2540 ORD FIXING DATE FOR PUBLIC HEARING ON PROPERTY ON PINE MILL ROAD FROM NW CORNER OF LOT 11 CITY BLOCK 294 ORDINANCE NO. 2540 , AN ORDINANCE FIXING THE DATE FOR A PUBLIC HEARING ON PROPERTY ON PINE MILL ROAD FROM THE N. W. CORNER OF LOT 11, CITY BLOCK 294, FROM A POINT IMMEDIATELY NORTH OF THE SAID CORNER IN THE NORTH RIGHT-OF-WAY LINE OF PINE MILL ROAD, EAST TO THE WEST RIGHT-OF-WAY LINE OF LOOP 286 N. E., BEING THE N. E. CORNER OF LOT 26, CITY BLOCK 296 AND THE S. E. CORNER OF LOT 12, CITY BLOCK 316, IN THE CITY OF PARIS, TEXAS; DIRECTING THE CITY CLERK OF THE CITY OF PARIS TO PUBLISH THE SAME THREE (3) TIMES IN THE PARIS NEWS AS REQUIRED BY LAW; APPROVING AND AC- CEPTING THE FINAL ESTIMATE OF COSTS AND CONSTRUCTION PLANS OF SUCH STREET IMPROVEMENTS AS FILED BY THE DIRECTOR OF PUBLIC WORKS OF THE CITY OF PARIS; FIXING THE CHARGES TO BE ASSESSED AGAINST THE ABUTTING PRO- PERTY OWNERS AND THE CHARGES TO BE PAID BY THE CITY OF PARIS; AND WITH THE INTENTION OF FIXING A CHA RGE AND LIEN AGAINST THE REAL AND TRUE OWNERS OF SAID PROPERTY AND AGAINST THE SAID PROPERTY ITSELF. WHEREAS, the City Council of the City oE Paris, Paris, Texas, hereby finds and determines: 1. That the City Council of the City of Paris, Paris, Texas, has heretofore by ordinance duly enacted on the 18th day of June, 1979, determined the necessity for and ordered the improvement of Pine Mill Road from the N. W. corner of Lot 11, City Block 294, from a point imme- diately North of the said corner in the North Right-of- Way Line of Pine Mill Road, East to the West Right-of- Way Line of Loop 286 N. E. , being the N. E. corner of Lot 26, City Block 296 and the S. E. corner of Lot 12, City Block 316, by grading, construction of underground drainage facilities, curb and gutter, pavement, replace- ment of inadequate water mains and other appurtenances, according to the plans and specifications prepared by Hayter Engineering, Inc. 2. That a notice duly executed in the name of the City of Paris, Paris, Texas, of the enactment of said above described ordinance has heretofore been filed with the County Clerk of Lamar County, Texas, the County in which said City of Paris is situated. 3. That the City Council has caused the Director of Public Works to prepare and file estimates of the costs of such improvements and estimates of the amounts per front foot to be assessed against the property abutting said street within the limits defined and the real and true owners thereof; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section l. That the date for public hearing before the City Council of the abutting property owners on the above described property is hereby fixed at 7:00 o'clock P. M. , in the City Council Room, City Hall, Paris, Texas, on the 8th day of December, 1980. The City Clerk is hereby directed to publish in the Paris News, notice of the public hearing three (3) times prior to said public hearing, the first of said notices to be published at least twenty-one (21) days prior to the date of the public hearing, as required by law. Section 2. That the report to the City Council by the Director of Public Works, consisting of the final estimate of the costs of the improvements to the abutting property owners of approximately $5. 00 per front foot for curb and gutter, plus any additional costs to extend driveways and other improvements to individual property as requested by property owners, as heretofore approved, and the final construction plans and final estimate, as prepared by said Director of Public Works, are in all things ap- proved by the City Council of the City of Paris. That the City of Paris is to pay all of the costs of drainage installation, excavation, base preparation and paving, curb and gutter within intersections, repair and replacement of utilities disturbed by the street con- struction and other appurtenances, in the amount of $308, 232. 30, and the abutting property owners are to pay the remaining costs of $36, 767. 70 for curb and gutter and driveways. Section 3. That it is the intention of the City Council to assess the abutting property owners and to Eix a lien against the abutting property, as provided for and under the terms and pro- visions of Chapter 106 of the Acts of the First Called Session of the 40th Legislature oE the State of Texas, now designated as Article 1105b, Vernon' s Texas Civil Statutes, under which law these proceedings were taken and had. Section 4. This ordinance shall become effective immediately upon passage.
