2307 ORD SETTING DATE, TIME AND PLACE FOR PUBLIC HEARINGS BEFORE P&Z COMMISSION OF COP AND CITY COUNCILORDINANCE NO. 2307 , AN ORDINANCE SETTING A DATE, TIME AND PLACE FOR PUBLIC HEARINGS BEFORE THE PLANNING AND ZONING COMMISSION OF THE CITY OF PARIS AND THE CITY COUNCIL OF THE CITY OF PARIS ON THE PROPOSED ANNEXATION OF CERTAIN PROPERTY BY THE CITY OF PARIS, PARIS, TEXAS, AND COMMERCIAL ZONING UPON ANNEXATION, AND AUTHORIZING AND DIRECTING THE MAYOR TO PUBLISH NOTICE OF SUCH PUBLIC HEARINGS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section 1. That a public hearing be held by and before the Planning and Zoning Commission of the City of Paris, Paris, Texas, on the 3rd day of January, 1977, at 7:00 o'clock P. M. , in the Council Room, City Hall, Paris, Texas, and by and before the City Council of the City of Paris, Paris, Texas, on the lOth day of January, 1977, at 7:00 o'clock P. M. , in the Council Room, City Hall, Paris, Texas, giving all interested persons the right to appear and be heard on the proposed annexation and commercial zoning upon annexation of the following described property: BEGINNING at the Northeast corner of a 4. 72 acre tract of land out of the Isaac Cruse Survey, conveyed John R. Webster, Jr. , by deed dated January 10, 1976, recorded in Volume 575, Page 443, Deed Records, Lamar County, Texas, said corner being in the South Right of Way Line of U. S. Highway No. 82 and in the present City Limit Line of the City of Paris; THENCE S 1 degree 00 minutes W with the present City Limit Line and the East Boundary Line of said Webster tract, a distance of 504.0 feet to a point; THENCE N 88 degrees 55 minutes W, parallel with and 504 feet South of the South Right of Way Line of U. S. Highway No. 82, a distance of 540. 0 feet to a point in the most Easterly West Boundary Line of a 54.80 acre tract of land conveyed Lisle Mullins and wife, Helen Mullins, by deed dated January 11, 1966, recorded in Volume 438, Page 292, Deed Records, Lamar County, Texas; THENCE N 1 degree 00 minutes E, along said West Boundary Line, a distance of 504. 0 feet to a point in the South Right of Way Line of U. S. Highway No. 82; THENCE S 88 degrees 55 minutes E, along said South Right of Way Line of U. S. Highway No. 82, a distance of 540.0 feet to the place of beginning and containing 6.27 acres of land, more or less. Section 2. That the Mayor of the City of Paris, Paris, Texas, is hereby authorized and directed to cause notice of such public hear- ings to be published once in the newspaper having general circulation in the City and in the above described territory not more than twenty (20) days nor less than ten (10) days prior to the date of such public hearings, all in accordance with the Municipal Annexation Act (Chapter 160, Acts of the 58th Legislature, Regular Session, 1963; compiled as Article 970a, Vernon's Texas Civil Statutes). Section 3. It is hereby declared to be the intention of the City Council of the City of Paris that the sections, paragraphs, sen- tences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional or invalid by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality or invalidity shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any unconstitutional or invalid phrases, clauses, sentences, paragraphs or sections. It is further hereby declared to be the intention of the City Council of the City of Paris to exclude any area or areas described in the description of the property to be annexed, which are not within said City's jurisdiction to annex and that such area or areas should be carved out of the description of the property herein described by the valid judgment or decree of any court of competent jurisdiction, in order that such area or areas would not cause this annexation ordinance to be found to be invalid, voidable or void.
