, 215.0 feet along the North
line of Stone Ave. to the true point of beginning
of the tract herein described;
THENCE continue along said North line S 85°51'E,
127.7 feet to a PI in said North line;
THENCE continuing with said North line S 59°40E,
1256 feet more or less, to the Western most corner of
a tract conveyed to the Powderly-Reno Consolidated ISC
by deed recorded in Volume 459, Page 163, Deed Recordsd
THENCE along the West line of said property, N 30
20'E, 528 feet to the Northern most corner of said tract;
THENCE North, 718.7 feet along the West line of a
tract of land conveyed to said ISD by deed recorded in
Volume 436, Page 14 to the Northwest corner of said tract;
THENCE N 76°12' W, 1449.3 feet more or less, to the
Southeast corner of a tract conveyed to the North Paris
Baptist Church by deed recorded in Volume 571, Page 551;
THENCE with the South line of said church property
N 89°31'W, 370.1 feet to said R-O-W of Highway 271;
THENCE along a curve to the SE having a radius
of 11,434 feet, a distance of 552.9 feet to the
Southwest corner of a tract conveyed to Abbcos, Inc.
by deed recorded in Volume 631, Page 291;
THENCE along the South line of said Abbcos Tract,
5 85°E, 250 feet to the Southeast corner of said
Abbcos tract;
THENCE S 40 21'E, 325 feet along the current City
Limits line to the point of beginning containing 38.7 acres.
Section 2. That the Mayor of the City of Paris, Paris,
Texas, is hereby authorized and directed to cause notice of
such public hearings to be published once in the newspaper
having general circulation in the City and in the above de-
scribed territory not more than ten (10) days prior to the
date of such public hearings, all in accordance with the
Municipal Annexation Act (Chapter 160, Acts of the 58th
Legislature, Regular Session, 1963; compiled as Article 970a,
Vernon's Texas Civil Statutes).
Section 3. It is hereby declared to be the intention
of the City Council of the City of Paris that the sections,
paragraphs, sentences, clauses and phrases of this ordinance
are severable, and if any phrase, clause, sentence, para-
graph or section of this ordinance shall be declared un-
constitutional or invalid by the valid judgment or decree
of any court of competent jurisdiction, such unconstitution-
ality or invalidity shall not affect any of the remaining
phrases, clauses, sentences, paragraphs and section of
this ordinance, since the same would have been enacted by
the City Council without the incorporation in this ordinance
of any unconstitutional or invalid phrases, clauses, sentences
paragraphs or sections. It is further hereby declared to be
the intention of the City Council of the City of Paris to
exlude any area or areas described in the description of the
property to be annexed which are not within
said City's jurisdiction to annex and that such area or
areas should be carved out of the description of the property
herein described by the valid judgment or decree of any court
of competent jurisdiction, in order that such area or areas
would not cause this annexation ordinance to be found to be
invalid, voidable or void.
Section 4. This ordinance shall take effect immediately
upon passage.
