2597 ORD PROVIDING CODE OF ORDINANCES BE AMENDED BY REVISING SECTION 12-12 OF SAID CODE ORDINANCE N0. 2597 AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, PRO- VIDING THAT THE CODE OF ORDINANCES OF THE CITY OF PARIS, PARIS, TEXAS, BE AMENDED BY REVISING SECTION 12-12 OF SAID CODE; PROVIDING FOR OUTSIDE FIRES AND OPEN FLAME TORCHES; PROVIDING FOR A PENALTY r10T TO EXCEED $200.00; REPEALING ALL O SFOR ANREFFECTOIVEZDATEEOFIDECEMBERCl, H19811TH; AZdD PROVIDING BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section 1. That Section 12-12 of the Code of Ordi- nances of the City of Paris, Paris, Texas, be amended so that such shall read as follows: "Sec. 12-12. Outside Fires and Open Flame Torches. (a) It shall be unlawful for any person to burn trash, brush, grass, leaves, paper, cloth, trees, boards, planks, lumber or any other character of debris or imflammable material whatsoever out-of- doors in the fire l.imits of the city for any purpose whatsoever, except c.ooking, washing and other purely domestic purposes. (b) Whenever it shall become necessary fc,r any person to have a fire out-of-doors and within ths fire limits, for cooking, washing or any other purely domestic purposes, such person is hereby required to build such fire in a fireproof container of some kind r.lade of brick, stone, metal or other fireproof ma- terial or to surround such fire with bricks, stone, netal or other fireproof material in such a way as to prevent such fire from escaping. (c) It shall be unlawful for any person or firm to burn trash, brush, grass, leaves, paper, cloth, trees, boards, planks, lumber or any other character of debris or imflammable material whatsoever out-of- doors outside of the fire limits and within the city unless the same is contained in a fireproof container with a top that prevents the escape of sparks or cinders. (cl) It shall be unlawful for any person or firm to burn any trash, rubbish, garbage, or animal matter in such a manner as to create a foul and offensive odor of such extent to be detected on any adjoining property. (e) Not withstanding the prohibition contained in paragraph (a) ,(b) , and (c) of this section, any acts permitted by the laws of the State of Texas and Fire Departr.lent training exercises are perr:iitted. (f) It shall be unlawful for any person ta install, erect or maintain any open flame torch on any nremises within the corporate limits of the City of Paris unless a permit is obtained for the in-- stallation or erection of sucn torch. Before beginning installation or erection of any open flame torch in the city, an applicant must submit a written request to the office of the fire marshal and include a plot plan showing the location of torches and their proximity to building, vegetation and other combusti- bles, driveways, parking areas, streets and walkways. Cutaway drawings of the device and the method of in- stallation must also be submitted. All torch devices proposed to be installed must bear the seal of approval of tize American Gas Association or other nationally recognized safety testing laboratories. If, after due consideration of the above items, a permit is issued, tne installation must be made under the following conditions: (1) No combustibles, including shrubbery, shall be located within ten (10) feet of the open flame. (2) A regulated orifice shall be placed within the supply line of each torch of such size to prevent a flame of over eighteen (18) inches in height above the burner outlet when the valve is fully open. (3) Gas shall be delivered to the device at a pressure not greater than the pressure normally pro- vided for residential installations, (4) The height: of the bottom of the burner of the torch shall be at least eight (8) feet above the adjacent ground level. (5) Torches adjacent to streets, parking areas, driveways, or walkways shall be curbed or otherwise barricaded to prevent mechanical damage. (6) Torches shall not be located closer than ten (10) feet to any street parking area, driveways or walkways. (7) Torches shall not be installed closer than ten (10) feet to any building or combustible riaterial. (8) Installations shall be made in keeping with the regulations of the plumbing division of the City of Paris." Section 2. Any person violating any of the provisions of this ordinance shall be guilty of a Class "C" Misdemeanor, and upon conviction shall be fined in any sum not to exceed $200.00. Section 3. All ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. Section 4. This ordinance shall become effective on December l, 1981.
