2466 ORD FIXING DATE FOR PUBLIC HEARING ON PROPERTY ON 7TH ST NE ORDINANCE NO. 2466 , AN ORDINANCE FIXING THE DATE FOR A PUBLIC HEARING ON PROPERTY ON 7TH STREET, N. E., FROM THE NORTH EDGE OF PAVEMENT OF EAST CHERRY STREET, NORTHERLY 601.5 FEET TO ITS DEADEND; ON BOOTH ALLEY, FROM THE EAST EDGE OF PAVEMENT OF 7TH STREET, N. E., EASTERLY 392 FEET TO THE WEST EDGE OF PAVEMENT OF 8TH STREET, N. E. ; AND ON BOOTH PLACE, FROM THE EAST EDGE OF PAVE- MENT OF 7TH STREET, N. E., EASTERLY 157 FEET TO ITS DEADEND, IN THE CITY OF PARIS, TEXAS; DIRECTING THE SAME CITY CLERK OF THE HIE P~RISANERIS WS OASUREQUIRED Y LAW; THREE (3) TIMES IN T APPROVING AND ACCEPTING THE FINAL ESTIMATE OF COSTS AND CONSTRUCTION PLANS OF SUCH STREET IMPROVEMENTS AS FILED BY THE DIRECTOR OF PUBLIC WORKS OF THE CITY OF PARIS; FIXING THE CHARGES TO BE ASSESSED AGAINST THE ABUTTING PROPERTY OWNERS AND THE CHARGES TO BE PAID BY THE CITY OF PARIS; AND WITH THE INTENTION OF FIXING A CHARGE AND LIEN AGAINST THE REAL AND TRUE OWNERS OF SAID PROPERTY AND AGAINST THE SAID PROPERTY ITSELF. WHEREAS, the City Council of the City of Paris, Paris, Texas, hereby finds and determines: 1. That the City Council of the City of Paris, Paris, Texas, has heretofore by ordinance duly enacted on the 14th day of August, 1978, determined the necessity for and ordered the improvement of portions of the following streets: (a) 7th Street, N. E. , from the North edge of pavement of East Cherry Street, Northerly 601. 5 feet to its deadend. (b) Booth Alley, from the East edge of pavement of 7th Street, N. E. , Easterly 392 feet to the West edge of pavement of 8th Street, N. E. (c) Booth Place, from the East edge of pavement of 7th Street, N. E. , Easterly 157 feet to its deadend. by grading, constructing curb and gutter and pavement and replacement of inadequate water main and other appurtenances, according to the plans and specifications prepared by the Director of Public 'Works, and change orders thereto. 2. That a notice duly executed in the name of the City of Paris, Paris, Texas, of the enactment of said above described ordinance has heretofore been filed with the County Clerk of Lamar County, Texas, the County in which said City of Paris is situated. 3. That the City Council has caused the Director of Public Works to prepare and file estimates of the costs of such improvements and estimates of the amounts per front foot to be assessed against the property abutting said streets within the limits de - fined and the real and true owners thereof; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section 1. That the date for public hearing before the City Council of the abutting property owners on the above described property is hereby fixed at 7:00 o'clock P. M. , in the City Council Room, City Hall, Paris, Texas, on the 8th day of October, 1979. Zhat the City Clerk is hereby directed to publish in the Paris News, notice of the public hearing, three (3) times prior to said public hearing, the first of said notices to be published at least twenty-one (21) days prior to the date of the public hearing, as required by law. Section 2. That the report to the City Council by the Director of Public Works, consisting of the final estimate of costs of the improvements to the abutting property owners of approximately $5. 82 per front foot for paving and approximately $4. 65 per front foot for curb and gutter, plus any additional costs to extend driveways and other improvements to individual property as requested by property owners, as heretofore approved, and the final construction plans and final estimate, as prepared by said Director of Public Works, are in all things approved by the City Council of the City of Paris. That the City of Paris is to pay one-third of the costs of paving and all the costs of drainage installations, replacement of in- adequate water main and other appurtenances, and all the costs of excavation, base preparation and paving within street inter- sections, in the amount of $28, 042. 64, and the abutting property owners are to pay the remaining costs of $23, 156. 75. Section 3. That it is the intention of the City Council to assess the abutting property owners and to fix a lien against the abutting property, as provided for and under the terms and provisions of Chapter 106 of the Acts of the First Called Session of the 40th Legislature of the State of Texas, now desig- nated as Article 1105b, Vernon's Texas Civil Statutes, under which law these proceedings are taken and had.
