AN ORDINANCE FIXING I'HE DATE FOR A PUBLIC HEARING
ON PROPERTY ON 7TH STREET, N. W., FROM THE NORTH
BOUNDARY LINE OF BONHAM STREET TO THE SOUTH BOUNDARY
LINE OF GRAHAM STREET, IN THE CITY OF PARIS, TEXAS; DI-
RECTING THE CITY CLERK OF THE CITY OF PARIS TO PUBLISH
THE SAME THREE (3) TIMES IN THE PARIS NEWS AS REQUIRED
BY LAW; APPROVING AND ACCEPTING THE FINAL ESTIMATE OF
COSTS AND CONSTRUCTION PLANS OF SUCH STREET IMPROVE-
MENTS AS FILED BY THE DIRECTOR OF PUBLIC WORKS OF THE
CITY OF PARIS; FIXING THE CHARGES TO BE ASSESSED AGAINST
THE ABUTTING PROPERTY OWNERS AND THE CHARGES TO BE
PAID BY THE CITY OF PARIS; AND WITH THE INTENTION OF
FIXING A CHARGE AND LIEN AGAINST THE REAL AND TRUE
OWNERS OF SAID PROPERTY AND AGAINST THE SAID PROPERTY
ITSELF.
WHEREAS, the City Council of the City of Paris, Paris, Texas,
hereby finds and determines:
1. That the City Council of the City of Paris, Paris, Texas,
has heretofore by ordinance duly enacted on the 14th day
of January, 1980, determined the necessity for and or-
dered the improvement of 7th Street, N. W. , from the
North Boundary Line of Bonham Street to the South
Boundary Line of Graham Street, by grading, construc-
tion of storm sewers, drainage inlets, driveway ap-
proaches and pavement with curb and gutter, and other
related work, according to the plans and specifications
prepared by Hayter Engineering, Inc.
2. That a notice duly executed in the name of the City of
Paris, Paris, Texas, of the enactment of said above
described ordinance has heretofore been filed with the
County Clerk of Lamar County, Texas, the County in
which said City of Paris is situated.
3. That the City Council has caused the Director of Public
Works to prepare and file estimates of the costs of
such improvements and estimates of the amounts per
front foot to be assessed against the property abutting
said street within the limits defined and the real and
true owners thereof; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PA R IS:
Section 1. That the date for public hearing before the City
Council of the abutting property owners on the above descr.ibed
property fs hereby fixed at 7:00 o'clock P. M. , in the City Council
Room, City Hall, Paris, Texas, on the 8th day of December, 1980.
The City Clerk is hereby directed to publish in the Paris News,
notice of the public hearing three (3) times pr.ior to said public
hearing, the first of said notices to be published at least
twenty-one (21) days prior to the date of the public hearing, as
required by law.
Section 2. That the report to the City Council by the
Director of Public Works, consisting of the final estimate of the
costs of the improvements to the abutting property owners of
approximately $5.00 per front foot for curb and gutter, plus
any additional costs to extend driveways and other improvements
to individual property as requested by property owners, as here-
tofore approved, and the final construction pla.ns and final
estimate, as prepared by said Director of Public Works, are in
all things approved by the City Council of the City of Paris.
?hat the City of Paris is to pay all of the costs of drainage
installation, excavation, base preparation and paving, curb and
gutter within intersections and other appurtenances, in the
amount of $129, 516. 73, and the abutting property owners
are to pay the remaining costs of $8, 391. 80 for curb and
gutter and driveways.
Section 3. That it is the intention of the City Council to
assess the abutting property owners and to fix a lien against the
abutting property, as provided for and under the terms and pro-
visions of Chapter 106 of the Acts of the First Called Session oE
the 40th Legislature of the State of Texas, now designated as
Article 1105b, Vernon's Texas Civil Statutes, under which law
these proceedings were taken and had.
Section 4. This ordinance shall become effective immediately
upon passage.
Passed and adopted by the City Council of the City of Paris,
in regular session convened, on this the lOth day of November,
1980.
