2439 ORD AMENDING ORDINANCE NO 1315 OF COP PROVIDING FOR ENFORCEMENT OF SUBDIVISION REGULATIONS WITHIN ETJ OF COP ORDINANCE NO. 2439 . AN ORDINANCE AMENDING ORDINANCE NO. 1315 OF THE CITY OF PARIS, PROVIDING FOR THE ENFORCEMENT OF SUB- DIVISION REGULATIONS WITHIN THE EXTRATERRITORIAL JURISDICTION OF THE CITY OF PARIS, ESTABLISHING MINIMUM LOT SIZE, INCREASING THE DESIGN STANDARDS FOR SUBDIVI- SION STREET AND UTILITY CONSTRUCTION AND PROVIDING FOR THE DEVELOPER AND OWNER TO GUARANTEE THE PER- FORMANCE OF THE SAME FOR ONE (1) YEAR FROM DATE OF ACCEPTANCE OF A SUBDIVISION; PROVIDING FOR A PENALTY NOT TO EXCEED $200. 00; REPEALING ALL ORDI- NANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF. APRIL l, 1979. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section l. That the first phrase of the caption of Ordinance No. 1315 of the City of Paris shall be amended to read as follows: "AN ORDINANCE PRESCRIBING RULES AND REGU- LATIONS GOVERNING PLATS, PLANS AND SUBDIVISION OF LAND WITHIN THE CORPORATE LIMITS AND THE EXTRATERRITORIAL JURISDICTION OF THE CITY OF PARIS;" and a like change shall be made in the first and second "Whereas" paragraphs, the first paragraph after "BE IT ORDA INED and in the first paragraph of Section II. Section 2. That the "ORDAINED" phrase of said ordinance shall be amended to read as follows: "BE IT ORDA INED BY THE CITY COUNCIL OF THE CITY OF PARIS:" Section 3. That the following shall be added as a Sub - paragraph to Section I: "(17) Extraterritorial Jurisdiction--The phrase "Extraterritorial Jurisdiction" shall mean that unincorporated area contiguous to the corporate limits of the City of Paris to the extent described in Article 970a, Vernon's Annotated Texas Statutes. " Section 4. That Paragraph IV (11) be amended by adding a second paragraph thereto as follows: "A certificate of guarantee of the workman- ship and materials used in the construction and installation of water mains, sanitary sewer mains and street paving for a period of one (1) year from the date of acceptance of the final plat, executed by the developer and owner or owners and by all other parties who have a mortgage or lien in- terest in the property or subdivision. " Section 5. That Paragraph VII, C(1) be amended to read as follows: "(1) Lot Size. The minimum lot size of any lot shall conform to applicable zoning regulations. Section 6. That Paragraph VIII, B be amended to read as follows: "B. Valleys and Dips. Where surface water drains across street intersections, said crossing shall be rein- forced concrete pavement for a distance of not less than four (4) feet in each direction from the centerline of said crossing and said crossing shall extend from curb to curb. The design of these valleys or dips sha 11 be the same as that for concrete pavement. " Section 7. That Paragraph VIII, C(4) be amended by adding thereto the following: "Such street base shall extend to a point not less than one (1) foot back of curb. " Section 8. That the last paragraph of VIII, D shall be amended to read as follows: "All alleys shall have same paving specification requirement as a local street except when said alley is dedicated solely to provide ingress and egress to an existing alley, in which case the alley may have six (6) inches of approved compacted gravel. " Section 9. That the second paragraph of VIII, F be amended by adding the following: "The developer shall be required to provide testing of sewer lines, within his subdivision, to assure that leakage is within the limits established by the City of Paris. " Section 10. That VIII, G shall be amended by changing the first two paragraphs to read as follows: "G. Water Distribution System. The water distribution system shall be based on a design adequate to furnish the anticipated water consumption within the subdivision, including proper fire protection. Water mains less than 6" in diameter shall be con- sidered substandard and will not be allowed, except that any deviation to a lesser diameter may be considered as recommended by the City Engineer. Fire hydrants shall be located so that every lot within the addition will be within 500 feet of same and further said hydrants shall be located so as to con- form to the overall plan of the City. Gate valves shall be installed on leads between fire hydrants and water mains. " Section 11. That Section XIII shall be amended by adding thereto the following: "The developer and owner shall guarantee the work - manship and materials used in the construction and installation of water mains, sanitary sewer mains and street paving within the subdivision for one (1) year from the date of completion of all of such im - provements as certified to by the City Engineer of the City of Paris, which period shall be in addition to the period of guarantee provided for in Section IV (11). " Section 12. That Section XVII shall be amended by adding thereto the following: "Any developer or owner who fails to correct any defect in workmanship or materials used in the construction or installation of water mains, sanitary sewer mains and street paving within thirty (30) days of the date of notification of the same by certified mail, return receipt requested, shall be deemed to be in violation of this ordinance and shall be subject to the penalties herein established. " Section 13. Any person violating any of the provisions of this ordinance shall be guilty of a Class "C" Misdemeanor, and upon conviction shall be fined in any sum not to exceed $200. 00. Section 14. All ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. Section 15. This ordinance shall become effective on April 1, 1979.
