2573 ORD CONTAINING HEARING ON PROPERTIES LOCATED IN COP BELONGING TO VARIOUS OWNERS ORDINANCE N0. 2573 , AN ORDINANCE CONTAINING A HEARING ON PROPERTIES LOCATED IN THE CITY OF PARIS, TEXAS, BELONGING TO VARIOUS OWNERS, AND AN ORDINANCE OF THE CITY COUNCIL FINDING THE MATERIALS REMAINING IN THE PREMISES TO CONSTITUTE A NLJISANCE AND TO BE A FIRE HAZARD TO LIFE AND PROPERTY AND A HAZARD TO THE LIFE AND WELFARE OF THE INHABI- TANTS OF THE AREA, AND ORDERING SAID RUBBISH, LUMBER AND REFUSE FROM THE STRUCTURES TO BE TORN DOWN AND REMOVED FROM THE PREMISES IN ORDER TO ABATE SUCH NUI- SA NCE. WHEREAS, a public hearing was called to order by the Mayor of the City of Paris, Billy Joe Burnett, on the llth day of May, 1981, at 7:00 o'clock P. M. , in the Council Room, City Hall, in the City of Paris, Texas; and, WHEREAS, the City Council finds that the Builing Hazard Inspection Committee fixed a date for hearing on the resolut.ion re- ferred to the Committee by the City Council on February 9, 1981, and said Committee fixed said hearing at 10:00 o'clock A. M. , on the 24th day of April, 1981, and the hearing was had thereon. That proper notice was given to the owner or owners oE the structures located at the following addresses: 1128 Cooper Street, B lock F, Lot 3, Fuller pohoney Addit.ion 525 Woodlawn, City Block 116, Lot 1-A 514 East Sherman Street, City Block 144, Lot 2 343 East Hearon Street, City Block 142, Lot 18 1325 8th S. E. Street, City Block 188-A, Lot 3-A 803 Sycamore, City Block 188-A, Lot 9 1162 Van Zant, City Block 175-A, Lot 17 1207 llth N. E. Street, City Block 174, Lot 8 1738 Fitzhugh, Block A, Lot 21, East Park Addition 520 7th N. E. Street, Block 63-A, Lot 9 240 E. Provine Street, City Block 73 -A, Lot 3 145 W. Provine Street, C.ity Block 79, Lot 7-A 806 4th N. W. Street, City Block 96, Lot 1 1220 34th N. W. Street, City Block 326, Lot 11 1344 3rd S. W. Street, C.ity Block 171, Lot 5 That at said hearing the Committee l.isted the structures involved and introduced pictures of the various portions of the structures and var- ious portions of the premises involved and a list of d.iscrepancies in the structures located thereon. That the Committee found that each of the above structures was .in such state of deterioration and dilapi- dation as to create a serious fire hazard to life and property and that each of sa.id bti ldings was d.ilapidated and was dangerous to l.ife and property and dangerous structures to l.ife and property. That said bu.ild.ings are in such state of dilap.idation and decay that none of sa.id structures are capable of repair. It is further found that the condi- tion of the premises and structures involved was such that the Committee recommended to the City Council that they be declared a nuisance and that the owners thereof be ordered by the City Council to tear down and remove the same from the lots involved. That said Committee filed a complete report of its hearing and its find.ings with the City Clerk of the City of Paris on the 30th day of April, 1981; and, WHEREAS, the City Counc.il further finds that proper notice was given to the owner or owners of the structures here.inafter listed, That at said hearing on the 24th day of Apr.il, 1981, the Committee listed the structures involved and .introduced pictures of the various portions of the structures and various portions of the prem.ises in, volved and a list of discrepancies in the structures located thereon. That the Committee found that each of the hereinafter listed struc- tures was in such state of deterioration and dilap.idation as to create a serious fire hazard to life and property, and that each of sa.id buildings was dilapidated and dangerous to life and property and dan- gerous structures to life and property. That the owners of the pro, perty appeared before the Committee and requested time to repair the structures or the Committee found that the structures could be re- paired. That it was the recommendation of the Committee that the structures be condemned or repaired and that the respective owners thereof be given the time to abate sa.id nuisance by repair or removal as is set out in connection with each of such addresses, as follows: 832 4th N. Street, City Block 50, Lot 11 6 months 1106 Cooper Street, Block F, Lot 4, Fuller Dohoney Addition 60 days 1331 Bonham Street, Block 2, Lots 21, 22 and 23, Talkington Hodge Addition 60 days 1000 Block West Kaufman Street, Railroad Right of Way 60 days and it is so stated .in the report of the Building Hazard Inspection Comm.ittee f.iled with the City Clerk of the City of Paris on the 30th day of April, 1981; and, WHEREAS, the City Council has fully heard and cons.idered the testimony presented upon the hearing and a complete transcript of the testimony reported by the Bu.ilding Hazard Inspection Committee; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PA R IS: Section 1. That the structures located at the following addresses: 1128 Cooper Street, Block F, Lot 3, Fuller pohoney Addition 525 Woodlawn, City Block 116, Lot 1-A 514 East Sherman Street, City Block 144, Lot 2 343 East Hearon Street, City Block 142, Lot 18 1325 8th S. E. Street, City Block 188-A, Lot 3-A 805 Sycamore, City Block 188-A, Lot 9 1162 Van Zant, City Block 175-A, Lot 17 1207 llth N. E. Street, City Block 174, Lot 8 1738 Fitzhugh, Block A, Lot 21, East Park Addition 520 7th N. E. Street, Block 63 -A, Lot 9 240 E. Provine Street, City Block 73 -A, Lot 3 145 W. Provine Street, City Block 79, Lot 7-A 806 4th N. W. Street, City Block 96, Lot 1 1220 34th N. W. Street, City Block 326, Lot 11 1344 3rd S. W. Street, City Block 171, Lot 5 are a nuisance, and they are hereby declared a nuisance, .in that they are dangerous to life and property, and that the same constitute a fire hazard to life and property, and that the respect.ive owners are hereby ordered to abate such nuisance within thirty (30) days from the date hereof. The City Clerk is d.irected to furnish the owners a copy of this ordinance, in the event the addresses of said owners are known, and in the event the respective owners refuse to comply w.ith this or- dinance, the City Attorney, T. K. Haynes, .is hereby directed to pro- ceed to enforce this ordinance by the procedure provided for .in Article III of Chapter 7 of the Code of Ordinances of the City of Paris. Section 2. That the structures hereinafter enumerated are a nuisance, and they are hereby declared a nuisance, in that they are dangerous to life and property, and that the same constitute a fire hazard to l.ife and property, and that the respective owners are here- by ordered to abate such nuisances on or before the dates set out in connection with the addresses of each of such structures, as follows: 832 4th N. K. Haynes, is hereby directed to proceed to enforce th.is ordinance by the procedure provided Eor in Article III of Chapter 7 of the Code of Ord.inances of the C.ity of Paris. Section 3.
