A N ORDINA NCE OF THE CITY OF PA R IS, PA R IS, TEXA S,
PROVIDING THAT THE CODE OF ORDINANCES, CITY OF PARIS,
BE AMENDED BY REVISING SECTIONS 19-1 AND 19-2 OF SAID
CODE; PROVIDING DEFINITIONS FOR TERMS USED IN THE
MANUFACTURED HOUSING INDUSTRY AND PROHIBITING THE
LOCATION OF SAME, OTHER THAN AS PERMITTED BY CHAPTER
19 OF THE CODE OF ORDINANCES AND THE ZONING ORDINANCE
OF THE CITY OF PARIS, AND BY REVISING ARTICLE II OF
CHAPTER 19 AND SECTION 19-15, PROHIBITING THE USE OF
TRAVEL TRAILERS AND MOTOR HOMES AS RESIDENCES AND
REPEALING SECTIONS 19-16 THROUGH 19-21 OF SAID CODE;
PROVIDING FOR A PENALTY NOT TO EXCEED $200. 00; RE-
PEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE
DATE OF MAY l, 1981.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PARIS:
Section 1. That Sect.ion 19-1 of the Code of Ordinances of the
City of Paris, Paris, Texas, be amended so that such shall read as
follows:
"Sec. 19-1. Definitions.
Unless otherwise indicated to the contrary, the following
def.initions shall apply in the interpretation of this chapter:
"Manufactured hous.ing" or "manufactured home" means
a mobile home or a modular home or both.
"Mobile home" means any vehicle or sim.ilar portable
structure in excess of eight (8) feet in width having no
foundation other than wheels, jacks, blocks, or sk.irtings,
and so designed or constructed as to permit occupancy for
dwelling or sleeping purposes.
"Dependent mobile home" means a mobile home which
does not have a flush toilet and a bath or shower.
"Independent mobile home" means a mobile home
which has a flush toilet and a bath or shower.
"Modular home" means a structure or building module
that is manufactured at a location other than the location
where .it is installed an:I used as a residence by a consumer,
transportable .in one or more sect.ions on a temporary chassis
or other conveyance device, and is designed fio be used as a
permanent dwelling when installed and placed upon a perma-
nent foundat.ion system. The term includes the plumbing,
heating, air conditioning, and electrical systems contained
in the structure. The term does not include a mobile home
as defined herein, nor does .it include bu.ilding modules
incorporating concrete or masonry as the primary
st ructural component. For purposes in these regula-
tions, the term includes only those structures manu-
factured after May 1, 1980, and bearing a modular decal
of the Manufactured Housing Division, Texas Department
of Labor and Standards.
"Single-wide mobile home" means a structure,
transportable in one or more sections, which is fourteen
(14) body feet or more in width and fifty-two (52) body
feet or more in length, and which is built on a permanent
chassis and .is designed to be used as a dwelling with or
without a permanent foundation when connected to the re-
quired util.ities and includes plumbing, heating, air condi-
tioning, and electrical systems contained therein. For
purpbses in these regulations, the term includes only those
structures manufactured after June 15, 1976, and bearing
a mobile home seal of the Manufactured Hous.ing Division,
Texas D.-partment of Labor and Standards.
"Multi-section mobile home" means a structure,
transportable in two or more sections, wh.ich when placed
on a site is a minimum of twenty-four (24) feet .in width
and a minimum of forty (40) feet .in length and which is
built on a permanent chassis and is designed to be used
as a dwelling with or without a permanent foundation when
connected to the required utilities and includes plumbing,
heating, air conditioning, and electr.ical systems contained
therein. For purposes in these regulations, the term in-
cludes only those structures manufactured after June 15,
1976, and bearing a mobile home seal of the Manufactured
Housing Division, Texas Department of Labor and Standards.
"Mobile home park" means any plot of ground upon
which two (2) or more mobile homes, occup.ied for dwelling
or sleeping purposes, are located, regardless of whether
or not a charge is made for such accommodation.
"Mobile home space" means a plot of ground within
a mobile home park designed Eor the accommodation of
one mobile home.
"Mobile home subdivision" means a subdivision de-
signed and intended for residential use where residence is
permitted .in mobile homes, each being located on a separate
lot. Such subdivision may retain a central management and
may be operated as a plan development, retaining ownership
of streets and common open spaces.
"Travel trailer" means any vehicle or structure, eight
(8) feet and less in width and thirty-five (35) feet and less
in length, designed to be transported and intended for human
occupancy as a dwelling for short periods of time containing
limited kitchen or bathroom facilities.
"Motor home" means any vehicle eight (8) feet and
less in width and thirty-five (35) feet and less in length,
designed to be driven upon the public roads and intended
for human occupancy as a. dwelling for short periods of
time containing limited kitchen and bathroom facilit.ies.
"Natural or artif.icial barrier" means any river, pond,
canal, railroad, levee, embankment, fence or hedge."
Sect.ion 2. That Section 19-2 of the Code of Ordinances of the
City of Paris, Paris, Texas, be amended so that such shall read as
follows :
"Sec. 19-2. Permitted location of manufactured housing.
No manufactured home shall be located within the
City except as permitted by this Chapter and the Zoning
Ordinance of said C.ity. "
Section 3. That Article II of Chapter 19 and Section 19-15
of the Code of Ordinances of the City of Paris, Paris, Texas, be
amended so that such shall read as follows:
"Article IL Travel Trailers and Motor Homes
Sec. 19-15. Use as a residence prohib.ited.
No pe.rson shall occupy or use as a residence any
travel trailer or motor home for more than twenty-four
(24) hours on any premises within the City and outside a
mobile home park. "
Section 4. That Sections 19 -16 through 19 -21 of the Code of
Ordinances of the City of Paris, Paris, Texas, are hereby repealed
and declared null and void and of no effect.
Section 5. Any person violating any of the provisions of this
ordinance shall be guilty of a Class "C," Misdemeanor, and upon
conviction shall be fined in any sum not to exceed $200. 00.
Section 6. All ord.inances or parts of ordinances in conflict
herewith are hereby expressly repealed.
Section 7. This ordinance shall become effective on May l, 1981.
