2551 ORD PROVIDING EXTENSION OF CERTAIN BOUNDARY LMIMTS OF COP AND ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 74.5 ACRES ORDINANCE N0, 2551 AN ORDINANCE PROVIDIIIG FOR THE EXTENSION OF CERTAIN BOUNDAR.Y LIMITS OF THE CITY OF PARIS, PARIS, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 74.5 ACRES, MORE OR LESS, WHICH IS LESS THAT3 TEN PER CENT (10%) OF THE TERRITORY INCLUDED WITHIN ITS PRESENT CITY LIMITS, WHICH SAITJ TERRITORY LIES ADJACENT TO AND ADJOINS THE PRE- SENT BOUNDARY LIMITS 0F THE CITY OF PARIS, PARIS, TEXAS. Whereas, a public hearing before the City Council of the City of Paris, Paris, Texas, where all interested per- sons were provided with an opportunity to be heard on the proposed annexation of the following described territory: Situated in the County of Lamar and State of Texas, a part of the Enoch Crow and the Joseph Leach Surveys, and being mor.e particularly described as follows: BEGINNING at a point in the present city limit line of the City of Paris, said point being in the South Boundary Line of Pine Mill Road and being at the point of intersection of a line that is 600 feet East of and parallel to the center line of the out- side lane of Loop 286 N. E.; THENCE in a Southerly direction with said city limit line and the lin.e which is 600 feet East of and parallel to the center line of the outside lane of Loop 286 N. E. approximatPly 1,520 feet to the rlorth Right-of-Way line of U. S. Highway 32 East; THENCE in an Easterly direction with said North Right-of-Way line approximately 2,015 feet to the center of a creek *,ahich flows South; THLNCE in a Northerly and Northwesterly di- rection with the rneanders of the center of said creek approximately 2,100 feet to the North prop- erty line of a tract of land conveyed to Roy L. Williamson by G. L. Skidmore by deed recorded in Book 492, Page 53, Deed Records, Lamar County, Texas; THENCE South 89 Deg. 57 Min. West to the South Boundary Line of Pine Mill Road, the same being the present city limit line of the City of Paris; THENCE Westerly with said South Boundary Line of Pine i1i11 Road approximately 1,500 feet to the place of beginning and con.taining 74.5 acres, more or less. was held at Paris, Texas, on the lOth day of November, 1980, which date is not more than twenty nor less than ten days prior to the institution of annexation proceedings; and, WHEREAS, notice of such public hearing was published in a newspaper havir.g general circulation in the City of Paris, Texas, aizd in the above described territory, on the 25th day of October, 1980, which date is not more than twenty nor less than ten days prior to the date of such public hearing; and, WHEREAS, the total corporate area of the City of Paris, Paris, Texas, on the first day of January, 1980, was 14,026 acres; and, WHEREAS, the population of the City of Paris, Paris, Texas, is in excess of 5,000 and less than 25,000 inhabi- tants; and, W:iEREAS, the above described territory lies within the extraterritorial jurisdiction of the City of Paris, Paris, Texas; and, WHEREAS, the above described territory lies adjacent to and adjoins the City of Paris, Paris, Texas; and, WHE?tEAS, the above described territory contains 74.5 acres, more or less, which when added to other property annexed in the year 1980 is less than ten per cent (10%) of the present acreage contained in the corporate limits of the City of Paris, Texas; NOW, THEREFORE, BE IT ORDAINED BY THi CITY COUNCIL OF THE CITY 0F PARIS: Section l. The following described land and territory lying adjacent to and adjoining the City of Paris, Paris, Texas, is hereby added and annexed to the City of Paris, Paris, Texas, and said territory hereinafter described shall hereafter be included within the boundary liMits of the City of Paris, iexas, and the present boundary limits of said city, at the various points contiguous to the area herein- after described, are altered and amended so as to include said area within the corporate limits of the City of Paris, Texas, to-wit: Situated in the County of Lamar and State of Texas, a part of the Enoch Crow and the Joseph Leach Surveys, and being more particularly described as followsc BEGINNING at a point in the present city limit line of the City of Paris, said point being in the South Boundary Line of Pine Mill Road and being at the point of intersection of a line that is 600 feet East of and parallel to the center line of the out- side lane of Loop 286 N. E.; THENCE in a Southerly direction with said city limit line and the line which is 600 feet East of and parallel to the center line of the outside lane of Loop 286 N. E. approximately 1,520 feet to the North Right-of-Way line of U. S. Highway 82 East; THENCE in an Easterly direction with said North Right-of-Way line approximately 2,015 feet to the center of a creek which flows South; THENCE in a Northerly and Northwesterly di- rection with the Meanders of the center of said creek approximately 2,p00 feet to the North prop- erty line of a tract of land conveyed to Roy L. WilliaMSOn by G. L. Skidmore by deed recorded in Book 492, Page 53, Deed Records, Lamar County, Texas; THENCE South 89 Deg, 57 Min. West to the South Boundary Line of Pine Mill Road, the same being the present city limit line of the City of Paris; THENCE Westerly with said South Boundary Line of Pine Mill Road approximately 1,500 feet to the place of beginning and containing 74.5 acres, more or less. Section 2. The above described territory and area so annexed shall be a part of the City of Paris, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied by the City of Paris, Paris, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of a11 the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Paris, Paris, Texas. Section 3. It is hereby declared to be the intention of the City Council of the City of Paris that the sections, para- graphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional or invalid by the valid judhment or decree of any court of competent jurisdiction, such unconstitutionality or invalidity shall not affect any of the remaining phrases, claus.es, sen- tences, paragraphs and sections of this ordinancea since the same would have been enacted by the City Council without the incorporation in this ordinance of any unconstitutional or invalid phrases, clauses, sentences, parabraphs or sections, It is further hereby declared to be the intention of the City Council of the City of Paris to exclude any area or areas de- scribed in the description of the property to be annexed, which are not within said City's jurisdiction to annex and that such area or areas should be carved out of the descrip- tion of the property herein described by the valid judgment or decree of any court of competent jurisdiction, in order that such area or areas would not cause this annexation ordinance to be found to be invalid, voidable or void. Section 4, This ordinance shall be published and passed in the manner provided in Article II, Section 7, of the Charter of the City of Paris, Paris, Texas.
